ABSENT:

WHEREAS, there is a letter from the Fire Chief Inspector, Jonas R. Silvano, City Fire Marshall, dated January 15, 2009 , addressed to the City Mayor, requesting for the immediate repair of six (6) Fire Trucks;

WHEREAS, the said vehicles are used in times of calamities, natural and man-made disasters;

WHEREAS, the absence of said fire trucks adversely affect our capability, thereby, rendering us weak in responding to fire incidents and other rescue operations;

WHEREAS, the repair would serve as part of the preventive activity of disaster management and preparedness;

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo with the unanimous accord of the members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the members of the Sangguniang Panlungsod in session assembled to enact the following ordinance.


ORDINANCE NO. 16
(Series of 2009)

AN ORDINANCE AMENDING ORDINANCE NO. 7, SERIES OF 2009

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED THAT:

SECTION 1. AMENDMENT

a) ORDINANCE NO. 7, Series of 2009 entitled,

“AN ORDINANCE APPROPRIATING THE AMOUNT OF THREE MILLION PESOS (Php3,000,000.00) TO THE ITEM SUBSIDY TO NATIONAL GOVERNMENT AGENCIES -BUREAU OF FIRE PROTECTION UNDER THE OFFICE OF THE CITY MAYOR TO BE TAKEN FROM THE UNAPPROPRIATED BALANCE OF THE GENERAL FUND”

Be amended to:

“AN ORDINANCE APPROPRIATING THE AMOUNT THREE MILLION PESOS (PhP 3,000.000.00) FOR THE PREVENTIVE/ PREPARATION ACTIVITY AGAINST DISASTER – NATURAL AND MAN-MADE FROM THE UNAPPROPRIATED BALANCE OF THE GENERAL FUND”

b) SECTION 1 OF ORDINANCE NO. 7, Series of 2009 which states that:

“The amount of Three Million Pesos (Php 3,000,000.00) to be taken from the Unappropriated Balance of the General Fund is hereby appropriated to the item Subsidy to National Government Agencies-Bureau of Fire Protection under the Office of the City Mayor.”

Be amended to:

“The amount of Three Million Pesos (Php3,000.000.00) is hereby appropriated from the Unappropriated Balance of the General Fund to wit:”

Php695,840.00 - 5% Calamity Fund (to augment deficiency in the 2009 Annual Budget)

2,304,160.00 - Subsidy to National Government Agencies – Bureau of Fire Protection under Maintenance & Other Operating Expenses of the Office of the City Mayor

PhP3,000,000.00

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The pertinent letter- request of the Honorable City Mayor James Gordon, Jr. dated February 10, 2009 and the letter of Mr. Jonas R. Silvano shall be made as integral parts of this Ordinance.

SECTION 4. This Ordinance shall take effect upon its approval.
