In the interest of public service and on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 46
(Series of 2005)

AN ORDINANCE CREATING THE ROUTE UNDER ZONE III AT
FORESTRY, OLD CABALAN FROM BENNET ROAD TO ANY
POINT IN THE FORESTRY AREA ONLY (APITONG/CRUSHER)

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. There shall be an authorized route within Olongapo City for motorized tricycle for hire under Zone III from Bennet Road to any point in Forestry, Old Cabalan only (Apitong/Crusher).

SECTION 2. This shall be assigned the Body Nos. 3531-3540, with body color of light blue and cream top.

SECTION 3. Only those who are residents of Old Cabalan which do not have to cross the National Highway may be qualified to apply to operate.

SECTION 4. Awarded applicants shall comply with all existing Ordinances of the city and national laws and regulations relative to its operation (from LTO, LTFRB, TRAFFIC, DENR, BIR)

SECTION 5. The terminal point of this route shall be before the Bennet Road Bridge. Only ten (10) units shall be allowed to use the terminal at any given time. Use of any private or any other for hire vehicle without authority is a violation of this Ordinance. This shall be prosecuted under the colorum or out of line ordinance which ever is applicable.

SECTION 6. Operators and drivers must give due recognition and coordination with existing zone three officers and barangay and cooperative officials in the area. They must co-exist harmoniously settling dispute within their ranks, before the city.

SECTION 7. Violation of any part of this Ordinance shall be a ground for revocation of its franchise and automatic cancellation of body number assigned.

SECTION 8. This Ordinance shall take effect upon its approval.
