RESOLUTION NO. 130
(Series of 2006)

A RESOLUTION AUTHORIZING THE CITY MAYOR TO ENTER INTO A CONTRACT WITH A REPUTABLE CONTRACTOR FOR THE LEASE OF ONE (1) BULLDOZER AND FOUR (4) DUMPTRUCKS FOR A PERIOD OF ONE YEAR TO SUPPLEMENT THE NEEDS OF THE ENVIRONMENTAL SANITATION AND MANAGEMENT OFFICE (ESMO), AFTER A PUBLIC BIDDING IS DULY CONDUCTED FOR THE PURPOSE;

WHEREAS, the volume of the city’s garbage has increased from an average of 90 metric tons to 133 metric tons a day (ref. February 8, 2006 letter from ESMO);

WHEREAS, the basic service of garbage collection affects the health, safety and sanitation of the community; it is a service requiring continuous hauling and any interruption or delay must be avoided at all costs;

WHEREAS, the equipment used in this service, e.g., dump trucks and bulldozers are used round the clock and in a manner that expedites obsolescence as such equipment are subjected to corrosive waste, leachates and extraordinary wear and tear;

WHEREAS, seven (7) surplus dump trucks and one (1) bulldozer were purchased last December 2005, however, because of the nature of garbage collection as well as the additional volume, through the normal, ordinary course of work by ESMO, some of these have bogged down, causing some of the trucks to be unreliable and some even unserviceable;

WHEREAS, buying surplus equipment has become unadvisable because of the unreliability and the limited warranty against hidden defects;

WHEREAS, the motor pool of ESMO for its garbage collection has become as a whole, in need of supplemental dump trucks to maintain and sustain its daily operations and to fully address the ever-increasing volume of garbage collection;

WHEREAS, the ESMO has attached a comparative study between outsourcing versus acquisition and maintenance of our own equipment, the latter being capital and maintenance intensive, the former, being acceptable and in line with the cost-reductions policy of the government

WHEREAS, outsourcing as a mode of delivery of basic goods and services has become the trend not only in business but in government due to its efficient and effective delivery of services.

NOW, THEREFORE, on motion of Councilor John Carlos G.. de los Reyes, with the majority decision of the Members Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the City Mayor to enter into a contract with a reputable contractor for the lease of one (1) bulldozer and four (4) dumptrucks for a period of one year to supplement the needs of the Environmental Sanitation and Management Office (ESMO) after a public bidding is duly conducted for the purpose.
