(Series of 2012)

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO NEGOTIATE, SECURE, ENTER, EXECUTE AND SIGN AN AGREEMENT AND NECESSARY INSTRUMENTS FOR A SUPPLEMENTAL LOAN OF SEVENTY TWO MILLION AND FIVE HUNDRED THOUSAND PESOS (PHP 72,500,000.00) WITH THE DEVELOPMENT BANK OF THE PHILIPPINES TO ADDRESS THE ADDITIONAL COSTS FOR THE SANITARY LANDFILL DEVELOPMENT PROGRAM BROUGHT ABOUT BY THE RECENT COLLAPSE/LANDSLIDE IN THE EXISTING OPEN DUMPSITE DUE TO TYPHOON PEDRING IN A MANNER CONSISTENT WITH LAW

WHEREAS, the pursuit of a Sanitary Landfill Program is duly sanctioned under Republic Act No. 9003 and its implementing/allied legislation, Department of the Interior and Local Government issuance and the Department of Environment and Natural Resources official communications;

WHEREAS, only after the passage of the City Council Resolutions allocating the necessary funding for the Sanitary Landfill Program with the Materials Recovery Facility, the city was struck by typhoon Pedring just this September 2011, which caused a landslide and deaths of some locals who were fortuitously in the area when the typhoon struck;

WHEREAS, the collapse of garbage materials brought about an unforeseen exigency which necessitated modifications in the program of works for the Sanitary Landfill Development Program, and consequently require additional costs to ensure that the dangers posed by an non-holistic program would be avoided;

NOW, THEREFORE, on motion of City Councilors Rodel S. Cerezo, Eyrma Yvette Marzan-Estrella, Gina Gulanes-Perez, Elena C. Dabu, Eduardo J. Piano, Edna A. Elane, Dolly Mae M. Ramos and Carlito A. Baloy, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize as it hereby authorizes, the Honorable City Mayor James Gordon, Jr. to Negotiate, Secure, Enter, Execute and Sign An Agreement and Necessary Instruments for a Supplemental Loan of Seventy Two Million and Five Hundred Thousand Pesos (PHP72,500,000.00) with the Development Bank of the Philippines to Address the Additional costs for the Sanitary Landfill Development Program brought about by the recent Collapse/Landslide in the Existing open Dumpsite due to Typhoon Pedring in a Manner Consistent with Law
