RESOLUTION NO. 138
(Series of 2005)

A RESOLUTION AUTHORIZING THE CITY MAYOR IN BEHALF OF THE CITY GOVERNMENT OF OLONGAPO TO ENCLOSE FENCE TO ALL ACCRETION AREAS WITHIN OLONGAPO CITY


WHEREAS, Article II Sec. 16 of the 1987 Constitution mandates, to wit: “The state shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature”;

WHEREAS, pursuant to General Welfare Clause of the Local Government Code of 1991 (RA 7160) partly provides that each local government unit shall ensure and support among other things the preservation and enhancement of the right of the people to a balanced ecology;
WHEREAS, over the years, accretion due to the natural course of nature happened to our beach areas which should be developed and promoted to its full potential to boost the growing tourism industry of the City;
WHEREAS, the construction of fence over the accretion areas would prevent squatting and other land related problems in the future;
WHEREAS, the accretion areas and the surrounding waters could be used by the people for public swimming and other recreational purposes;
WHEREAS, with the very limited land resources of the City having only less than 2000 hectares of Alienable and Disposable land, it is only fair, just and equitable to the City of Olongapo to protect its right over accretion areas;

NOW, THEREFORE on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,
RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to support, as it hereby supports the City, through the Honorable City Mayor represented by its Barangay Captain of every barangay concerned to construct a fence over all accretion areas developed as a result of the movement of the bodies of water within the City of Olongapo.
