A RESOLUTION AUTHORIZING THE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT (MOA) WITH THE BAGUMBAYAN VOLUNTEERS OF OLONGAPO, INC. FOR THE USE OF VACANT LOT AT OTERO AVENUE, MABAYUAN FOR THE BAGUMBAYAN OFFICE AND SKILLS TRAINING CENTER ANNEX

Whereas, Bagumbayan Volunteers of Olongapo City, Inc. has been a partner of the city government for the implementation of skills training programs of the city;

Whereas, Bagumbayan Volunteers of Olongapo City, Inc. received cash prize of One Million Pesos worth of project from the winning of former Councilor Edwin J. Piano as the Most Outstanding Councilor of the Philippines through the Priority Development Fund of Senator Edgardo Angara;

Whereas, the Department of Budget and Management through the recommendation of the office of Senator Angara approved the construction of a building for the use of Bagumbayan and Skills Training Center;

Whereas, Bagumbayan Volunteers of Olongapo City, Inc. requested the city government for the use of a parcel of idle lot owned by the city adjacent to Filtration Plant at Otero Avenue, Barangay Mabayuan, Olongapo City and marked as Lot 8 in the City Assessor’s Property Identification map;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter into and sign a Memorandum of Agreement (MOA) with the Bagumbayan Volunteers of Olongapo, Inc. for the use of vacant Lot at Otero Avenue, Mabayuan for the Bagumbayan office and Skills Training Center Annex.

A RESOLUTION EXPRESSING DEEPEST SYMPATHIES AND CONDOLENCES TO THE BEREAVED FAMILY OF DAVID B. SALLES, SR. FORMER BARANGAY COUNCIL MEMBER OF EAST BAJAC-BAJAC, THIS CITY.

WHEREAS, David B. Salles, Sr., former Barangay Council Member of East Bajac-Bajac, this city peacefully joined his creator on September 2, 2011 at the age of 81;

WHEREAS, David B. Salles, Sr. served the said barangay as it Council Member from 1997 to 2002 to 2007 to 2010;

WHEREAS, Mr. Salles, aside from being a barangay official, was also one of the forerunners of various communication groups in the city, such as the Ulo ng Apo DX3 UNA Radio Club, as its Past President, Olongapo Integrated Communication (OIC), as its founding member and RESCUE 548 as its Director. He was also the Past President of Bicolnon Association;

WHEREAS, “Ka Salles”, as he is fondly called, is known for his scholarly and wise counsel;

WHEREAS, his candid views and opinions during legislative deliberations were always admired and respected by his peers in the Barangay Council;

WHEREAS, to his credit, the Barangay Council churned out numerous quality legislative measures that greatly redounded to the welfare of their barangay;

WHEREAS, in the performance of his functions, Barangay Councilor Salles was a very efficient public servant pouring out his best efforts for the benefit of his constituents;

WHEREAS, Olongapo City joins the Salles family in its grief over the loss of a distinguished barangay legislator, esteemed public servant and the beacon of their family;

NOW, THEREFORE, on motion of City Councilor Elena C. Dabu co-sponsored by City Councilors Eyrma Yvette Marzan-Estrella, Aquilino Y. Cortez, Jr., James G. delos Reyes, Gina Gulanes-Perez, Eduardo J. SECTION 3. This request is in reference to the letter of the Iglesia ni Cristo addressed to the City Mayor dated August 31m 2011.

A RESOLUTION DECLARING A STATE OF IMMINENT DANGER IN MT. BALIMPUYO ROCKSLIDE, TABACUHAN, STA. RITA, OLONGAPO CITY AREA AND CALLING ON THE DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES (DENR), THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS (DPWH) AND OTHER PERTINENT NATIONAL GOVERNMENT OFFICES TO EXPEDITIOUSLY ACT TO ARREST THE IMPENDING DANGER, IN NATIONAL GOVERNMENT TERRAIN IN A MANNER CONSISTENT WITH LAW

WHEREAS, there are communities situated in areas in the Mt. Balimpuyo Rockslide, Tabacuhan, Sta. Rita, Olongapo City which under Department of Environment and Natural Resources (DENR) maps are considered alienable and disposable;

WHEREAS, recent information from pertinent government agencies such as Bureau of Mines and Geosciences shoe that there subsists rock formations/boulders which may be considered unstable and, compounded by the current weather conditions, may possibly fall-off does posing a real danger to the lives and properties of the communities in the Mt. Balimpuyo, Tabacuhan, Sta. Rita area;

WHEREAS, the City has already undertaken short-term and medium-term measures such as the provision for social; services and temporary relocation to the affected families estimated to be around more than one-hundred fifty families, with a number of families temporarily placed in a safe site;

WHEREAS, there is a need for both prompt action to complement the City’s on-going efforts to arrest the current impending dangers and a long-term solution which mandate action on the part of the Department of Environment and Natural Resources (DENR), the Department of Public Works and Highways (DPWH) and other pertinent National Government Offices in the light of findings that the Mt. Balimpuyo Rockslide, Tabacuhan, Sta. Rita, Olongapo City area where the dangerous rock formation are situated is within national government terrain;

WHEREAS, the City recognizes the object, prudent, and real need to facilitate holistic and long-term looking responsive action to protect the welfare and well-being of local communities, in a manner compliant and consistent with law;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare, as it hereby declares a state of imminent danger in Mt. Balimpuyo Rockslide, Tabacuhan, Sta. APPRECIATION TO THE CREW OF USS FRANK CABLE

A RESOLUTION EXPRESSING APPRECIATION TO THE CREW OF USS FRANK CABLE FOR THEIR INVALUABLE SERVICES AND SUPPORT TO THE PEOPLE OF OLONGAPO

Whereas, Submarine Tender USS Frank Cable, on port visit in Subic Bay Freeport Zone to conduct maintenance and support of submarines and surface vessels deployed in the U.S. 7th Fleet area of responsibility;

Whereas, while on dock at Alava Pier, Subic Freeport, the crew volunteered to make their visit more meaningful and conduct community services in Olongapo and Subic Town;

Whereas, among the services they conducted were Medical and dental consultations at Niños Pagasa Orpahange. They also repainted the interior of the orphanage, repaired electrical fixtures, replaced cushions and leather covers of sofas, donated tables and bookshelves;

Whereas, the group repainted school rooms, refurbished its furniture and electrical fixtures, did medical and dental consultations at Ilwas Elementary School, Subic and had fun games with the community;

Whereas, On their third day of community service activity in Olongapo City and Subic, Zambales, the crew of USS Frank Cable became champions of the environment, together with Bagumbayan Volunteers and Barangay Kalaklan Officials conducted tree planting and shoreline clean-up at Parola Area, Kalaklan;

Whereas, this goodwill gesture of US Navy Servicemen refreshes the lasting friendship and cooperation between the American Servicemen and Olongapeños;

NOW THEREFORE, on a unanimous accord of the Members of the Sangguniang Panglungsod present,

A RESOLUTION SUPPLEMENTING THE CITY COUNCIL RESOLUTION NO. 10, SERIES OF 2011 BY INCLUDING AN ADDITIONAL EIGHTY – THREE MILLION THREE HUNDRED THOUSAND PESOS (PHP83,300,000.00) IN THE AUTHORIZED LOAN THEREIN TO FACILITATE COMPLIANCE WITH THE DEVELOPMENT BANK OF THE PHILIPPINES TECHNICAL REQUIREMENTS FOR THE SANITARY LANDFILL DEVELOPMENT PROGRAM, AND AUTHORIZING THE HON. CITY MAYOR JAMES GORDON, JR. TO EXECUTE AND SIGN THE REQUIRED DEED OF ASSIGNMENT, PROMISSORY NOTE AND OTHER DEED/INSTRUMENTS RELATED THERETO, IN A MANNER CONSISTENT LAW

WHEREAS, the City Council unanimously approved a Sangguniang Panlungsod Resolution No. 10, Series of 2011 dated February 2011, which authorized the City Mayor to contract a loan agreement with the Development Bank of the Philippines (DBP) in the amount of Three Hundred Million Pesos, under the best possible terms, to avert an impending garbage crisis;

WHEREAS, as per initial submission by the city of its loan application, acceptance and approval of the requested loan was withheld as the DBP’s Clean Development Mechanism program, such as the centralized composting facility/material recovery facility, a critical component for the attainment of the city’s waste diversion goals as it facilitates minimizing the volume of wastes for final disposal and maximizes and prolongs the life of the sanitary landfill facility, in addition to the city’s initiative to instead request for one-hundred percent (100%) financing of the project, which entails an additional costing of Eighty Three Million Three Hundred Thousand Pesos (PhP83, 300,000.00), inclusive of the costs for construction and purchase of pertinent equipment;

WHEREAS, as per Notice of Closure dated 19 May 2011 from the Department of Environment and Natural Resources Regional Office, there is a continuous impending enforcement of a closure order against the city’s controlled dumpsite, pending compliance with the required establishment of a complete Sanitary Landfill compliant with Republic Act No. 9003 (RA 9003), otherwise known as “Solid Waste Management Act of 2000”;

NOW THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod, in session assembled, to Supplement, as it hereby Supplements the City Council Resolution No. 10, Series of 2011 by including an Additional Eighty-Three Million Three Hundred Pesos (PhP83, 300,000.00) in the Authorized Loan therein to facilitate compliance with the Development Bank of the Philippines Technical Requirements for the Sanitary Landfill Development Program, and Authorizing the Hon. City Mayor James Gordon, Jr. to execute and sign the required Deed of Assignment, Promissory Note and other Deeds/Instrument related thereto, in a manner consistent with Law.

