RESOLUTION NO. 175
(Series of 2006)

A RESOLUTION REQUESTING THE DEPARTMENT OF THE INTERIOR
AND LOCAL GOVERNMENT (DILG) THRU ITS SECRETARY RONALDO PUNO AND THE CIVIL SERVICE COMMISSION (CSC) TO CONDUCT A LIFESTYLE CHECK ON ALL PUBLIC OFFICIALS WHETHER ELECTIVE OR APPOINTIVE AND EMPLOYEES OF OLONGAPO CITY


WHEREAS, Section 1, Article XI of the 1987 Constitution states: “Public office is a public trust. Public officers and employees must at all times be accountable to the people, serve them with utmost responsibility, integrity, loyalty and efficiency, act with patriotism and justice and lead modest lives”;

WHEREAS, Section 4, Paragraph H of Republic Act No. 6713 entitled “An act establishing a code of conduct and ethical standards for public officials and employees, to uphold the time-honored principle of public office being a public trust, granting incentives and rewards for exemplary service, enumerating prohibited acts and transaction and providing penalties for violations thereof and for other purposes” to wit: Simple living –Public officials and employees and their families shall lead modest lives appropriate to their positions and income. They shall not indulge in extravagant or ostentatious display of wealth in any form”;

WHEREAS, “a public office is a public trust created in the interest and for the benefit of the public. The officers are servants of the people and not their rulers. The trust attached to a public office should be exercised in behalf of the government or the citizens and extends to all matters within the range of the duties pertaining to the office.(22 R.C.L. 378-379);

WHEREAS, in the case of Juntilla vs. Calleja AM P-961225 September 23, 1996 decided by the Supreme Court, it was held that: “Public office is a public trust. All public officers are accountable to the people at all times. Their duties and responsibilities must be strictly performed;

WHEREAS, the Department of the Interior and Local Government is mandated for the supervision and coordination on local government units including its local elective officials and as such is authorized to conduct a lifestyle check on all elective public officials in order to determine unreasonable accumulation of assets real or personal of the same, which are not commensurate with their income derived from government service on the basis of their Statement of Assets and Liabilities;

WHEREAS, insofar as the local appointive officials and employees are concerned, the conduct of a lifestyle should be coursed to the Civil Service Commission who has jurisdiction over all employees in the public service;

WHEREAS, the City of Olongapo has been known as a city of character and dignity whose vision and mission is “fighting for excellence”

WHEREAS, in order to enforce the clear mandate of the Constitution, laws and jurisprudence, a lifestyle check should be conducted on all public officials elective or appointive and employees of the City of Olongapo by the Department of the Interior and Local Government and the Civil Service Commission respectively:

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sanguniang Panglungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests the Department Of The Interior And Local Government (DILG) Thru Its Secretary Ronaldo Puno And The Civil Service Commission (CSC) To Conduct A Lifestyle Check On All Public Officials Whether Elective And Appointive And Employees Of Olongapo City.

Let copies of the foregoing resolution be furnished to the Department of Interior and Local Government and the Civil Service Commission
