A RESOLUTION DECLARING SANGGUNIANG BARANGAY NEW CABALAN RESOLUTION NO. 12, SERIES OF 2007 INVALID IN PART AND RETURNING THE SAME FOR THEIR CORRECTION


WHEREAS, the Local Government Code otherwise known as R.A. 7160 enumerates the powers, duties and functions of the Sangguniang Barangay, as the legislative body of the Barangay;

WHEREAS, Sangguniang Barangay of New Cabalan adopted a Resolution approving and adopting the Malacañang Executive Order No. 611 regarding compensation adjustment to government personnel last July 10, 2007;

WHEREAS, approval of an executive order issued by the President of the Philippines is in excess of the powers, duties and functions of the Sangguniang Barangay, as the legislative body of the Barangay;

WHEREAS, if the intention of the said Sanggunian is to implement the compensation adjustment to their Barangay, it is recommended that the Sanggunian approve an Ordinance appropriating for the said purpose. The increase in their compensation though allowed by E.O. 611 should still adhere to their approved budget, availability of funds, and the basic services mandated to be delivered by the Sangguniang Barangay concerned;

WHEREAS, the Sangguniang Panlungsod finds that the Barangay New Cabalan Resolution No. 12, Series Of 2007 Invalid in part and returning the same for their correction;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to declare, as it hereby declares Sangguniang Barangay New Cabalan Resolution No. 12, Series Of 2007 Invalid In Part And Returning The Same For Their Correction.
