In the interest of public service and on motion of Councilor Aquilino Y. Cortez, Jr., with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 66
(Series of 2007)

AN ORDINANCE AMENDING CERTAIN PROVISIONS OF ORDINANCE NO.97, SERIES OF 1999, ENTITLED “AN ORDINANCE AMENDING CERTAIN PROVISIONS OF ORDINANCE NO. 22, SERIES OF 1990, ENTITLED “AN ORDINANCE AUTHORIZING TRAFFIC LAW ENFORCEMENT OFFICERS
TO TOW AND IMPOUND MOTOR VEHICLES AND/OR REMOVE TRAFFIC OBSTRUCTION IN ANY PUBLIC STREET OR THOROUGHFARE WITHIN OLONGAPO CITY, AND FOR OTHER PURPOSES”

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Section 1.b of Ordinance No. 97, Series of 1999 is hereby amended as follows:

FEES FOR THE RELEASE OF IMPOUNDED VEHICLE

The impounded vehicle shall be released only when the owner/driver has paid the towing service charge of:

TOWING FEE

Seven Hundred Fifty Pesos (PhP750.00) for motorcycle, motorized tricycle or any other motorized three-wheeled vehicles.

One Thousand Five Hundred Pesos (PhP1,500.00) for the first 2 kilometer for cars, vans, pick-up, jeeps and any other four-wheeled light vehicles not exceeding 4,500 kgs. Additional One Hundred Pesos (PhP100.00) for every succeeding kilometer.

Two Thousand Five Hundred Pesos (PhP2,500.00) for the first 2 kilometer for trucks, cargo trucks, 10 wheeler trucks and any other heavy vehicles with more than six (6) wheels light and exceeding 4,500 kgs. Gross weight. Additional One Hundred Fifty Pesos (PhP150.00) for every succeeding kilometer.

LIFTING FEE

Two Thousand Pesos (PhP2,000.00) for the first I hour for cars, vans, pick-up, jeeps and any other four-wheeled light vehicles not exceeding 4,500 kgs. Additional Five Hundred Pesos (PhP500.00) for every succeeding hour.

Three Thousand Pesos (PhP3,000.00) for the first 1 hour for trucks, cargo trucks, 10 wheeler trucks and any other heavy vehicles with more than six (6) wheels light and exceeding 4,500 kgs. Gross weight. Additional Seven Hundred Pesos (PhP700.00) for every succeeding hours.

SECTION 2. Proceeds of the towing and lifting fee charges shall accrue to the Traffic Citation Fee Trust Fund.

SECTION 3. This Ordinance shall take effect upon its approval.
