RESOLUTION NO. 132
(Series of 2006)

A RESOLUTION ADOPTING REPUBLIC ACT 9344 OTHERWISE KNOWN AS “AN ACT ESTABLISHING A COMPREHENSIVE JUVENILE JUSTICE AND WELFARE SYSTEM, CREATING THE JUVENILE JUSTICE AND WELFARE COUNCIL UNDER THE DEPARTMENT OF JUSTICE, APPROPRIATING FUNDS THEREFORE AND FOR OTHER PURPOSES” FOR IMMEDIATE
AND FULL IMPLEMENTATION IN THE CITY OF OLONGAPO


WHEREAS, Article II, Sections 10 and 11 state, “The State shall promote social justice in all phases on national development” and “The State values the dignity of every human person and guarantees full respect for human rights”;

WHEREAS, Article XIII, Section 1 states, “The Congress shall give highest priority to the enactment of measures that protect and enhance the right of all the people to human dignity, reduce social, economic, and political inequalities, and remove cultural inequities by equitably diffusing wealth and political power for the common good.”;

WHEREAS, Article II, Section 13 states, “The State recognizes the vital role of the youth in nation building and shall promote and protect their physical, moral, spiritual, intellectual and social well-being. It shall inculcate in the youth patriotism and nationalism, and encourage their involvement in public and civic affairs”;

WHEREAS, recently, Republic Act 9344 was approved in the Philippine Congress providing a clear law regarding juvenile justice, a comprehensive system to protect children in conflict with the law to prevent inhuman treatment or punishment to juvenile delinquents;

WHEREAS, Republic Act 9344 provides for the creation of Juvenile Justice and Welfare Council (JJWC), which delineates its duties and functions, and should propel the entire Philippine government to strive for the creation of a comprehensive five year national juvenile intervention program;

WHEREAS, Olongapo City is known and recognized nationally for its Child Friendly Award, with its notable track record of caring for the condition, rights and safety of children in its jurisdiction;

WHEREAS, highlighting the rights of children, as the hope of the nation, Olongapo City acknowledges Republic Act 9344 as an answer to alleviate the pressing national concern;

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, co-sponsored by Councilor Robine Rose C. Buenafe, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to adopt, as it hereby adopts Republic Act 9344 otherwise known as “An Act Establishing A Comprehensive Juvenile Justice And Welfare System, Creating The Juvenile Justice And Welfare Council Under The Department Of Justice, Appropriating Funds Therefor And For Other Purposes” For Immediate And Full Implementation In The City Of Olongapo.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution and the Republic Act be furnished to the Office of the City Mayor, CSWD, City Court, and the seventeen (17) Barangays for their immediate action.