RESOLUTION NO. 69

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER, EXECUTE AND SIGN A MEMORANDUM OF AGREEMENT WITH THE DEPARTMENT OF LABOR AND EMPLOYMENT FOR THE ‘NEGOSYO SA KARITON’ (NEGOKART) LIVELIHOOD PROGRAM FOR THE CITY

WHEREAS, the Department of Labor and Employment (DOLE) instituted a program known as the Negosyo sa Kariton (‘NegoKart’) Capability Building for Livelihood Formation and Enhancement as part of its ‘Kabuhayan Program’ to help persons not suited for traditional employment become grassroots based entrepreneurs;

WHEREAS, under the program, DOLE shall provide fund assistance in the amount of Fifteen Thousand Pesos for one (1) beneficiary from each barangay which shall serve as the capital for both the construction of the ‘cart’ (‘kariton’)and the purchase of the merchandise to be sold as may be chosen by the beneficiary;

WHEREAS, DOLE will be allocating Two Hundred Twenty Five Thousand Pesos (PhP225,000.00) or PhP15,000.00 each for the beneficiaries from fifteen barangays – given that two (2) barangays have pending allocations for DOLE- assisted projects which must first be consummated and liquidated;

WHEREAS, as per DOLE determination, each ‘Nego-Kart’ would cost Eighteen Thousand Seven Hundred and Fifty Pesos (PhP18,750.00) or a total of ‘PhP281,250.00’ for the fifteen nego-karts- and has required local government units (LGUs) to provide twenty-percent (20%) of the said cost per cart as its counterpart obligation for the fifteen Nego-kart beneficiaries as a precondition for the availment of the fund assistance – in that DOLE shall provide the PhP225,000.00 (representing 80% of the total project cost of P281,250) while the LGU shall provide P56,250 (representing 80% of the said project cost);

WHEREAS, to encourage entrepreneurship, the beneficiaries were required to submit a basic proposal on the type of Nego-Kart business which was submitted to and approved by the DOLE Regional Office;

WHEREAS, the Sanggunian of other jurisdictions in Zambales such as Iba, Botolan, Palauig and San Narciso have also availed of the program and have passed the necessary resolution/s with provision for the counterpart LGU funding to avail of the benefits accruing from the DOLE Nego-Kart initiative;

WHEREAS, under the program, DOLE with the Public Employment Service Office (PESO) would provide technical assistance in the form of coordination with other government agencies such as Department of Trade and Industry to provide support for the program beneficiaries;

WHEREAS, to ensure that the Nego-kart beneficiaries act in accordance with law, they secure the necessary permits for the operation, and act responsibly and not become illegal vendors and become a public nuisance, DOLE with the City shall be charged with overseeing, monitoring and assisting in the implementation of the project, including facilitating the submission of the required progress and financial reports through the DOLE as required under the program;

A RESOLUTION COMMENDING HON. MARLON AUSTRIA, BARANGAY COUNCILOR OF EAST TAPINAC, OLONGAPO CITY FOR BEING ONCE AGAIN ELECTED AS THE NATIONAL SECRETARY GENERAL OF THE BARANGAY COUNCILORS LEAGUE OF THE PHILIPPINES (BCLP) HELD ON JUNE 21, 2011 AT THE BAY VIEW PARK HOTEL, MANILA

WHEREAS, the Local Government Code authorizes the creation of two (2) kinds of leagues, namely; the League of LGUs and the League of Elective Local Officials. The BCLP falls under the second type of league, whose creation is authorized by laws;

WHEREAS, the Constitution and By-Laws of the Barangay Councilors League of the Philippines, under Article II Objectives, Section 1 provides that: “The League shall have the primary purpose of ventilating, articulating, and crystallizing issues affecting Barangay government administration and securing through proper and legal means, solutions thereto”;

WHEREAS, under Article III Powers and Functions, Section 6. The Secretary-General shall perform the following duties;

a. Exercise overall supervision over the National Secretariat;

b. Recommended to the President for appointment the personnel and staff who will compose the permanent working staff of the National Secretariat:

c. Initiated the means and processes by which the memberships of the league are fully informed of all activities and operations of the league;

d. Prepare a budget for the operation, functions and activities of the league in consultation with the treasurer and auditor of the league;

WHEREAS, the Barangay Councilors League of the Philippines National Executive Council Assembly was held last June 20, 2011 at the Bayview Park Hotel, Manila;

WHEREAS, in the first quarter of 2003; the 1st meeting of the Barangay Councilors was held at Kong’s Restaurant which was attended by numerous Barangay Kagawads from the 17 barangay of Olongapo City who ensured the call and discussed the purpose of creation of an organization of the 1st Councilor to look for the last, efficient and honest delivery of basic services in the barangay level;

WHEREAS, the Hon. Marlon Austria has long served community of Olongapo since 1996-2002 where he served as SK Chairman of Barangay East Tapinac; 2002-2007 Barangay Councilor, rank #7; 2007-2010 Barangay Councilor, rank #5 and 2010 to present on the same position;

NOW THEREFORE, on motion of City Councilor James G. Delos Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

WHEREAS, the Department of Health recognizes the participation of private sectors for quality improvement in health system;

WHEREAS, MedAsia Healthcare System, Philippines, Incorporated (MedAsia) is a health care management specialist company providing and promoting comprehensive medical and health care programs consisting of preventive health care, in-patient and out-patient services, providing support services with a ‘24/7 assistance center’ wherein medical insurance policy holders can call for any inquiries during actual availment of their medical benefits and coordinating with medical health institutions to ensure delivery of health care services to its members or members of its partner companies;

WHEREAS, James L. Gordon Memorial Hospital accommodates health insurance providers which cater to patients who voluntarily avail of health insurance from private firms, either independent of or in addition to their Philippine Health Insurance (Phil-Health), subject to its submission of a copy of a clearance from the Department of Health as required under the National Health Insurance Act (or Republic Act No. 7875);

WHEREAS, the agreement would provide and additional safety mechanism that would assist patients and facilitate payment of their medical cost given that MedAsia has made an express warranty that it guarantees payment for all expenses incurred by its members for all medical care rendered by JLGMH including but not limited to emergency care, hospitalization expenses, medicines, laboratory and diagnostic procedures, doctors’ fees and other related care ordered by the attending accredited physician;

NOW THEREFORE, on motion of City Councilor Edna A. Elane, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

TO ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT TO AUGMENT THE HONORARIUM OF THE COMMUNITY DEVELOPMENT OFFICER AS THE CITY’S COUNTERPART PERTINENT TO SERVICING THE TWO HUNDRED TWENTY BENEFICIARIES OF THE PEARL S. BUCK FOUNDATION PHILIPPINES, INC. OLONGAPO CITY OFFICE.

WHEREAS, the Pearl. S. Buck Foundation (PSB), a Non-Government Organization (NGO), has been a partner of the Olongapo City Government in providing assistance and services for marginalized youth in the Philippines specially in the Olongapo City- Zambales area;

WHEREAS, the PSB, as registered with the Olongapo City Community Social Welfare and Development Office, is required under the Department of Social Welfare and Development (DSWD) Administrative Order No. 13, Series of 2005 [under Social Welfare and Development Standards paragraph “I(B)(3)(b.2)]” to deploy Community Development Officers (CDOs) [or Supervising Social Workers] who are duly-licensed social workers to monitor its two hundred and twenty (220) beneficiaries in the Olongapo-Zambales area;

WHEREAS, PSB as the City’s consistent partner in social services initiatives is willing to extend its assistance in catering to the youth beneficiaries of the Olongapo-Zambales area and in exchange the City shall provide the necessary social workers (CDOs) as its counterpart duty in the initiative of serving underprivileged youth;

WHEREAS, PSB caters to beneficiaries in the entire country despite its limited resources, it has even come forth and manifested its willingness to shoulder the remuneration of one CDO (which is supposed to be part of the City’s counterpart duty);

WHEREAS, the PSB has manifested that it is willing to provide fund subsidy for an additional one (1) CDO in the amount of Three Thousand Pesos (Php3, 000.00) to remunerate another CDO, and thus the City only has to shoulder Seven Thousand Pesos (Php7, 000.00) to ensure that the ‘220’ beneficiaries of the PSB initiative in the Olongapo-Zambales are would be best served by a property remunerated licensed social worker- Community Development Officer as the City’s counterpart;

NOW THEREFORE, on motion of City Councior Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

WHEREAS, the city affirms the constitutional recognition of the role of the youth in nation building and the need to provide social support for projects that promote their development into healthy and socially responsible citizens;

WHEREAS, the Department of Social Welfare and Development (DSWD) is in the process of implementing a Nationwide Supplement Feeding Program which will benefit fifty five (55) Day Care Centers in Olongapo City, comprised of two thousand one hundred ninety five (2,195) pre-school children;

WHEREAS, the DSWD, through the Olongapo City Social Welfare and Development Office will provide funding for the Supplemental Feeding Program in the amount of Three Million Five Hundred Eighty Four Thousand and One Hundred Seventy Five Pesos (Php3,584,175.00). This is for the conduct of a Six (6)-Month Feeding Program to commence in July 2011, while the city shall provide the local person who shall be the City Social Welfare Officer;

A RESOLUTION CONFIRMING THE APPOINTMENT OF MR. FERNANDO M. MAGRATA AS CITY GOVERNMENT DEPARTMENT HEAD II (CITY ADMINISTRATOR) SG-26, UNDER THE CITY ADMINISTRATOR’S OFFICE.

WHEREAS, the City Mayor has appointed Mr. Fernando M. Magrata as City Government Department Head II (City Administrator) under the City Administrator’s Office pursuant to Civil Services Laws, Rules and Regulations;

WHEREAS, Section 454(d) of RA 7160, otherwise known as the Local Government Code of 1991, provides that heads of departments shall be appointed by the City Mayor with concurrence of the majority of all Members of Sangguniang Panlungsod.

NOW THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IS HEREBY RESOLVED, by the Sannguniang Panlungsod in session assembled, to confirm, as it hereby confirms, the appointment of Mr. Fernando M. Magrata as City Government Department Head II (City Administrator) SG-26, under the City Administrator’s Office which effects the appropriation in the amount of Four Hundred Nineteen Thousand Three Hundred Forty Pesos (Php419,340.00) in the item City Government Department Head II under the account “salaries” of the City Administrator’s Office.

