RESOLUTION NO. 38
(Series of 2006)

A RESOLUTION LIFTING THE PROHIBITION OF THE OLONGAPO CITY GOVERNMENT EMPLOYEES’ MULTI-PURPOSE COOPERATIVE, INCORPORATED (OCGEMPCI) TO SUBLEASE DRIFTWOOD BEACH SUBJECT TO A MEMORADUM OF AGREEMENT BETWEEN THE COOPERATIVE AND THE CITY MAYOR AND CONFIRMATION OF
A SANGGUNIANG PANLUNGSOD RESOLUTION


WHEREAS, Resolution No. 80, Series of 2002 authorized the Olongapo City Government Employees’ Multi-Purpose Cooperative, Inc. to exclusively manage and operate Driftwood Beach located at Brgy. Barretto, Olongapo City;

WHEREAS, Paragraph 4 of the said Resolution prohibits the said Cooperative to sublease the said Beach to any other person, organization or entity;

WHEREAS, the Driftwood Beach’s potential tourism call can be attributed to its core location that can offer prime sports and leisure activities requiring bigger investments and business ventures to further increase its marketability, promotion and profitability;

WHEREAS, with the limited investment of the Cooperative, it is deemed favorable and advantageous to invite prospective investors and developers to negotiate a sublease/development agreement that will bring further improvements to the said area to increase its viability and enhance its competitiveness in the tourism arena;

WHEREAS, a Memorandum of Agreement pertaining to the Sublease of the Driftwood Beach mutually advantageous to the City Government of Olongapo and the Olongapo City Government Employees’ Multi-Purpose Cooperative, Inc. must be forged and entered into by both parties and be confirmed/ratified by the Members of the City Council to legally bind its provisions;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to lift, as it hereby lifts the Prohibition of Olongapo City Government Employees’ Multi-Purpose Cooperative, Inc. to Sublease Driftwood Beach subject to a Memorandum of Agreement between the Cooperative and the City Mayor of Olongapo and confirmation of a Sangguniang Panlungsod Resolution.
