Call to Order
The City Vice-Mayor and Presiding Officer Cynthia G. Cajudo called the session to order at 4:15 in the afternoon.
Roll Call
With seven (7) members and the Presiding Officer present, a quorum was declared.
Reading and Adoption of Minutes
Prior to the votation for the adoption of the Minutes of the Previous Session, Councilor Edwin Piano mentioned some corrections. First is on page 7, on the second to the last paragraph, the word “double radar” should spell as doppler radar”. Second is on page 8, item no. 6, the word “NPC” should be “NTC” which stands for National Telecommunications Commission.
On motion of Councilor John Carlos G. delos Reyes, the body adopted the minutes of the regular session dated October 10, 2007 as corrected.

11. Councilor Angelito W. Baloy moved to include, “A Resolution Extending Profound Condolences and Heartfelt Prayers to the Family of Mr. Ruben de Guzman, Bereaved with the Passing of their Patriarch, Mr. Jose de Guzman”. Sponsored Unanimously. This measure was approved by the body as an additional item on first reading.
Councilor John Carlos G. delos Reyes commented and made it clear it is not an objection, that he thinks it is proper to put in the Agenda draft/proposed ordinances and resolutions that affects public interest, the city in general or something that warrants public attention. He explained further that a City Councilor is vested with power as Chairman of the Committee to solve problems in the Committee level. He cited as an example the agenda under the first reading specifically the Draft Resolution “Requesting The DTI To Waive The Sales Promotion Permit For The Miss Mart One Voting Contest As Part Of The 2007 City Fiesta Queen Activities”. The Councilor respectfully suggested to the sponsors, Councilors Gie Baloy and Ellen Dabu, if they could just ask this request from the DTI in the form of a signed official letter. He concluded that he would adhere though to the Council as to whether or not they should put the said measure for consideration of the whole body.
With no other comments, the body approved the Day’s Agenda as amended, on motion of Councilor John Carlos G. delos Reyes.