WHEREAS, Generali Pilipinas is a health insurance company providing medical coverage to their members;

WHEREAS, James L. Gordon Memorial Hospital accommodates health insurance providers as most companies are availing medical insurance for their employees aside from their PhilHealth membership;

WHEREAS, with this agreement, it will give an opportunity for James L. Gordon Memorial Hospital to ensure that the third party will be billed and will be paying the hospital for their members;

SECTION 1. That 18th Street between Graham and Harris Street, Barangay East Baajac-Bajac, Olongapo City is declared temporarily closed from 7:00 a.m. to 12:00 noon on June 11, 2011.

SECTION 2. The above-mentioned temporary closure is in line with the Grand Opening and Blessing of Ridon’s St. Jude Medical Center.

SECTION 3. Re-routing of vehicle to be outlined by the Office of the Traffic Management and Public Safety is necessary during the said closure.

AN ORDINANCE ADOPTING THE “HIMNO NG OLONGAPO” AS THE OFFICIAL HYMN OF OLONGAPO CITY

SECTION 1. The Official hymn of Olongapo City is entitled “Himno ng Olongapo”

SECTION 2. The Himno ng Olongapo shall always be sung in the original language in which it was composed. The following shall be the lyrics of the Himno ng Olongapo.

Sa Perlas ng Silangan

Bayani ang mamamayan

Malasakit sa bayan sa puso’y nagnunulay

Ipinagbubunyi Olongapo aming bayan

SECTION 3. The rendition of the Himno ng Olongapo, whether played or sung, shall be in accordance with the musical arrangement and composition of Roland Fronda and Allan Maroda. No remix arrangements/versions or modification of the original version is allowed when it is sung during ceremonies and formal and official programs and gatherings. The Himno shall be performed within 80-84 MM (metronome marking) or BPM (beats per minute). However, the Himno may be performed in faster tempo as may be deemed appropriate but not to exceed more than 100 MM or BPM when sung during athletic gatherings or similar activity. Provided further that when the Himno is sung in a fast tempo, the prosody and syllabication of the lyrics as notated in the musical score is strictly preserved.

SECTION 4. When the Himno ng Olongapo is played in a public gathering, whether by a band or by singing or both, or reproduced by any means, the attending public shall sing the anthem. The singing must be done with fervor. As a sign of respect, all persons shall stand at attention and face the Olongapo City flag (if there is one displayed); and if there is none, they shall face the band or the conductor.

SECTION 5. REGULATORY PROVISION

1. The official Olongapo City Hymn shall be disseminated to all barangays of this City, national government offices and agencies, departments and agencies under the local government unit, accredited non-government organizations, public and private schools, local radio stations and the public in general.

2. The hymn shall be played after the Panunumpa ng Katapatan sa Watawat ng Pilipinas or the Phil. National Anthem un the absence of the former.

3. The hymn shall be played or sung in all government functions, gatherings, or special occasions.

4. Private schools and organizations with non-government functions, during their gatherings within the City, are also encouraged to play or sing the hymn.

5. As the Olongapo City Hymn is played or sung, everyone in attendance shall be required to stand as a gesture of respect.

A RESOLUTION REQUESTING THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) AND SUBIC BAY FREEPORT LOCATORS TO DONATE SCRAP MATERIALS AND OTHER ITEMS TO THE CITY OF OLONGAPO FOR VARIOUS LIVELIHOOD AND SKILLS TRAINING PROGRAMS AND PROJECTS

WHEREAS, Olongapo City and the Subic Bay Metropolitan Authority as well as the Freeport locators have long standing economic, social and cultural partnerships in various developmental projects;

WHEREAS, SBMA has scrap materials stored at the warehouse yard which are not being utilized and will be better of donated to the Olongapo City Government for beneficial use of its residents;

WHEREAS, Freeport locators, on other hand, can directly help the various city programs by donating their scrap materials such as rags, wood, metal and plastic materials as well as other recyclable/reusable items;

WHEREAS, the aforesaid materials can be of better use for poverty alleviation and livelihood/skills training programs of Olongapo City;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the members of the Sangguniang Panlungsod present,

A RESOLUTION COMMENDING THE BUSINESS ONE STOP SHOP (BOSS) FOR AN EXEMPLARY PERFORMANCE AS HALL OF FAME AWARDEE IN STREAMLINED PROCEDURES IN THE ISSUANCE OF MAYOR’S PERMIT

WHEREAS, in the Business Permit and Licensing Office is one of the special service divisions in the Olongapo City Government tasked at processing and issuance of permits and regulating business establishments;

WHEREAS, in 2008, the City of Olongapo revived the “Olongapo Business One Stop Shop”; rendering prime service to the public with the Business Permit Licensing Office, City Planning and Development Office, City Engineering Office, City Health Office, City Treasurer’s Office, Environmental Sanitation and Management Office and Bureau of Fire together serving the needs of the business community;

WHEREAS, from then on, Olongapo City’s BOSS has been receiving special awards and recognition which include the “Best One Stop Shop” in Central Luzon and First Place in the Documented Streamlined Procedures in the Issuance of Mayor’s Permit in 2008 by Central Luzon Growth Corridor Foundation Inc. (CLGCFI);

WHEREAS, for two consecutive years of 2009 and 2010, the Olongapo City’s BOSS received Special Citation in the Most Business Friendly LGU Award by the Philippine Chamber of Commerce and Industry (PCCI);

WHEREAS, in January 2010, the Olongapo’s BOSS was given the ISO 9001: 2008 Certificate in the processing and issuance of Mayor’s Permit for business establishment by SGS United Kingdom Ltd;

WHEREAS, in 2010, the BOSS received a Plaque of Recognition – Model LGU in the Implementation of Reforms under the Nationwide Streamlining of Business permits and Licensing System by the Department of Trade and Industry (DTI), Department of the interior and Local Government (DILG), CLGCFI and once again, First Place in Documented Streamlined Procedures in the Issuance of Mayor’s permit by CLGCFI which resulted for them to clinch the Hall of Fame Award for Outstanding Achievement as consistent First Place Winner for Three consecutive years in the implementation of Documented Streamlined Procedures in the issuance of Mayor’ Permit;

WHEREAS, with their strong drive to meet their objectives, the number of registered business establishments grew from 4,985in 2007 to 6,340 in 2010; revenues from business taxes and fees have also increased from PhP67 Million in 2007 to Php91 Million in 2010;

WHEREAS, the Olongapo City Business One Stop Shop has shown an exemplary performance with should serve as a model and inspiration to the whole City Government Organization;

WHEREAS, the combined efforts of the Aforesaid offices, resulted to additional projects being implemented for the constituents of Olongapo City through its HELPS program initiated by the present administration of Honorable City Mayor James Gordon, Jr. ;

NOW, THEREFORE, on motion of the City Councilor James G. Delos Reyes, with the unanimous accord of the Members of the Sangguniang Panlugsod present;

A RESOLUTION REITERATING OLONGAPO CITY’S REQUEST TO THE SUBIC BAY METROPOLITAN AUTHORITY TO ASSIST BY THE WAY OF ALLOCATING FUNDS OR EQUIPMENT IN THE DREDGING OF CHANNELS AND RIVERS SHARED BY OLONGAPO CITY AND SUBIC BAY FREEPORT AS PER RESOLUTION NO. 47, SERIES OF 2010

WHEREAS, the City Government recognized the danger brought about by clogged and polluted waterways and there is, in fact, an urgent need to dredge and revive Olongapo waterways to prevent massive flooding, polluted beaches, and scarcity of clean water both in the city and Subic Bay Freeport;

WHEREAS, the industrialization and reclamation by the SBMA and its locators contributed in the clogging and pollution of the city’s rivers and bay;

WHEREAS, the city government in its vigorous campaign to protect and maintain its rivers and channels through continuous implementation of dredging operations, sees the need for SBMA, who shared rivers and channels with Olongapo, to assist by way of allocating more or less Thirty Million Pesos (PhP30M) or needed equipment for the immediate de-clogging of rivers and channels shared by Olongapo City and Subic Bay Freeport;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguininag Panlumgsod present;

WHEREAS, the Olongapo City Government acquired a dredging machine last year for the de-clogging of Olongapo City waterways and started to dredge the Kalaklan River;

WHEREAS, dredging, desilting, declogging operations have since been undertaken at various waterways of the city;

WHEREAS, the dredging of Kalaklan River is rendered futile because Subic Bay’s natural flow causes the sand to build up at the mouth of Kalaklan River which was aggravated by the reclamation project at Moonbay Marina.

WHEREAS, a study conducted by experts in flood control suggests that a jetty/breakwater or other similar structure must be constructed at both sides of Kalaklan River to prevent clogging at the mouth of Kalaklan River;

WHEREAS, the City Government of Olongapo thru the CDF of Senator Richard Gordon had completed the jetty construction at its side and requested SBMA to construct a similar structure on their side as part of their social responsibility.

WHEREAS, the recent flooding were unprecedented in the history of the city and flood experts conclude that the Moonbay Marina Project which Olongapo strongly opposed, contributed in such massive flooding. Furthermore, such project is devoid of Environmental Compliance Certificate (ECC) and Environmental Impact Statement and has not been approved by DENR, and therefore must implement required mitigating measures;

WHEREAS, the City Government thru the City Council deems it necessary to reiterate that SBMA construct a jetty/breakwater or other similar structure at their side at the mouth of Kalaklan river;

NOW, THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to reiterate, as it hereby reiterates Olongapo City’s Request to the Subic Bay Metropolitan Authority (SBMA) to contruct a jetty/breakwater or other similar structure to prevent clogging at the mouth of Kalaklan River as per Resolution no. 44, Series of 2010.

