In the interest of public service and on motion of Councilor Gina G. Perez, with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 23
(Series of 2008)

AN ORDINANCE REPEALING CITY ORDINANCE NO. 11, SERIES OF 2008 AND APPROPRIATING THE AMOUNT OF ONE HUNDRED SIXTY-THREE MILLION THREE HUNDRED EIGHT THOUSAND SEVEN HUNDRED NINETEEN PESOS AND NINETY-SEVEN CENTAVOS (PHP163,308,719.97) TO THE ITEM MAINTENANCE AND OTHER OPERATING EXPENSES (MOOE) AND CAPITAL OUTLAY UNDER ENVIRONMENTAL SANITATION AND MANAGEMENT OFFICE TO BE TAKEN FROM THE LOAN OF THE CITY FROM THE DEVELOPMENT BANK OF THE PHILIPPINES AND UNAPPROPRIATED BALANCE OF THE GENERAL FUND (2008 IRA ADJUSTMENT)

BE IT ORDAINED BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. The amount of One Hundred Sixty-Three Million Three Hundred Eight Thousand Seven Hundred Nineteen Pesos and Ninety-Seven Centavos (PhpP163,308,719.97) is hereby appropriated to the Maintenance and Other Operating Expenses and Capital Outlay under Environmental Sanitation and Management Office, to be taken from the loan of the city from the Development Bank of the Philippines and unappropriated balance of the General Fund (2008 IRA adjustment).

SECTION 2. This ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. This in effect repeals City Ordinance No. 11, Series of 2008 otherwise known as “An Ordinance Appropriating the Sum of PhP16,200,000.00 to the Item Maintenance and Other Operating Expenses and Capital Outlay of ESMO to be Taken from the Unappropriated Balance of the General Fund (2008 IRA Adjustment).

SECTION 4. The pertinent letter of Mayor James Gordon, Jr. shall be made an integral part of this Ordinance.