Letter from Eliseo P. de Guzman, City Director, Department of the Interior and Local Government, Office of the Local Government Operations Officer VIII addressed to the Sangguniang Panlungsod Secretary requesting her presence on Thursday, 06 December 2007, 10 o’clock in the morning at By The Sea Restaurant, Barretto, Olongapo City as one of the members of the Board of Supervisors who shall supervise and serve as final arbiter of all election controversies that may arise during the SK Federation Election. This is pursuant to DILG Memorandum Circular No. 2002 – 123, particularly on section 2(a) thereof. (For information and guidance)
2. Letter from Quirino A. Marquinez, of Marquinez Arceno Taton And Associates addressed to the Honorable City Mayor James Gordon and the Sangguniang Panlungsod Members informing him that his client, Ms. Teresita S. Meredith, proprietress and owner of KALE Beach Resort, located at Barangay Kalaklan, has endorsed to them the complaint against the City Mayor and all the Officials of the Sangguniang Panlungsod, Olongapo City for allegedly fencing and taking possession of the surrounding land owned by her without judicial observance of due process. 3. Letter from Vic Capulong Madrogaba, In-Charge of Production, Miss Intercontinental 2007, (i-C) inter-Continental Productions addressed to Hon. City Vice Mayor Cynthia G. Cajudo and Members of the City Council regarding their change of event date in line with the Grand Coronation Night of Miss Intercontinental 2007 Beauty Pageant. Due to unavoidable circumstances, they are moving the event date from December 8, 2007 to December 22, 2007 at 6:00 P.M. to 12 P.M. and also the event venue from the Lyceum of Subic Bay Court to either the Rizal Triangle Multi-Purpose Center or at the Marikit Park. This would depend on the approval of the Honorable City Mayor James Gordon Jr. Furthermore, they are cordially inviting the Vice Mayor and the City Councilors to grace the event, and for the Vice Mayor to deliver her Inspiring Message during the affair.
4. Letter from Hon. Gina Gulanes-Perez, Chairman, Task Force Tourism addressed to the Hon. City Vice Mayor Cynthia G. Cajudo and Members of this body informing them that the Provincial Officials of Makima, Sarangani will conduct a Lakbay-Aral in Olongapo City on December 6, 2007. She would like to request assistance to welcome the group and conduct a briefing on the different plans and programs of the city. The group is composed of 30 participants headed by Hon. Miguel A. She reminded Councilor Rodel Cerezo whose birthday was on December 2, Councilor Gina Perez on December 8, Councilor Marey Beth Marzan on December 18 and Ms. Annabelle Gabriel on December 24 to undergo their annual physical examination on their birth dates.
8. Notice of Hearing from Grace V. Manuel, Officer-In-Charge, Commission Secretariat, National Telecommunications Commission, Quezon City, for the request of the applicant Teodoro N. Romasanta, Inc., for the issuance of a Certificate of Public Convenience and Necessity to install, operate and maintain a VSAT network in selected areas in the Philippines in its amended application. Invitation letter from Jose Dejano Moring, Chief Inspector JMP Warden, Bureau of Jail Management and Penology, Olongapo District Jail, addressed to the Vice-Mayor Cynthia Cajudo regarding the promotion of “Enhanced Rehabilitation Program”, with theme: “Pagsulong ng Rehabilitasyon Tungo Sa Higit Pang Kagalingan”, focused on socio-cultural application that would rejuvenate not just the inmates’ spirit but the entire City of Olongapo, as well as the Province of Zambales. This will be held on December 10, 2007 at 1:00 P.M. (The Presiding Officer mentioned that there is an appeal for them to go and watch the presentation)
16. Letter from Ms. Dyezebel R. Dado, City Project Coordinator, Reproductive Health Program, addressed to the Hon. Vice-Mayor relative to the UNFPA Program Officers from Asia-Pacific Headquarters and Country Officials who would like to seek audience with the Vice-Mayor and the City Council to discuss policies/strategic directions of the City on December 10, 2007 at 9:00 A.M. (The Presiding Officer mentioned to the body that they are to meet at the Vice-Mayor’s Office at 9:00 A.M. on Dec. 10, 2007 for the said request)
Committee Reports
Councilor Elena Dabu, Chairman of the Committee on Women reported that the Technical Working Group and GAD Council finalized the GAD Plan for CY 2008 pursuant to DILG – MC No. 98-148 regarding the Mobilization of Government Resources to the Mainstream and Incorporation of GAD plans in the local planning and budgeting system. According to Councilor Dabu, GAD will recognize the equal contribution of men and women in all sectors and all aspects of development. Councilor Dabu said that in the past few years, the plight of women was already brought out in the open and were given attention with the enactment of laws that aimed to protect women’s rights. The GAD of many government agencies institutionalized gender responsiveness in agency programs and plans. The Councilor further added that there are also many organizations offering services that teach women how to help themselves, however, services offered are still fragmented and the lack of dissemination of information is the reason why many women are still unaware of how and where to get assistance. Thus, the Women’s Desk was established in all municipalities of Region III manned by female Philippine National Police personnel.
According to Councilor Dabu, the Women’s Desk handles cases filed by women and children, which are mostly cases of rape, incest, battering and acts of lasciviousness. All personnel assigned were trained on Violence Against Women and on Gender Sensitivity. The case filed at the Women’s Desk are also referred to the Department of Social Welfare and Development for further assistance.
Lastly, Councilor Dabu informed the body that the “18-day Campaign To End Violence Against Women” is on November 25 to December 12. She invited her colleagues to join in the prayer to end violence on women on the next flag ceremony.
The Presiding Officer announced to the body the invitation to the inauguration and blessing of “Abot Kamay Convenience Store”, a joint livelihood project of Mayor James Gordon, Jr. and the Department of Labor and Employment on December 10, 2007, 2:00 p.m. at the Marikit Park of Olongapo.

1. Draft Ordinance No. 2007 – O–45 – “An Ordinance Appropriating The Amount Of Ninety Nine Thousand Eight Hundred Fifty Two Pesos and Twenty Four Centavos (PhP99,852.24) To Be Taken From The Unappropriated Balance Of The General Fund Made Available To The Personal Services Of The Office Of The Sangguniang Panlungsod”, was deferred for lack of a Certificate of Availability of Funds, on motion of Councilor Anselmo A. Aquino, in behalf of Councilor Marey Beth D. Marzan, the sponsor of the said measure. Councilor Marzan, the Chair of the Committee on Appropriations, and the Vice Chairman of the Committee were both on official business, thus, were not present. Councilor Aquino is a member of the said Committee.
2. Draft Resolution No. 2007 – R–93 – “A Resolution Accrediting The Olongapo City Government Employees Multi-Purpose Cooperative, Inc. For The Purpose Of Membership In The Local Special Bodies In Olongapo City Pursuant To The Provisions Of Republic Act No. 7160 Otherwise Known As The Local Government Code Of 1991”, was approved unanimously on its second and final reading upon motion of Councilor Edwin J. Piano.
Councilor Piano informed the body that a committee hearing was held on Monday with regard to the application of both the Olongapo City Government Employees Cooperative and the Bagumbayan Olongapo City Chapter. The draft of the said resolution was sent through e-mail and hard copies were given to all the Members of the Sanggunian.
3. Draft Resolution No. 2007 – R -94 – “A Resolution Accrediting The Bagumbayan-Olongapo City, Inc. For The Purpose Of Membership In The Local Special Bodies In Olongapo City Pursuant To The Provisions Of Republic Act No. 7160 Otherwise Known As The Local Government Code Of 1991”, was approved unanimously on its second an final reading upon motion of Councilor Edwin J. Piano.
Councilor John Carlos G. delos Reyes suggested that the vision-mission or the objectives of both the Bagumbayan Movement and the Olongapo City Government Employees Multi-Purpose Cooperative must be added for formality and for file.
The Presiding Officer asked Councilor delos Reyes if he is amenable to the idea that a copy of the SEC Registration with the vision-mission of the applicants shall form an integral part of the Resolution. Councilor delos Reyes affirmed.

