RESOLUTION NO. 103
(Series of 2005)

A RESOLUTION LIFTING THE CITY’S RESERVATION ON 166 LOTS LOCATED AT PUROK 3 & 7, BARANGAY NEW CABALAN, OLONGAPO
CITY AND LIMITING THE AREA RESERVE FOR REFORESTATION


WHEREAS, City Council Resolution Nos. 5 & 58 are resolutions reserving certain government lots in Olongapo City for public welfare projects and other purposes enacted on 23 January 1991 and 19 June 1996, respectively;

WHEREAS, corresponding Miscellaneous Sales Applications for all government lots in Olongapo City were filed by the City with the Department of Environment and Natural Resources;

WHEREAS, there are 166 lots (CNI Subdivision) reserved as Reforestation Area at Purok 3 and 7, Barangay New Cabalan by the city that is now occupied by residents who have already introduced considerable improvements in the area;

WHEREAS, this overlapping area was applied for with Miscellaneous Sales Applications by the city but the same have not been processed by the DENR (Department of Environment and Natural Resources);

WHEREAS, the reforestation plan of the city for the area no longer conforms to the existing condition of the site and to the approved 2005 Comprehensive Land Use Plan (CLUP) of the city;

WHEREAS, majority of the occupants within CNI Subdivision are now applying for titling of their occupied lots;

WHEREAS, titling of the lots will redound to the benefit of the City in terms of increased tax revenue and lot sales payments and will spur economic growth in the area;

WHEREAS, areas beyond the coverage of CNI Subdivision are the only remaining feasible sites to remain as Reforestation Area;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to waive as it hereby waives, the city’s reservation over 166 lots located at Purok 3 and 7, Brgy. New Cabalan, Olongapo City identified as Lot Nos. 1057, 366-440, 442-489, 500-510, 511-526, 2190-2204, CNI Subdivision, in favor of the occupants of the mentioned lots and limiting only areas beyond the coverage of CNI Subdivision as reserve sites for Reforestation Area.
