WHEREAS, the city government is investing in facilities and infrastructures from taxes collected from its constituency to provide for the community’s welfare and development;

WHEREAS, despite strong efforts to protect these resources, there are still some people who keep on destroying these facilities and infrastructures, and even commit other more devastating forms such as rioting, which entails willful destruction of public and private property;

WHEREAS, vandalism per se is often considered as one of the least serious common crimes, but it can become quite serious when committed extensively, violently or as expression of hatred and intimidation that may affect progress;

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 06
(Series of 2007)

AN ORDINANCE AMENDING ORDINANCE NO. 7, SERIES OF 1967 ENTITLED “AN ORDINANCE PROHIBITING ACTS OF VANDALISM AND PROVIDING PENALTY THEREFORE”

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED THAT:

SECTION 1. VANDALISM DEFINED. Vandalism is a willful or malicious destruction of public or private property or the intentional and malicious destruction of or damage to the property of another. It is a malicious act and may reflect personal ill will.

SECTION 2. PENALTIES. Any person violating the provision of this Ordinance shall upon conviction, be punished by a fine of Five Thousand Pesos (PhP5,000) for every offense.

SECTION 3. Any violator of this Ordinance shall pay the corresponding amount of damaged property that will be assessed by the court.

SECTION 4. In case the violator is a minor, the case will be referred to the City Social Welfare and Development Office (CSWDO) for proper guidance.

SECTION 5. Each Barangay shall be responsible for the enforcement of this Ordinance if the case is within its jurisdiction. However, for City - owned facilities and structures damaged by vandals, the City hereby authorizes the Olongapo City Police Office (OCPO) the implementation of the same.

SECTION 6. Sign boards measuring 1.5 x 2 ft. will be made and strewn for information dissemination in all city parks and plazas for strict compliance.

SECTION 7. This Ordinance shall take effect immediately upon approval.

Let copies of this Ordinance be given to the Public Affairs Office (PAO) for public’s information, City Social Welfare Development Office (CSWDO), and to the seventeen (17) Barangays in the city for guidance and implementation.