Let copies of this Resolution be furnished to SBMA, DENR, DPWH and Moonbay Marina for their information and record.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO SIGN AND ENTER INTO A MEMORANDUM AGREEMENT (MOA) WITH THE STA. CECILIA MEDICAL CENTER FOR A REFERRAL SYSTEM WITH THE JAMES L. GORDON MEMORIAL HOSPITAL, IN A MANNER CONSISTENT WITH LAW

WHEREAS, the James L. Gordon Memorial Hospital (JLGMH) is the most equipped level 4, tertiary training hospital in the Olongapo City-Zambales area in terms of medical services and facilities, and has become among the most in-demand medical facilities in the Central Luzon area with an estimated volume of surgical procedures of three thousand five hundred (3,500) operations annually, and the conduct of an estimated ten to twelve (10-12) daily operations involving elective and emergency surgical procedures;

WHEREAS, given its standing as a level 2 hospital, the Sta. Cecilia Medical Center of Iba, Zambales has been in the practice of referring patients which their hospital could not accommodate to the JLGMH which has been assisting it in providing the necessary services demanded by the Olongapo City-Zambales communities;

WHEREAS, the department of health issued a directive to the effect that there is a need for the Sta. Cecilia Medical Center of Iba, Zambales to enter into a Memorandum of Agreement with a tertiary hospital, such as the JLGMH with whom it has had a previous tie-ups , to ensure that patients not accommodated could be promptly referred to another hospital with a formal referral set-up with it;

WHEREAS, among the formal requirements for the renewal of the accreditation of Sta. Cecilia Medical Center of Iba, Zambales is the submission of a memorandum of agreement with a tertiary hospital – and thus it has requested JLGMH to grace its request on formalizing its existing referral system with said medical facility;

NOW, THEREFORE, on motion of City Councilor Edna Elane, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to sign and enter into a memorandum of Agreement (MOA) with the Sta. A RESOLUTION EXTENDING RECOGNITION AND APPRECIATION TO THE OFFICE OF CIVIL DEFENSE-REGION 3 DIRECTOR AND REGIONAL DISASTER RISK REDUCTION AND MANAGEMENT COUNCIL CHAIRPERSON NERI G. AMPARO FOR HER INVALUABLE SUPPORT AND SERVICES RENDERED TO THE PEOPLE OF OLONGAPO IN TERMS OF DISASTER RISK REDUCTION AND MANAGEMENT

WHEREAS, it is the desire of the City of Olongapo to give appropriate acknowledgement and recognition to individuals who have rendered invaluable service to its citizens;

WHEREAS, the Office of the Civil Defense Region 3 Director and Regional Disaster Risk Reduction and Management Council Chairperson Neri G. Amparo will be retiring from public service effective at the close of office hours on May 26, 2011 after serving faithfully and effectively for thirty-four (34) years;

WHEREAS, Dir. Neri G. Amparo worked with Olongapo City to improve its disaster risk reduction and management programs, and provided extraordinary service to the City Disaster Risk Reduction and Management Council by lending the knowledge and expertise she has acquired through the years as both a disaster manager and a successful public servant;

WHEREAS, during her directorship, Olongapo City improved its disaster risk reduction and management programs, increased its standards, enhanced its people’s skills and knowledge on disaster management, and won both the Regional and National Gawad Kalasag Hall of Fame Awards for Olongapo Fire-Rescue Team as Best Government Emergency Responders and Olongapo City Disaster Coordinating Council as Best City Disaster Coordinating Council – Highly Urbanized City Categories, respectively;

WHEREAS, as the OCDR3 director, she has led the efforts to manage every disaster happening within Central Luzon, and actively extended assistance to incidents happening in many places of the country;

WHEREAS, the legacy she left to Olongapeños and the rest of Central Luzon will be continued by the people and friends she worked for;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

A RESOLUTION REQUESTING THE PHILIPPINE CHARITY SWEEPSTAKES OFFICE (PCSO) TO SET UP OFFICE AT OLONGAPO CITY TO FACILITATE CONVENIENT PROVISION OF THEIR SOCIAL SERVICE/COMMUNITY EXTENSION SERVICES FOR THE LOCAL COMMUNITY, IN A MANNER CONSISTENT WITH LAW.

WHEREAS, the Vision and Mission statement of the Philippines Charity Sweepstakes Office says; To uplift the quality of life of the Filipino people and to be a model government agency in carrying out its responsibilities to provide medical and health services to the disadvantaged sectors through a professional workforce with integrity, competence, a deep sense of accountability and transparency in all its official transactions;

WHEREAS, the Philippine Charity Sweepstakes (PCSO) is the principal government agency for raising and providing funds for health programs, medical assistance and services, and charities of national character;

WHEREAS, as embodied in its charter, the PCSO’s primary objective is to provide funds for health programs, medical assistance and services and charities of national character. The PCSO’s mandate sets the pace for the development of community health care in all the regional hospitals nationwide through the establishment of Tuberculosis Centers, Cancer and Pain Centers, and Dialysis Centers that deliver vital medical assistance and services to the people;

WHEREAS, since its inception in 1934, the Philippine Charity Sweepstakes Office (PCSO) has lived up to the challenge of its mandated mission and purpose and has remained unwavering in carrying out its vision of uplifting the quality of life of the Filipino people. The agency has well established itself as a model government institution with its unquestioned dedication to serve the disadvantaged sectors of society;

WHEREAS, the PCSO has developed a strong credence and incontestable acceptance from Filipinos who have all come to believe and get comfort on the fact that the PCSO will always be there for them, as long as needs shall be satisfied and hopes and dreams be given life and fulfillment;

WHEREAS, the City of Olongapo has a strategic location in Region III to extend help to its neighboring provinces in creation an office of the PCSO;

WHEREAS, the city will be providing an office space for the proposed PCSO Office;

A RESOLUTION AUTHORIZING THE CITY MAYOR HON. JAMES GORDON, JR. TO ENTER INTO, EXECUTE AND SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF OLONGAPO A MEMORANDUM OF AGREEMENT (MOA) WITH THE DEPARTMENT OF INTERIOR AND LOCAL GOVERNMENT (DILG), REPRESENTED BY REGIONAL DIRECTOR FLORIDA M. DIJAN, DILG REGIONAL OFFICE III, IN RELATION TO EXECUTIVE ORDER NO. 32, SERIES OF 2011, CREATING THE PUBLIC TRANSPORT ASSISTANCE PROGRAM

WHEREAS, with the creation of Inter-Agency Energy Contingency Committee (IECC), it is mandated to audit available resources of the government, evaluate contingency plans and submit reports to the Office of the President.

WHEREAS, one of the initial projects of the said office is the “Pantawid Pasada Program” or the Public Transport Assistance Program (PTAP), which aims to help the transportation group of our country by providing subsidy for their expense on fuel;

WHEREAS, based on IECC’s studies the Public Transport Assistance Program (PTAP) has been found to be the most equitable form of intervention to adopt as targeted relief to those vulnerable sectors;

WHEREAS, Section 8 of Presidential Decree No. 910, as amended by Republic Act No. 7638, provides that all fees, services and receipts from any or all sources including receipts from service contracts and agreements collected by Department of Energy (DOE) shall form part of a Special Fund to be used to finance energy resources development and exploration programs and projects of the government, and for such other purposes as may be directed by the President;

WHEREAS, according to the Executive Order No. 32, PTAP will be guided by the following:

Section 1. The Public Transport Assistance Program- Pantawid Pasada. The “Public Transport Assistance Program” (PTAP) is hereby established which shall provide targeted relief to the public transport section to cushion the impact of high fuel prices on the riding and consuming public. the Department of Energy (DOE) is hereby designated as the lead agency to implement PTAP.

Section 2. Disbursement of the PTAP Funds. The PTAP shall be implemented in coordination with the IECC consistent with the members’ specific responsibilities pursuant to Section 3, AO No. 6 (s. 2011). Specifically, the Department of Transportation and Communications (DOTC), Department of Finance (DOF), and the Department of Energy (DOE) are jointly authorized to determine the monthly funding requirement of the PTAP. The PTAP shall partially subsidize the average consumption of the identified public transport group; Provided, that the disbursement shall be made per franchisee anf on the number of franchised unit s based on information to be provided by the DOTC through the Land Transportation Franchising and Regulatory Board (LTFRB): provide further, That the DOE shall use smart cards to ensure the integrity of the disbursements.

Upon the recommendation of the IECC, the DOE may review the list of those entitled to the PTAP to include other sectors whose operations may ba classified as sensitive to high oil prices, and it may also suspend the PTAP when it determines the impact of fuel costs on these sectors no longer exists.

In the case of tricycles, the PTAP shall also subsidize a portion of their average consumption. The Department of the Interior and Local Government (DILG) shall coordinate with the Local Government Units (LGUs) for the joint implementation of the PTAP; Provided: That funding for PTAP for tricycles shall be subject to availability of counterpart funds of the respective LGUs.

After the first month of implementation, the DOE shall submit to IECC a report on the status of the accomplishments of the PTAP. The IECC shall submit the recommendations to the President regarding the continued implementation of the program and its projected requirements.

Section 3. Funding Source of the PTAP. The initial funding requirementa of the program shall be FOUR HUNDRED FIFTY MILLION PESOS (P450,000,000) which shall be sourced for the Special Account in General Fund (SAGF) of the DOE under Fund 151, to be released by the Department of Budget and Management (DBM) subject to the submission of the Bureau of Treasury (BTR) Certification on the availability of deposited collections with the SAGF of the DOE and to existing laws and the usual government budgetary, accounting and auditing rules and regulations.

Section 4. Implementation of the PTAP. In the implementation of the PTAP, the DOE shall coordinate with the following departments:

(a) Department of National Defense(DND);

(b) DILG; and

Section 5. Duty to Extend Assistance to the PTAP. The departments, bureaus, offices, agencies or instrumentality of Government, including government-owned and/or controlled corporations and government financial institutions are hereby directed to extend such assistance and support to the PTAP, as may be necessary, for its successful implementation.

Section 6. Implementing Guidelines. The DOE as Lead, DBM,DILG, DOF, and DOTC shall promulgate the rules and regulations for the implementation of this Order within fifteen (15) days from effectively hereof.