Before the motion to table the proposed measure, Councilor Piano explained the course of action he will make with regard to the application of Globe Telecom. According to him, he intends to write a resolution so that the Council will give approval on the basis of specific projects. This, he said, is because of the opinion manifested by Councilor John Carlos G. delos Reyes that the body should not give a sort of “blanket authority” by saying that they are not objecting to the projects of Globe. Instead, he will draft a resolution which shall state what specific project is to be approved and other details like the location, etc.
Also, as per suggestion of Councilor Gie Baloy, Councilor Piano said that in addition to the “Beneficial User’s Fee” imposed, they with also try to come up with the “Rental Fee” so that areas where cabinets will be installed will be paid by the Telecommunication’s Company on a rental basis. This was likened by Councilor Gie Baloy to the areas where the city peg prices such as in the City Mall and other areas operated by the city.

The Presiding Officer asked the proponent from what school is Eagle Scout Kenny Ralph Fernando. Councilor Piano replied that he is a third year high school student from Columban College.
10. Draft Resolution No. 2007 – R-109 – “A Resolution Approving The List Of City Priority Infrastructure Projects For The Calendar Year 2008”.
Councilor Anselmo Aquino mentioned that representatives from the Engineering Office were present to provide some information.
The Presiding Officer asked if all the projects in the list were already approved under the Annual Investment Plan (AIP). The reason for the query according to the Presiding Officer, was because as she knows, before the body approves projects, and for the projects to be given proper budget, it is requested to be approved in the Annual Investment Plan and it should be endorsed by the City Development Council.
Engr. Villanueva of the Engineering Office replied that as far as he knows, it was included in the Annual Implementation Plan.
The Presiding Officer again stressed the question if it was endorsed by the Local Development Council because as far as the body is concerned, there are procedures to be followed so that they will not be questioned later with the giving of approval.
Engr. Villanueva affirmed, there was an endorsement.
The Presiding Officer requested that a copy be provided for attachment: first, the copy of endorsement or resolution by the Local Development Council endorsing the said projects; and second, the approval under the AIP and the Development Council. This process is also part of the requirements given to Barangays, and to all other projects. Engr. Villanueva said he will get copies from their office and provide the Council.
Councilor Dabu said that since she was a Barangay Kagawad for 13 years at Brgy. East Bajac-Bajac, she knows that each barangay is given five (5) priority projects. She asked the Engineer if the lists consist of the priority projects of the 17 barangays. The Presiding Officer in addition, requested the Engineer to show the copy of the priority projects endorsed by each barangay.
Engineer Villanueva replied that they have received copies of the priority projects of all barangays but these are being prioritized. Thus, some barangay projects are included. The Engineer said he will provide the Council the request and list of the barangays for priority projects.
Councilor Lipumano-Garcia asked who decides what to be included in the priority project with regard to school for every barangay. The Presiding Officer added a query as to who makes the requests.
Engineer Villanueva answered that the requests come from the Principals. The City Planning and Engineering Office identifies the others since they are also part of the Local Development Council.
The Presiding Officer reiterated her request for the provision of the copies of documents mentioned above.
Draft Resolution No. 2007-R-109 was deferred for consideration next session, and to attach the necessary documents requested, upon motion of Councilor Anselmo A. Aquino.
Other Matters
A. “A Resolution Extending Profound Condolences And Heartfelt Prayers To The Family Of Mr. Ruben De Guzman, Bereaved With The Demise Of Their Patriarch, Mr. Jose De Guzman”, was considered an urgent matter by the body and was approved unanimously on its second and final reading. The Councilor mentioned that it is for unanimous sponsorship.
B. Draft Resolution No. 2007 – R-110 – “A Resolution Requesting The Department Of Trade And Industry (DTI) To Waive The Sales Promotion Permit For The Miss Mart One Voting Contest As Part Of The 2007 City Fiesta Queen Activities” was considered an urgent matter by the body on motion of Councilor Angelito W. Baloy.
The Presiding Officer verified the date. Councilor Gie Baloy answered that its on December 7-28, up to noon time. The Presiding Officer observed that the date December 7 was not in the “whereas” thus put this to the Councilor’s attention.
Councilor Gie Baloy took note of the observation.
Draft Resolution No. 2007-R-110 was approved unanimously on its second and final reading on motion of Councilor Gie Baloy and jointly sponsored by Councilor Elena C. Dabu.
