RESOLUTION NO. 53
(Series of 2015)

 FROM THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) FIRE DEPARTMENT DEPLOYED TO NEPAL  TO HELP IN THE SEARCH AND RESCUE AND DAMAGE ASSESSMENT AS A RESULT OF  THE DEVASTATING 7.8 MAGNITUDE EARTHQUAKE THAT STRUCK THE COUNTRY

WHEREAS, on April 25, 2015 a magnitude 7.8 Earthquake Struck Nepal, resulting to over seven thousand  persons killed and destroying priceless historic cultural structures;

WHEREAS, on April 29, 2015, the Philippine Red Cross immediately assembled and sent to Nepal a 13 Man Team to conduct Search & Rescue And Damage Assessment;

WHEREAS, the Philippine Rescue Team that was deployed, seven  are from Olongapo – SBMA Fire Department namely:

3. ROMEO PAULMINO
4. HEDION ESTEBAN
5EDWIN SANTOS
6. NOEL LAPID
7JAY-ARR BASA

WHEREAS, these brave rescue personnel proceeded to heavily damaged remote areas of Nepal like Dhading, Budor and Wakmanpur, far-flung areas that takes  four to six  hours of travel by foot to reach;

WHEREAS, the area of operation of these heroic Olongapo rescuers are so dangerous and treacherous that other international rescue teams refuse to proceed there;


WHEREAS, aside from conducting search and rescue of trapped or injured Nepalese, the Philippine Rescue Team also efficiently assembled rub halls or huge tents where relief goods are stored and kept;

WHEREAS, the International Federation of the Red Cross (IFRC) and The International Search & Rescue Advisory Group (INSARAG) has acknowledged the contributions and bravery of the only Philippine Rescue Team sent to Nepal;

WHEREAS, these Olongapo responders performed the tasks given, above and beyond the call of duty, exemplifying the Filipino bayanihan spirit and malasakit of a true Olongapeño;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present:

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled  to commend as it hereby commends the brave and heroic Batang Olongapo from the Subic Bay Metropolitan Authority (SBMA) Fire Department deployed to Nepal to help in the Search and Rescue and damage assessment as a result of the devastating 7.8 magnitude earthquake that Struck the country.

PAULINO TO ENTER INTO AND SIGN THE MEMORANDUM OF AGREEMENT WITH ‘SATURDAY AFTERNOON GENTLEMEN SAILING’ (SAGS) REPRESENTED BY  ITS CHAIRMAN, MR.  FEDERICO SANDOVAL, AS REGARDS THE HOLDING OF THE ‘SUBIC BAY TO BORACAY RACE’ (SBBR) ON FEBRUARY 27, 2015 UP TO MARCH 2, 2015 AND THE ‘BORACAY CUP REGATTA (BCR)’ ON MARCH 2-6 2015, WITHIN THE SUBIC BAY FREEPORT ZONE AND THE CITY OF OLONGAPO

WHEREAS, Saturday Afternoon Gentlemen Sailing  (SAGS),the leading organizer of local and international yacht racing event  in the country, wrote a letter of proposal dated February 3, 2015 to the City Mayor Rolen C. Paulino asking for the City’s cooperation and support to the upcoming Standard Insurance ‘6th Subic Bay to Boracay Race (SBBR)’ on February 27, 2015 to March 2, 2015 to the ‘Boracay Cup Regatta (BCR)’ on March 2-6, 2015 and to the ‘8th Commodores Cup Regatta’ on April 5-11, 2015;

WHEREAS, the said event are expected to draw a number of sailing enthusiasts and the City of Olongapo was invited to be part of the 2015 International Regatta to promote the Philippines, particularly the Subic Bay and surrounding areas as a world class tourist destination, domestically and internationally, that offers exciting, fun, and diverse experience in the water and land natural resources of Olongapo and Subic Bay;

WHEREAS, a Memorandum of Agreement is deemed necessary to carry out the specified mutual covenants between the City of Olongapo and the SAGS.

NOW, THEREFORE, on joint motion of City Councilors Aquilino Y. Cortez, Jr.  Emerito Linus D. Bacay and Eduardo G. Guerrero, with the unanimous accord of the Members of Sanggunian Panlungsod present;

  
RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes  the City Mayor Rolen C. Paulino to enter into and sign the Memorandum of Agreement with ‘Saturday Afternoon Gentlemen Sailing’ represented by  its Chairman, Mr.  Federico Sandoval as regards the holding of the ‘Subic Bay to Boracay Race’ (SBBR) on February 27, 2015  up to March 2, 2015 and the ‘Boracay Cup Regatta’ (BCR) on March 2-6 2015, within the Subic Bay Freeport Zone and the City of Olongapo.

Let a copy of the signed Memorandum of Agreement (MOA)  be made an integral part of this resolution.