Section 7. Separability. If any provision of this Executive Order is declared invalid or unconstitutional, the other provisions unaffected shall remain valid and subsisting.

Section 8. Effectivity. This Executive Order shall take effect immediately upon publication in newspaper of general circulation.

A RESOLUTION EXTENDING PROFOUND SYMPATHIES AND CONDOLENCES TO THE BEREAVED FAMILY OF FORMER CITY COUNCILOR, HON. LEOPOLDO D. FEDERICO

WHEREAS, Honorable Leopoldo D. Federico, former City Councilor of Olongapo peacefully joined His Creator on May 16, 2011 at the age of 87;

WHEREAS, Kagawad Federico, who served under former Mayors, Amelia J. Gordon and Richard J. Gordon, was an epitome of a councilor unbounded by any leadership style in his ultimate quest for public service;

WHEREAS, a native Dingle, Iloilo, the late councilor was a former recruiting officer of the Base Industrial Recruitment Office (BIRO) under the US Naval Base before he became a legislator under the leadership of former City Mayor Amelia J. Gordon in 1968;

WHEREAS, his long service in the government, tracing back from the Marcos’ Regime up to the People Power Revolution, attests that he was a public servant untouched by the changes in the country’s political and economic landscape;

WHEREAS, “Ka Polding”, as he is fondly called, is known for his scholarly and wise counsel. His candid views and opinions during legislative deliberations were always admired and respected by his peers in the city Council;

WHEREAS, he was known to be the “transport czar” of the City, as the author of the transport ordinance, and the chair of the Committee on Public Highways, under the leadership of former mayor and senator, Hon. Richard J. Gordon, when the City implemented the first ever color-coding scheme in the transport sector in the country, replicated now by local government units nationwide;

WHEREAS, to his credit, the City Council churned out numerous quality legislative measures that greatly redounded to the welfare of the City residents;

WHEREAS, Olongapo City joins the Federico Family in its grief over the loss of a distinguished legislator, esteemed public servant and the beacon of their family

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to extend, as it is hereby extends profound sympathies and condolences to the bereaved family of Former City Councilor, Honorable Leopoldo D. Federico.

A RESOLUTION OF STRONGLY SUPPORTING AND ENDORSING TO THE OFFICE OF THE PRESIDENT OF THE REPUBLIC OF THE PHILIPPINES THE APPOINTMENT OF ANNE MARIE C. GORDON AS OLONGAPO CITY’S REPRESENTATIVE DIRECTOR IN THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) BOARD OF DIRECTORS

WHEREAS, history attests to the fact that SBMA was created through the efforts of Ologapenos led by then SBMA Chairman Richard J. Gordon who volunteered in the preservation, and facilitated the development of SBMA as a premier international investment, tourism and logistics hub;

WHEREAS, Section 13 ( c ) (1) of Republic Act No. 7227 (RA 7227) otherwise known as the Bases Conservation and Development Act of 1992 provides that local governments concurring in the creation of Subic Bay Freeport Zone, such as Olongapo City, shall have a representative in the Subic Bay Metropolitan Authority (SBMA) Board of Directors;

WHEREAS, both provisions of RA 7227 and Republic Act No. 7160 or the Local Government Code of 1991 mandate that the local government of Olongapo City should be consulted on matters vitally affecting its communities to enhance complementation and not predatory competition, among the investors of SBMA and the Olongapo City small and medium scale entrepreneurs and major local businesses;

WHEREAS, there is a need to ensure corporate social responsibility on the part of SBMA, a need to sustain partnerships with SBMA in prospective public service initiatives, and a need to preserve and safe keep artifacts which illumine Olongapo City’s history and heritage, and an imperative to give a strong voice to the people of Olongapo’s sentiments and aspirations as the lead founder of SBMA.

WHEREAS, there is a need for strong representation for Olongapo City in the SBMA Board of Directors to ensure that its legitimate interests are protected and that the welfare of the local community is safeguarded;

WHEREAS, Anne Marie C. Gordon has been a public servant of Olongapo City in various capacities, as a private individual, a member of social service and civic organizations, as a project head of public service projects and as a partner in progress during her stint as a leader in the Olongapo-Zambales community.

WHEREAS, Ms. Gordon possesses the necessary academic competencies required to effectively serve as Director of the SBMA Board, viz: (a) She is academically accomplished graduating on top of her class at the St. Theresa’s College, and a consistent Dean’s Lister en route to earning a degree in Business Management; and (b) She holds a Masters in Business Administration from the Dela Salle University;

WHEREAS, she is versed in local cultural, social and economic conditions and concerns having served locally based international socio-civic organizations such as the Soroptimst International and Soroptimist International, Girl Scouts of the Philippines (GSP);

WHEREAS, Anne Marie C. Gordon has the indispensable acumen in international diplomacy and foreign relations emanating from her experience as the Deputy Team Leader at the Embassy of the United States of America Immigrant Visa Section and an Investigator therein at the Anti-Fraud Section, a Consultant to the Orthika International Ltd. of Tokyo, Japan and as an Assistant Administrator with the United States of America The Scrips Research Institute of La Jolla, California and as by her being a recipient of various Meritorious Award Honor Ambassador’s Awards;

WHEREAS, Anne Marie C. Gordon has a proven track record in public service in the Olongapo City-Zambales area, undergoing extensive training in legislation and fiscal management processes, serving as project manager of various public service initiatives in Olongapo City and eventually as the Vice Governor in the Province of Zambales, with her unparalleled stint recognized and honored with the Outstanding Service Award given by the Provincial Government of Zambales and the Outstanding Service Award as Regional Director for Region III by the League of Vice Governors of the Philippines;

WHEREAS, Anne Marie C, Gordon is evidently attuned to local conditions and needs in the Olongapo City-Zambales area, is academically competent, and most importantly, possesses the indispensable experience in managing business and investment related matters, and is versed in international relations and diplomacy;

WHEREAS, Anne Marie C. Gordon receives strong support from the widest spectrum of sectors in the local community all of whom are informally and formally lobbying for her and petitioning that She be the one appointed to represent the best interests of the City of Olongapo;

WHEREAS, Anne Marie C. Gordon, is a widely respected leader in the local, provincial, and regional community and known to be the person of unquestionable ethics, morality and probity;

A RESOLUTION DECLARING THE ANNUAL BUDGET OF BARANGAY PAG-ASA FOR THE FISCAL YEAR 2011 OPERATIVE IN ITS ENTIRETY

In the interest of the public service and on motion of City Councilor Gina Gulanes-Perez with unanimous accord of the Members of the Sannguniang Panglungsod present:

RESOLVED, AS IT IS HEREBY RESOLVE, by the Sannguniang Panlungsod in session assembled, to declare as it hereby declares the Annual Budget of Barangay Pag-Asa for the Fiscal Year 2011 operative in its entirety considering that the said budget as contained in Appropriation Ordinance No. 01 Series of 2011 of Barangay Pag-Asa, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations. PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the OIC, City Budget Office in her letter dated May 2, 2011 are strictly complied with;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED that Appropriation Ordinance No. 01, Series of 2011 of Barangay Pag-Asa dated January 5, 2011 and letter from Ms. Marey Beth D. Marzan, OIC-City Budget Office dated May 2, 2011 shall be made as integral parts of this Resolution.

A RESOLUTION CONGRATULATING ABSOLUTE SERVICE, INC. AS RECIPIENT OF A SPECIAL AWARD IN THE 2011 EMPLOYERS CONFEDERATION OF THE PHILIPPINES (ECOP) KAPATID NATIONAL AWARDS.

WHEREAS, ECOP’s Kapatiran sa Industriya or KAPATID Awards is a biennial national event which recognizes companies that exemplify best workplace policies and programs highlighted by industrial peace and harmony, and characterized by quality and productivity, social accountability, and strategic visioning and partnering;

WHEREAS, companies which have been bestowed with the Grand KAPATID Award are known to have strong partnership between management and workers, the society, and continue to thrive as a top-level establishment in their respective sectors;

WHEREAS, Absolute services, Inc., a duly registered company based in Subic Bay Freeport Zone employing 112 employees was among the 13 companies and the only medium-size company nominated for the coveted award and was eventually chosen as the Grand Kapatid Special Awardee for 2011;

WHEREAS, prestigious multinational companies with the likes of Nestle Philippines, Toyota Motor Phils., SM, Bridgestone Precision, IBM Philippines, Dole Philippines, Amkor Technology, AGC Flat Glass Phils. A RESOLUTION EXTENDING OUR WARMEST CONGRATULATIONS TO ATTY. DEO AMOR DAVID FOR BEING ADJUDGED AS THE MOST OUTSTANDING CHAPTER PRESIDENT, CATEGORY B OF THE INTEGRATED BAR OF THE PHILIPPINES

WHEREAS, Atty. Deo Amor David is a native of Municipality of Castillejos, Province of Zambales and one of the promising legal practitioners not only within our sphere but goes beyond its border;

WHEREAS, he has been characterized by his legal brethren within the legal circle as a hardworking lawyer practicing with humility. Inevitably, this trademark did not escape the eyes of his fellow brothers in profession, thus on February 2009 he was elected as the Chapter President of the Integrated Bar of the Philippines Olongapo-Zambales Chapter;

WHEREAS, immediately upon assumption into office, Atty. Deo Amor David introduced several innovations in his chapter, reliving camaraderie and fellowship among legal circle with its regular “Kapihan sa IBP” through constant communications with trial judges, prosecutors and court officials and employees for the efficient and effective administration of justice, assignment of IBP Legal Aid Lawyers in every branch of the courts, conducting regular legal aid clinic, distribution of school supplies and relief goods to indigent families and holding regular sport programs;

WHEREAS, his leadership has moved the IBP - Olongapo-Zambales Chapter to greater heights which gained strong and active participation by its members in all its activities and projects;

WHEREAS, at the helm of his governance as Chapter President of Integrated Bar of the Philippines Olongapo-Zambales Chapter, Atty. Deo Amor David was able to secure the right to host the 13th National Convention of Lawyers on April 7 to 10, 2011 to be held at Subic Bay Freeport Zone;

WHEREAS, the untiring efforts of Atty. Deo Amor David leading the chapter to broaden its horizon did not escape the attention of the awarding body of the Integrated Bar of the Philippines, National chapter for which reason, he was adjudged as an OUTSTANDING CHAPTER PRESIDENT Category B during the recently concluded 13th National Convention of Lawyers on April 7 to 10, 2011 at Subic Bay Freeport Zone.

