RESOLUTION NO. 146

A RESOLUTION REQUESTING THE HOUSE OF REPRESENTATIVES TO APPROPRIATE AND FACILITATE THE RELEASE OF THE CITY SHARE RESULTING FROM TAXES COLLECTED AT THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) SPECIAL ECONOMIC ZONE FROM 1994-1998 AMOUNTING TO THIRTY MILLION EIGHT HUNDRED SEVENTY EIGHT THOUSAND ONE HUNDRED FIFTY-FOUR AND 58/100 PESOS (PHP30,878,154.58)

WHEREAS, Section 12 (c) of RA 7227 states that”…one percent (1%) shall be remitted to local government units affected by the declaration of the zone in proportion to their population area, and other factors. In addition, there is hereby established a development fund of one percent (1%) of the gross income earned by all businesses and enterprises within the Subic Special Economic Zone to be utilized for the development of municipalities outside the City of Olongapo and the Municipality of Subic, and other municipalities contiguous to the base areas;

WHEREAS, based on the policy stated above, the City of Olongapo is entitled for a 2% share from taxes collected from 1994-1998 as implemented by the Department of the Interior and Local Government (DILG), Department of Finance (DOF), and Department of Budget and Management (DBM) through a Joint Circular No. 99-2 dated 20 April 1999;

WHEREAS, the Bureau of Internal Revenue (BIR) had already forwarded a certification with respect to the 1% share of LGUs affected by the Declaration of the Zone and 1% share of the LGUs covered by the Special Development Fund;

WHEREAS, based on the above certification, the 1% share of Olongapo City with respect to the 1 % share for the LGUs affected by the Declaration of the Zone, amounts to Thirty Million Eight Hundred Seventy Eight Thousand One Hundred Fifty-four and 58/100 Pesos (PhP30,878,154.58) from the years 1994-1998;


WHEREAS, the funds stated above shall be used for the developmental projects of the City;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;


RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to request, as it hereby requests the House of Representatives to appropriate and facilitate the release of the City share resulting from taxes collected at the Subic Bay Metropolitan Authority (SBMA) Special Economic Zone from 1994-1998 amounting to Thirty Million Eight Hundred Seventy Eight Thousand One Hundred Fifty Four Pesos and 58/100 (PhP30,878,154.58)

Let copies of this Resolution be furnished to Her Excellency President Gloria Macapagal-Arroyo, Hon. Jose de Venecia, Jr., Speaker of the House of Representatives, Chairman, Committee on Appropriations of the House of Representatives and BUHAY Representative Carissa Coscolluela for their perusal.