WHEREAS, the government employees of the Subic Bay Metropolitan Authority (SBMA) are mostly the heroic volunteers that helped secure the former Subic Naval Base and establish the thriving Subic Bay Freeport Zone;

WHEREAS, the employees of the Subic Bay Metropolitan Authority are mostly Olongapeños whose last salary adjustment was in 2005 and has since then languished and found it challenging to cope to the rising costs of living.;

WHEREAS, salary adjustments can be implemented either as step increments or as provided by the Salary Standardization Law, subject to “availability of funds”;

WHEREAS, the City Government of Olongapo thru Honorable Mayor Rolen C. Paulino will implement a 50% salary adjustment in the 2015 pay of its employees for the 3rd tranche of the Salary Standardization Law despite assuming a city ridden with debts and other financial obligations;

WHEREAS, the SBMA is in a financial position to consider adjusting the salaries of its employees based on its declared revenue of P2.513 billion for 2014 and Php547.668 million budgeted for Personal Services in the Corporate Operating Budget (COB) for 2015;
  
WHEREAS, there is a great need for His Excellency, President Benigno Simeon C. Aquino III to intercede with the impasse of whether the Subic Bay Metropolitan Authority is part of the coverage of Republic Act 10149 (Government Owned & Controlled Corporation Act of 2011), therefore subject to the moratorium of salary increase, allowances and benefits or that the SBMA is categorized as a learning institution, therefore excluded by the same GOCC Act of 2011 and it could adopt the Salary Standardization Law to determine the rightful salaries of its employees;

WHEREAS, the City Council of Olongapo, representing our constituents from Olongapo, the employees of the Subic Bay Metropolitan Authority (SBMA) respectfully ask Honorable Benigno Simeon C. Aquino III, President of the Republic of the Philippines, to direct the Department of Budget & Management (DBM) to review the request of the SBMA to be included in the Salary Standardization Law and the Subic Bay Metropolitan Authority (SBMA) thru Honorable Chairman Roberto V. Garcia to consider the salaries & benefits as approved & ratified in the Corporate Operating Budget (COB) 2015 of the SBMA;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod  namely: City Councilors  Aquilino Y. Cortez, Jr., Emerito Linus D. Bacay, Benjamin G. Cajudo II, Elena C. Dabu, Edna A. Elane,  Eyrma Yvette D. Marzan-Estrella,  Eduardo G. Guerrero,  Alreuela M. Bundang-Ortiz, Eduardo J. Piano, Randy D. Sionzon, Noel Y. Atienza and Egmidio Gonzales, Jr.

RESOLVED, AS IT IS HEREBY RESOLVED,  by the Sangguniang Panlungsod in session assembled to ask, as it hereby respectfully asks, The Honorable President Of The Republic Of The Philippines, His Excellency Benigno Simeon C. RESOLUTION NO. 149

A RESOLUTION STRONGLY OPPOSING THE SUBIC BAY METROPOLITAN AUTHORITY (SBMA) RESOLUTION NO. 14-09-5172 ENTITLED: “APPROVING THE SUBIC BAY WATER REGULATORY BOARD (SBWRB) RESOLUTION NO. 2014-08-194” AND HEREBY REITERATING OLONGAPO CITY COUNCIL RESOLUTION NO. 87 SERIES OF 2014

WHEREAS, Subicwater and Sewerage Co. Inc.  is the exclusive water service provider in Olongapo City and Subic Bay Freeport Zone;

WHEREAS, Subicwater and Sewerage Co. Inc. is applying for a 6.58% tariff rate increase to cover their CAPEX requirements;

WHEREAS, the Subic Bay Metropolitan Authority (SBMA) Resolution No. 14-09-5172 approved the Subic Bay Water Regulatory Board (SBWRB) Resolution No. 2014-08-194;

WHEREAS, under the amended franchise agreement, Subicwater shall cover the maintenance and operation of old and new facilities in efficient and safe manner at its own expense;

WHEREAS, Subicwater  shall bear the expense of improving and renovating its existing facilities. That the people of Olongapo considers this proposed tariff increase as unfair and uncalled for – shifting the burden on the consuming public as it is already well-known that Subicwater is an income-generating company and enjoys steady profits;

WHEREAS, with steady price increase of basic commodities and non-declaration of wage increase by the national government, an additional 6.58% water rate increase will surely add burden to our people and will deprive them of their resources/hard-earned income to sustain food, education, health, house-rental requirements, and other day-to-day needs;

WHEREAS, the local government unit is mandated to look into the welfare of its people and the proposed tariff increase will impoverish them even more denying access to clean, potable water;;

NOW, THEREFORE,  with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to oppose, as it hereby opposes the proposed 6.58% water tariff increase of Subicwater and Sewerage Company, Incorporated and strongly urging Subic Bay Water Regulatory Board (SBWRB) and Subic Bay Metropolitan Authority (SBMA) to heed the public outcry against its implementation
