RESOLUTION NO. 73
(Series of 2011)

A RESOLUTION SUPPLEMENTING THE CITY COUNCIL RESOLUTION NO. 10, SERIES OF 2011 BY INCLUDING AN ADDITIONAL EIGHTY – THREE MILLION THREE HUNDRED THOUSAND PESOS (PHP83,300,000.00) IN THE AUTHORIZED LOAN THEREIN TO FACILITATE COMPLIANCE WITH THE DEVELOPMENT BANK OF THE PHILIPPINES TECHNICAL REQUIREMENTS FOR THE SANITARY LANDFILL DEVELOPMENT PROGRAM, AND AUTHORIZING THE HON. CITY MAYOR JAMES GORDON, JR. TO EXECUTE AND SIGN THE REQUIRED DEED OF ASSIGNMENT, PROMISSORY NOTE AND OTHER DEED/INSTRUMENTS RELATED THERETO, IN A MANNER CONSISTENT LAW

WHEREAS, the City Council unanimously approved a Sangguniang Panlungsod Resolution No. 10, Series of 2011 dated February 2011, which authorized the City Mayor to contract a loan agreement with the Development Bank of the Philippines (DBP) in the amount of Three Hundred Million Pesos, under the best possible terms, to avert an impending garbage crisis;

WHEREAS, as per initial submission by the city of its loan application, acceptance and approval of the requested loan was withheld as the DBP’s Clean Development Mechanism program, such as the centralized composting facility/material recovery facility, a critical component for the attainment of the city’s waste diversion goals as it facilitates minimizing the volume of wastes for final disposal and maximizes and prolongs the life of the sanitary landfill facility, in addition to the city’s initiative to instead request for one-hundred percent (100%) financing of the project, which entails an additional costing of Eighty Three Million Three Hundred Thousand Pesos (PhP83, 300,000.00), inclusive of the costs for construction and purchase of pertinent equipment;

WHEREAS, as per Notice of Closure dated 19 May 2011 from the Department of Environment and Natural Resources Regional Office, there is a continuous impending enforcement of a closure order against the city’s controlled dumpsite, pending compliance with the required establishment of a complete Sanitary Landfill compliant with Republic Act No. 9003 (RA 9003), otherwise known as “Solid Waste Management Act of 2000”;

NOW THEREFORE, on motion of City Councilor Eduardo J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod, in session assembled, to Supplement, as it hereby Supplements the City Council Resolution No. 10, Series of 2011 by including an Additional Eighty-Three Million Three Hundred Pesos (PhP83, 300,000.00) in the Authorized Loan therein to facilitate compliance with the Development Bank of the Philippines Technical Requirements for the Sanitary Landfill Development Program, and Authorizing the Hon. City Mayor James Gordon, Jr. to execute and sign the required Deed of Assignment, Promissory Note and other Deeds/Instrument related thereto, in a manner consistent with Law.
