WHEREAS, Republic Act No. 7160, otherwise known as “the Local Government Code of the Philippines” empowers the City Government to impose supervisory, regulatory, processing and monitoring fees to defray the expenses of the government;

WHEREAS, prices of fuel products such as gasoline, diesel and kerosene had been rising to an unprecedented levels and impending shortage of supply makes consumers to be gravely concerned;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:


ORDINANCE NO. 55
(Series of 2005)

AN ORDINANCE AMENDING ARTICLE 18, SECTION 178 OF CITY ORDINANCE NO. 81, SERIES OF 2002 ENTITLED “AN ORDINANCE PROVIDING FOR THE OLONGAPO CITY REVENUE CODE 2002”

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Article 18, Section 178, Sub-section e) second paragraph shall read as follows:

a) CALIBRATION FEE:

A calibration fee of P100.00 per pump shall apply anytime a calibration is conducted.

b) FREQUENCY OF CALIBRATION:

Calibration by duly designated City Government official to fuel pumps shall be conducted at least once every six (6) months.

A re-calibration may be conducted even before the validity ends if the City Government have compelling reason to do so, such as but not limited to receiving complaints from consumers regarding accuracy of fuel pumps.

c) STICKER AND SEAL:

Immediately after each calibration is conducted, a sticker will be attached to each fuel pump. The sticker must have appropriate serial number, signature of authorized official who conducted the calibration, and date of validity or expiration of calibration. Below is the prescribed format of the sticker

d) The Treasurer’s office must have a computerized database of all fuel pumps with in the territorial jurisdiction of Olongapo City to ensure that gas pumps are scheduled for calibration before its validity expires.

SECTION 2. This Ordinance shall take effect upon its approval