NOW, THEREFORE, on motion of the City Councilor Noel Yabut Atienza, with the unanimous accord of Members of the Sanggunian Panlungsod present,

A RESOLUTION EXTENDING OUR WARMEST CONGRATULATIONS TO THE OFFICERS AND MEMBERS OF THE INTEGRATED BAR OF THE PHILIPPINES OLONGAPO-ZAMBALES CHAPTER FOR THE SUCCESSFUL HOSTING OF THE 13TH NATIONAL CONVENTION OF LAWYERS HELD LAST APRIL 27-10, 2011 AT THE SUBIC BAY EXHIBITION AND CONVENTION CENTER, SUBIC BAY FREEPORT ZONE

WHEREAS, the Integrated Bar of the Philippines Olongapo-Zambales Capter has been awarded the right to host the 13th National Convention of Lawyers on April 7 to 10, 2011;

WHEREAS, with strong determination and courage, the Integrated Bar of the Philippines Olongapo-Zambales Chapter has taken the challenge and organized one of the best ever conversations held in the history of Integrated Bar of the Philippines;

WHEREAS, with a limited resources, the Integrated Bar of the Philippines Olongapo-Zambales Chapter has tremendously worked overtime to come up with an organized and memorable convention to be held at the heart of economic bastion of the Philippines, Subic Bay Freeport Zone;

WHEREAS, true indeed, the IBP – Olongapo-Zambales Chapter through the hardwork and perseverance of its officers and members, garnered another milestone in its fold for having achieved in attendance, with no less than the Vice-President of the Philippines, Hon. Jejomar C. Binay who led the array of convention speakers who discussed about the integrity and credibility of a lawyer;

WHEREAS, the Integrated Bar of the Philippines Olongapo-Zambales Chapter in collaboration with its National Officers has come up with a complete 36 units of Mandatory Continuing Legal Education (MCLE) for the delegates covering accredited topics in laws and procedures with excellent line up of resource speakers;

WHEREAS, after the culmination of the four-day convention, delegates from all over the Philippines were delighted with benefits and happiness brought by the convention knowing fully well that their time and efforts in attending the said convention have added to their personal growth;

WHEREAS, by reason of the successful hosting of the 13th National Convention of Lawyer from April 07 to 10, 2011 by the Integrated Bar of the Philippines Olongapo-Zambales Chapter has a beneficial effect on the economic and tourism aspect not only with the Subic Bay Freeport Zone but likewise with the City of Olongapo;

SECTION 1. Section 1 of Ordinance No. 25, Series of 1995 is hereby amended to read as follows:

“Section 1. Pursuant to the provisions of Section 61, Republic Act No. 8551otherwise known as the “Department of the Interior Act of 1990”, as implemented by Section 7, Rule III of NAPOLCOM memorandum Circular No. 91-002, the Chairman and Members of the People’s Law Enforcement Board (PLEB) of Olongapo City are hereby provided with per diems for each actual attendance at a hearing of the Board in accordance with the following rates, to wit:

A RESOLUTION DECLARING THE ANNUAL BUDGET OF BARANGAY NEW CABALAN FOR THE FISCAL YEAR 2011 OPERATIVE IN ITS ENTIRETY

In the interest of public service and on motion of Councilor Gina Gulanes-Perez with the unanimous accord of the Members of the Sangguniang Panlungsod present:

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare as it hereby declares the Annual Budget of Barangay New Cabalan for the Fiscal Year 2011 operative in its entirety considering the said budget as contained in Appropriation Ordinance No. 01 Series of 2010 of Barangay New Cabalan, upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations. PROVIDED, that the City Accountant is enjoined to observe that the conditions enumerated by the OIC, City Budget Office in her letter dated April 20, 2011 are strictly complied with;

In the interest of public service and on motion of Councilor Gina Gulanes-Perez with the unanimous accord of the Members of the Sangguniang Panlungsod present:

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare as it hereby declares the Annual Budget of Barangay New Kalalake for the Fiscal Year 2011 operative in its entirety considering the said budget as contained in Appropriation Ordinance No. 001 Series of 2011 of Barangay New Kalalake , upon review by the Sangguniang Panlungsod, has substantially complied with the requirements and limitations set forth under Republic Act No. 7160 or the Local Government Code of 1991 and its Implementing Rules and Regulations. A RESOLUTION AUTHORIZING HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER INTO AND SIGN THE REVISED LETTER OF UNDERSTANDING BETWEEN THE CITY OF OLONGAPO AND THE UNITED NATIONS POPULATION FUND UNDER THE 6TH COUNTRY PROGRAM

WHEREAS, the purpose of the letter of Understanding (LOU) is to record the agreement of the implementing partner and the United Nations Population Fund UNFPA on the activities to be carried out, on the responsible partner institutions, time frames and planned inputs from the various involved parties, on modalities to request cash disbursement, supplies or services from UNFPA, and how to adhere to the funding, accounting, reporting and auditing procedures;

WHEREAS, the LOU is being revised in response to changes in the reporting requirements of financial forms, the updated signatories under the Reproductive Health (PHL6R207) and Population and Development Strategies (PHL6P203) programs, and the new UNFPA Country Representative to the Philippines, Ms. Ugochi Florence Daniels;

NOW, THEREFORE, on motion of City Councilor Edna A. Elane, with the majority decion of the Members of the Sangguniang Panlungsod present,

A RESOLUTION AUTHORIZING HONORALE CITY MAYOR JAMES GORDON, JR. TO NEGOTIATE, ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT (MOA) TO SECURE AN ANESTHESIA MACHINE, PATIENT MONITOR EQUIPMENT AND INFUSION AND SYRINGE PUMP EQUIPMENT AND OTHER RELATED EQUIPMENT FOR THE JAMES L. GORDON MEMORIAL HOSPITAL, IN A MANNER CONSISTENT WITH LAW.

WHEREAS, the City places premium concern to the health and safety of the local community, catering to its preventive, remedial and recuperative needs through the James L. Gordon Memorial Hospital;

WHEREAS, among the indispensable equipments needed for daily hospital surgical operations include the Anesthesia Machine, Patient Monitor Equipment, Infusion and Syringe Pump Equipment and other equipment such as the Pulse Oximeter, Capnograph, Cardiac Monitor, Suction Machine and Defibrillator;

WHEREAS, due to the day-to-day hospital operations and daily service to a wide volume of patients, both paying and underprivileged, the aforesaid equipments, have undergone natural wear and tear and may eventually no longer be serviceable, with some equipment on the verge of being rendered unserviceable despite preventive maintenance;

WHEREAS, there is a patient and urgent need to secure and make provisions for said equipment, considering its general use and necessity for daily health service surgical operations, with the conduct of an estimated ten to twelve (10-12) daily operations involving elective and emergency surgical procedures;

WHEREAS, as per findings in the hospital, the absence of these much needed equipment would expose the health and life of patients to unnecessary risks;

NOW, THEREFORE, on motion of City Councilor Edna A. Elane, with the unanimous accord of the Members of the Sangguniang Panlungsod present:

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it is hereby authorizes, the Honorable City Mayor James Gordon, Jr. to Negotiate, Enter Into and Sign a Memorandum of Agreement (MOA) to Secure an Anesthesia Machine, Patient Monitor Equipment and Infusion and Syringe Pump Equipment and other related equipment for the James L. Gordon Memorial Hospital, in a manner consistent with law.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that this will follow the usual procedure of public bidding moreso of ratification of the Sangguniang Panlungsod.

WHEREAS, Nestle Philippines would like to have a partnership with the City of Olongapo by offering the services to have Milo Clinics;

WHEREAS, the MOA entered into and signed by the Hon. City Mayor James Gordon, Jr., shall be indorsed for ratification by the Sangguniang Panlungsod of Olongapo;

A RESOLUTION ACCEPTING THE RADIO FREQUENCY IDENTIFICATION (RFID) SYSTEM DONATED BY PILIPINAS MICRO-MATRIX TECHNOLOGY, INCORPORATED (PMTI) TO BE USED AT GORDON COLLEGE AND AUTHORIZING THE HON. CITY MAYOR JAMES GORDON, JR. TO SIGN THE DOCUMENTS RELATED THERETO, IN ACCORDANCE WITH PERTINENT LAWS

WHEREAS, Pilipinas Micro-Matrix Technology, Incorporated (pmti) is a company founded in year 2007, based in Subic Bay Freeport Zone (SBFZ), engaged in the business of providing Information and Communications Technology Solutions to government agencies and private sectors;

WHEREAS, Radio Frequency technology has come of age and offers better and more efficient use than that of the bar code system of identification. Notably, Radio Frequency Identification (RFID) is in the stream of daily living in most countries especially in the Education Sector;

WHEREAS, when an RFID tag passes through the field of the scanning antenna, it detects the activation signal from the antenna. This starts up the RFID chip, and it transmits the information on its microchip to be received by the scanning antenna;

WHEREAS, the said system will be used by the students of Gordon College as access inside the campus for management and control;

WHEREAS, Gordon College Students and Teachers RFID Card Holder can also benefit this system for monitoring the time and attendance in classrooms;

WHEREAS, the RFID Card to be issued shall be renewable every three years and the validity shall be updated every year for security purpose. The said card is durable and will last up to three (3) years of normal usage and the print will not fade easily because it is laminated;

