WHEREAS, RA 3571, Section 4, “ Act Prohibiting the Cutting, Destroying or Injuring of Plant or Growing Trees, Flowering Plants and Shrubs or Plants of Scenic Value Along Public Roads in Plazas, Parks, School premises or in any Public ground”, provides that “ The Committee, (Committee in Parks and Wildlife) shall coordinate to the Director of the Parks and Wildlife the beautification of their respective locality and shall under its supervision, require school children on Arbor Day to plant trees and flowering plants of useful and scenic value in places provided by the preceding section of this provision.”

WHEREAS, the provision mentioned evidently shows that the creation of Fruit Park in the City can be made possible both economically and efficiently with the utmost assistance of the people of Barangay Cabalan and the Commission on Higher Education.

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to enact the following Ordinance:

ORDINANCE NO. 67
(Series of 2005)

AN ORDINANCE CREATING OLONGAPO FRUIT PARK IN FORESTRY, OLD CABALAN

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The Fruit Park shall be located in Forestry, Barangay Old Cabalan, Olongapo City.

SECTION 2. The aims of the Fruit Park are the following:

(a) Economic Purposes- This shall in the near future benefit the people of Olongapo City, specifically the people of Barangay Old Cabalan. Fruits in season for harvest will be available for picking and selling based on per piece or per kilo pricing. Portion of fund generated from this project shall be allocated to the allowance of the people who are taking care of the garden.

(b) Proper Orientation for the Students- this project shall develop sense of responsibility and love for environment among the students themselves.

(c) Aesthetic Purposes- this shall provide attraction not only to the people of the City but moreover to the tourism industry as a whole.

(d) Source of income for the continuous improvement of parks and playground in the City.

SECTION 3. In this garden, the following seedling classifications shall be planted:

(a) 1st classification- (Standard) like Mangoes (all varieties), Santol, Macopa, etc.

(b) 2nd classification- (Bush) like Atis, Guyabano, Mangosteen, Guavas, etc.

(c) 3rd classification- (Espaliers) like Suha, Anonas, Mabolo, etc.


SECTION 4. Every Tertiary School in the City shall be assigned by the Task Force to donate seedlings of one of the classifications provided in the preceding section.

SECTION 5. All City Tertiary Schools shall have their own schedule in taking care of the plant/ tree classification assigned to them.

SECTION 6. The Office of the City Mayor shall create a Task Force to fully supervise the Fruit Park, in coordination with the City’s Environment and Natural Resources Office, NGOs’ and Commission on Higher Education to be in-charge of the protection and maintenance of the said park.

SECTION 7. There will be a minimal financial requirement for the Fruit Park. Seedlings to be used in the garden may be accumulated from students and constituents. Net receipts shall be allocated as follows, 70% for the tourism and beautification projects of the city while the 30% will be for the Barangay concerned.

SECTION 8. The Tourism Department, Beautification Office, the Environment and Natural Resources Office and the Commission on Higher Education shall ensure the appropriate adequate information dissemination in the propagation of the Fruit Park.

SECTION 9. Effectivity. This ordinance shall take effect upon its approval.