WHEREAS, in order to make the donation valid, there is a need for the adoption of the resolution authorizing the City Mayor, Hon. James Gordon, Jr. to sign and accept, for and in behalf of the City, the documents pertaining to the acceptance specially the Deed of Donation;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to accept, as it hereby accepts the Radio Frequency Identification System (RFID) donated by Pilipinas Micro-Matrix Technology, Incorporated (PMTI) to be used at Gordon College and authorizing the City Mayor, Hon. A RESOLUTION EXPRESSING STRONG AND VIGOROUS OBJECTION TO THE ANNUAL WATER TARIFF ADJUSTMENT TO BE IMPLEMENTED BY THE SUBICWATER AND SEWAGE CO. INC. RECOMMENDED BY THE SUBIC BAY WATER REGULATORY BOARD AND APPROVED BY THE SUBIC BAY METROPOLITAN AUTHORITY

WHEREAS, Subicwater and Sewage, Co. Inc. is in charge for the operation, maintenance, supervision of the water supply system for the Freeport and City of Olongapo;

WHEREAS, Subic Bay Water Regulatory Board empowered to receive, hear and approve water tariff adjustment applied for by the Subicwater and Sewage Co. Inc in turn recommended for approval to the Subic Bay Metropolitan Authority;

WHEREAS, Subicwater and Sewage Co. Inc forged a Franchise Agreement with the then Chairman Richard J. Gordon which was thereafter amended which states among others the following relevant provisions thereof:

4(b) SUBICWATER shall exclusively operate and maintain all the Existing and New Facilities in an efficient and safe manner. The peroid for the operation and maintenance by SUBICWATER of existing facilities shall commence from the effective of the rectification of Agreement and continue for the duration of this Agreement. The period for the operation and maintenance by the SUBICWATER of the New Facilities shall commence from the date of completion of each art of the New Facilities and continue for the duration of this Agreement.”

4© The operation and maintenance required by Section 4 (b) of this Agreement shall be carried out by SUBICWATER at its own expense, if SUBICWATER shall fail to operate and/or maintain the Existing and New Facilities as required by Section 4(b), SBMA shall notify SUBICWATER in writing of such failure and that SUBICWATER shall take such immediate action as it is reasonably able to take to commence rectification and shall inform SBMA from time to time of the status of such rectification. If SUBICWATER shall not commence action to remedy such failure within a period of sixty (60) days and to complete such action to a schedule agreed with SBMA, SBMA shall without prejudice to any other rights it may be entitled to carry out the required operation and maintenance work by its own workmen or by other contractors and other charges incurred in connection therewith shall be payable by SUBICWATER. If SBMA carries out such works and charges SUBICWATER accordingly, shall not be considered in breach of this Agreement giving rise to a right of termination.

Copy of the Franchise Agreement is attached herewith as Attachment “A” and made an integral part of the present complaint:

WHEREAS, Subicwater and Sewage Co., Inc. has implemented tariff rate increases 28% on 2003, 15% for 2004 and 9% for 2007 a total of 52.5% tariff rate increase since 2003 approximately amounting amounting to One Hundred Thirty-Five Million Pesos (PhP135,000,000.00);

WHEREAS, the purpose raised by the Subicwater and Sewage Co. Inc for the water tariff increases was for the expansion and improvement of existing facilities;

WHEREAS, during the public hearing on June 14, 2007 held at Rizal Triangle, West Bajac-Bajac, Olongapo City, representative from Subicwater and Sewage Co. Inc expressly mentioned that the 52.5% water tariff increase was sufficient enough to cover any improvements and expansion to be undertaken by the latter;

WHEREAS, on May 19, 2008 defendant Subicwater and Sewage Co. Inc filed a petition for water tariff review and adjustment with Subic Bay Water Regulatory Board proposing a water rate increase as follows:

WHEREAS, however, on account of the pendency of the deliberation of the 2nd amendment of the Franchise Agreement (Attachment “A”), the review supposedly to be made by Subic Bay Water Regulatory Board on the petition of Subicwater and Sewage Co. Inc. was held in abeyance;

WHEREAS, on October 24, 2008 Subicwater and Sewage Co. Inc formally withdrew its Petition Dated May 19, 2008 and instead submitted another petition to set the initial water tariffs with an adjustment of 10.5% in all categories of water rates and an inflation factor of 91.3% for the next two years;

WHEREAS, Subicwater and Sewage Co. Inc. issued a Notice of Public Consultation to be held at Olongapo City Convention Center on November 3 and 5, 2008 both at 2:00 in the afternoon. However, despite the irregularities in the conduct of public hearings Subic Bay Water Regulatory Board recommended for approval the Petition for Water Tariff Adjustment of 6.33% in all categories of the water supply rates. The recommendation for approval of the water tariff adjustment made by the Subic Water Regulatory Board was approved by the Subic Bay Metropolitan Authority.

WHEREAS, Subicwater and Sewage Co. Inc. in clear violation of the Franchise Agreement as stated in the preceding paragraphs made and filed the Petition for water Tariff Adjustment on several occasions and recommended for approval by the Subic Bay Water Regulatory Board had an adverse effect on the consuming public when in fact and in truth the former shall exclusively shoulder the cost of improvements and renovation of existing facilities and to shift the burden on the consuming public;

WHEREAS, water has become one of the basic necessities which the oublic should not be deprived access thereof;

WHEREAS, the consuming public has experienced the worst economic burden who cannot afford to pay high cost for their basic needs;

WHEREAS, as part of Local Government Unit who is supposed to address the plight of its constituents must take concrete action to eradicate if not reduce the effect of the successive water tariff increases;

NOW THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to express, as it hereby expresses strong and vigorous objection to the annual water tariff adjustment to be implemented by the Subic water and Sewage Co. Inc. recommended by the Subic Bay Water Regulatory Board and approved by the Subic Bay Metropolitan Authority.

WHEREAS, in an effort to increase its income, the JLGMH is encouraging the accreditation of different Health Maintenance Organization (HMO) who can pay the hospital for the confinement of their members;

WHEREAS as a partner, the Assistance Alliance International (AAI) is in favor to post Two Hundred Thousand Pesos (Php200,000.00) Surety Bond to guarantee payment of all obligations;

A RESOLUTION AUTHORIZING THE CITY MAYOR, HON. JAMES BONG GORDON, JR.TO ENTER INTO AND SIGN FOR AND IN BEHALF OF THE CITY GOVERNMENT OF OLONGAPO, A MEMORANDUM OF AGREEMENT (MOA) WITH THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS (DPWH), FOR THE IMPEMENTATION OF THE SPECIAL LOCAL ROAD FUND (SLRF) UNDER RA 8794 OR THE MOTOR VEHICLE USER’S CHARGE (MUV) LAW

WHEREAS, Section 7 of R.A 8794 states that all monies collected under this Act shall be remarked solely and used exclusively (1) for road maintenance and improvement of road drainage; (2) for the instillation of adequate and efficient traffic lights and road safety devices; and, (3) for air pollution control. It further provides that 5% of all monies collected shall be deposited in the National Treasury under the Special Local Road Fund (SLRF), which shall be apportioned to provincial and city governments in accordance with the vehicle population and size of road network under their respective jurisdiction, and shall be used exclusively for maintenance of local roads, traffic management and road safety devices. It also directs that the Special Local Road Support Fund, the Special Local Road Fund and Special Local Road Safety Fund shall be under the DPWH;

WHEREAS, it necessary that a Memorandum of Agreement be entered into for the purpose of delineating responsibilities regarding the implementation of policies, standards and procedures at the LGU level in accordance with the pertinent provisions pf the SLRF under MVUC Law and its Implementing Rules and Regulations;

WHEREAS, the Olongapo City Engineering Office has the technical and equipment capability to undertake projects of the admission;

WHEREAS, the budget allocate for Olongapo City is One Million Four Hundred Fifty two Thousand Two Hundred Thirty Four pesos and Seventy-six centavos (P 1,452,234.76);

WHEREAS, the agreement would specify the implementation of the SLRF Project, with funding under the MVUC Special Local Road Fund, for the patching of potholes/asphalt overlay of roads in Barangays East Bajac-Bajac, this city;

NOW, THEREFORE, on motion of City Councilor Eyrma Yvette Marzan-Estrella, with the unanimous accord of members of Sangguniang Panlungsod present;

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorizes the City Mayor, Hon. A RESOLUTION AUTHORIZING THE HON. CITY MAYOR JAMES BONG GORDON, JR. TO NEGOTIATE A LOAN CONTRACT WITH THE DEVELOPMENT BANK OF THE PHILIPPINES (DPB) IN THE AMOUNT OF THREE HUNDRED MILLION PESOS (PHP300,000,000.00), AND SECURE THE BEST POSSIBLE TERMS FOR THE SANITARY LANDFILL DEVELOPMENT PROGRAM, IN A MANNER COMPLAINT WITH PERTINENT LAWS

WHEREAS, Republic Act No. 9003 (RA 9003), otherwise known as the ‘Solid Waste Management Act of 2000’ mandates all Local Government Units to establish and develop a Sanitary Landfill Facility which is deemed as an indispensable component of a genuine efforts towards enhancing environmental protection, conservation and maintaining ecological balance;

WHEREAS, Ra 9003 requires all LGU’s to divert twenty-five percent (25%) of all solid waste to waste disposal system or a Sanitary Landfill with its complementing components of a Material Recovery Facility (MRF) and a Buy-back center which is key to recycling efforts, which shall be augmented by education to the citizenry and local institutions;

WHEREAS, a Sanitary Landfill Development Program shall ensure and facilitate the utilization of environmentally-sound methods that maximize and encourage resource conservation and recovery;

WHEREAS, a Sanitary Landfill Development Program is long-term looking and beneficial to both the City present and future generations as it would cause immense environmental and health benefits to local communities, serve as an impetus to generate livelihood through the recycling industry, and is clearly both long-term looking, would outweigh immediate-term costs incurred, and would help preserve the current low costs of garbage collection and the City’s sanitation initiatives;

WHEREAS, the development of a Sanitary Landfill Facility involves a long-term process of studies, and groundwork initiatives and mustering enough technical and financial resources;

WHEREAS, even prior to the passage of RA 9003, the City has already undertaken to lay the groundwork for the development of a proper solid waste management facility which includes, among others, the conduct of an Urban environment and Solid Waste management Study conducted under the direction and administration of the World Bank covering the periods of from 1993 to 1995;

WHEREAS, the City’s subsequent initiatives to lay the groundwork for the development of a Sanitary Landfill Facility after the passage of RA 9003, the most notable of which include, among others: (a) improvement of solid waste containerization Program; (b) a feasibility study to ensure that what would be under taken is the most viable means of developing the facility without compromising the City’s order equally important and pressing social services; (c) as required in the City’s application for an Environmental Compliance Certificate (ECC) with respect to the development of the required solid waste management facility, it has undertaken an environmental examination, information and education campaign; (d) coordinate with, and requested, a geological scoping survey from the Mines and Geosciences Bureau; (e) competed the engineering geological and geo-hazard assessment report; (f) submitted the required environmental examination report to the Environment Management Bureau (EMB) for screening ; (g) made submissions of the required documents pertinent to the ECC-application to the EMB; (h) submitted the existing controlled dumpsite facility to EMB inspection and evaluation; (i) submitted to EMB for evaluation of its ECC application pertinent to the requirements under RA 9003; and its (j) Compost-Reuse-Reduce-Recycle (CR3) initiative;

WHEREAS, the City’s Environment Sanitation Management Office (ESMO) has already met with the Department of Environment and Natural Resources (DENR) EMB for a technical coordination to ensure that safety nets are duly considered and ensure such as, but not limited to: (a) prevention of permeation of waste elements to soil; (b) prevention of waste seeping to nearby water system; and (c) ensuring that the Programs complies with all legal safety requisites and shall therefore be made subject to close monitoring by the DENR;

WHEREAS, other than the legal necessity for the City to endeavor in a Sanitary Landfill Development Program, other the practical necessity to endeavor in the said Program by reason of the fact that initial closure orders have been sent initially to thirty-two (32) Mayors and would be sent to eight hundred twenty-six (826) jurisdictions in sixty-eighth (68) provinces with open and controlled dumpsites, and other than the pressing need to avert the closure of our own dumpsites which will force us to plead and contract with other compliant jurisdictions to accept our solid wastes for a substantial fee, other than the need to protect the City’s constituents from the shouldering skyrocketing garbage costs which would be brought about by the closure of our dumpsite which shall be affected by the DENR should the City fail to endeavor in a Sanitary Landfill Development Program, the City’s inter-generational responsibility to the present and future generations to maintain ecological balance and environmental conservation require that the City secure the necessary funding, for the full implementation of RA9003;

WHEREAS, the needed investment to give reality to the Sanitary Landfill Development Program under RA 9003, with its complementing components of a Central MRF and a Buy-back Center, necessitate that the City generate funds, exclusive of equity, which as per the pertinent study would cost Three Hundred Million Pesos (PHP 300,000,000.00), which is indispensable in averting a potential garbage crisis;

WHEREAS, as per DBP eligibility evaluation, the City and its Sanitary Land fill Development Program is eligible for its DBP-Environmental Development Program which, in turn, could facilitate the implementation of the Sanitary Landfill Development Program with DBP which has been the City’s long-time partner in its development Programs;

NOW, THEREFORE, on motion of City Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of Sangguniang Panlungsod present,

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlunsod in session assembled, to authorize, as it hereby authorizes the Hon. City Mayor James Bong Gordon, Jr. to negotiate a loan contract with the Development Bank of the Philippines (DBP) in the amount of three hundred million Pesos (PHP 300,000,000.00), and secure the best possible terms for the Sanitary Landfill Development Program, in a manner compliant with patient laws.

A RESOLUTION AUTHORIZING THE CITY MAYOR HON. JAMES GORDON, JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT WITH THE NATIONAL ECONOMIC & DEVELOPMENT AUTHORITY (NEDA), REGIONAL OFFICE III FOR TECHNICAL ASSISTANCE/SERVICES ON THE UPDATING OF THE CITY’S COMPREHENSIVE LAND AND WATER USE PLAN AND CITY DEVELOPMENT PLAN

WHEREAS, Sections 106 and 109 of Republic Act No. 7160 otherwise known as the Local Government Code of 1991 mandate all municipalities and cities to prepare their comprehensive multi-sectoral socio-economic development plans and policies;

WHEREAS, Executive Order No. 841, series of 2009 was issued directing all local chief executives and local development councils to immediately revisit/reformulate/formulate their respective Comprehensive Land Use Plans, identifying for the purpose the areas for socialize housing and resettlement relocation;

WHEREAS, the city’s current Comprehensive Land Use Plan (CLUP) covers the period of 2011 – 2010 and the City Development Plan (CDP) is for 2000 - 2010;

WHEREAS, to make the city’s CLUP and CDP more attuned to the current and future needs and development, there is a need to revisit and update the mentioned plans with the incorporation of water use plan;

WHEREAS, in the formulation of the Comprehensive Land and Water Use Plans (CLWUPs) and CDPs, the city may seek the assistance of any field office of National Government Agencies (NGASs)

WHEREAS, the City of Olongapo sought the assistance of the National Economic and Development Authority, Regional Office III (NEDA-RO III) as its Agency-Partner in the updating of its CLWUP and CDP;

WHEREAS, the City is willing and shall provide the necessary technical, financial and administrative support to realize the updating of its CLWUP and CDP;

WHEREAS, NEDA – RO III agrees to provide the requisite services and expertise necessary in the updating of the CLWUP and CDP for the City of Olongapo;

NOW, THEREFORE, on motion of City Councilor Gina Gulanes-Perez with the unanimous accord of the Members of the Sangguniang Panlungsod present;

WHEREAS, the CBMS Network Coordinating Team of the Angelo King Institute for Economic and Business Studies, Dela Salle University, Manila is a group of researchers and policy analysts, under the Poverty and Economic Policy Network;

WHEREAS, due to the long holidays that brought the delay of remittances from abroad, many real property taxpayers in the city were not able to avail of the twenty percent(20%) discount on the advance payment of Real Property Taxes(RPTs) as provided under section 2B.12 of the Olongapo City 2007 Revenue Code.

WHEREAS, the City Treasurer with the City Finance Committee recommended the extension of the said program to taxpayers who will pay their Real Property Taxes(RPTs) in full for tax year 2011 on or before February 11, 2011;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The twenty percent(20%) discount on the advance payment of Real Property Taxes due for Tax Year 2011 is extended until February 11, 2011 to taxpayers who will pay their Real Property Taxes (RPTs) in full.

SECTION 2. This Ordinance shall take effect immediately upon its approval.

WHEREAS, the Olongapenos have been gradually uplifted from the Global Economic crisis which started in 2008;

WHEREAS, local business owners are still recuperating from said crisis and are therefore experiencing a hard time in meeting the deadline for the payment of Mayor’s permit due for year 2011;

WHEREAS, both City Treasurer and City Business Permit Division Officer acknowledged the situation and vouched the extension of the deadline of payment for Mayor’s permit for businesses due for the year 2011 until February 11, 2011.

WHEREAS, this legislation shall act as the City’s show of goodwill and support to the business community;

NOW, THEREFORE, with the unanimous accord of the members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact to the following ordinance:

AN ORDINANCE EXTENDING THE DEADLINE OF PAYMENT FOR MAYOR’S PERMIT FEES FOR BUSINESSES AND BUSINESS TAXES FOR BOTH FULL AND/OR FIRST QUARTER DUE FOR THE CALENDAR YEAR 2011 AS PROVIDED UNDER SECTIONS 4A.21 AND 3A.08 RESPECTIVELY OF THE CITY ORDINANCE NO. 64, SERIES OF 2007 OTHERWISE KNOWN AS THE “OLONGAPO CITY 2007 REVENUE CODE”

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Payment for Mayor’s Permit fees for businesses and payment for both full and/or first quarter Business taxes due for the Year 2011 shall be extended until February 11, 2011.

SECTION 2. This Ordinance shall take effect immediately upon its approval.

Let copies of this Ordinance be furnished to the Business Permit and Licensing Office, City Treasurer’s Office and Public Affairs Office for their information and record.

A RESOLUTION CALLING FOR THE ESTABLISHMENT OF A SECURITIES AND EXCHANGE COMMISSION SATELLITE OFFICE ON OLONGAPO CITY TO ADDRESS THE INCREASED INFLUX OF PRESENT AND FUTURE INVESTORS IN THE OLONGAPO CITY AREA OF JURISDICTION IN A MANNER CONSISTENT WITH LAW

WHEREAS, in the wake of the ever-increasing influx of prospective local and foreign investments in Olongapo City, and its neighboring jurisdictions, there is a need to complement the city’s tourism and investment efforts by ensuring that the institutions necessary for business and industry that would generate employment and revenue for the community are in place;

WHEREAS, there is a need to further boost the city’s efforts and accomplishments in enhancing a business and investment-friendly environment, not only through its City Business Permit and Licensing Division and the City Tourism Office, but more so with the establishment of national agencies involved in investment-generation;

WHEREAS, the Securities and Exchange Commission (SEC) is the government agency tasked with accepting, evaluating, reviewing and approving applications for incorporation by business entities such as partnerships and corporations;

WHEREAS, to complement the City’s Business Permit and Licensing Office, the Department of Trade and Industry Olongapo Office and the Department of Labor and Employment Olongapo Office, there is a need for a SEC satellite office in the city to ensure that national agencies critical for business and investment are easily accessible in Olongapo City, which in turn facilitates employment and industry generation;

WHEREAS, there is an increasing sentiment from business leaders and prospective investors in the Olongapo City for the establishment of a SEC satellite office in the city to eliminate the inconveniences and bottlenecks of having to go to Metropolitan Manila to secure required documents to operate a business;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to call, as it is hereby calls for the Establishment of a Securities and Exchange Commission Satellite Office in Olongapo City to address the increased influx of present and future investors in Olongapo City in a manner consistent with law.
