A RESOLUTION URGING ALL BARANGAYS OF OLONGAPO CITY TO CREATE THE BARANGAY HUMAN RIGHTS ACTION CENTER (BHRAC) AND TO CONVENE THE BARANGAY HUMAN RIGHTS ACTION OFFICERS (BHRAO) AS MANDATED BY THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT (DILG) MEMORANDUM

WHEREAS, in pursuance to Article 2, Section 11 of the 1987 Constitution declaring as State policy the promotion and protection of the dignity of every person and the guarantee for full respect of human rights, the Commission on Human Rights of the Philippines (CHRP) instituted the Barangay Human Rights Action Center (BHRAC) Program. The program was designed to empower the ordinary citizen to take the lead in the promotion and protection of human rights of the grassroots;

WHEREAS, DILG Memorandum Circular 94-194, dated October 27, 1994, enjoins all barangays to pass/adopt a Resolution for the Establishment of Human Rights Action Center (BHRAC);

WHEREAS, DILG had recently issued a Memorandum Circular No. 2006-45 enjoining all Punong Barangays to conduct an election of Barangay Human Rights Action Officer (BHRAO) during the Barangay Assembly Day on October 21,2006, nationwide. The DILG is committed to monitor the establishment and the election of BHRAOs in all barangays. As of the 1st quarter of CY 2007, 60.5% or 702 of the total 1,160 barangays in Region XI were able to elect their respective BHRAOs;

WHEREAS, the Responsibilities of LGUs in the BHRAC Program as stipulated in the MOA signed on December 11, 2001 are the following:

• Whenever necessary, issue circular/directive enjoining the barangays to pass/adopt resolution creating the BHRAC and selecting BHRAO in accordance with the duly adopted resolution according to set of standard provided in the BHRAC handbook.

• Give priority to BHRAC program and review human rights plan of action of respective LGU unit/level for inclusion in the annual budget appropriation.

• Appropriate funds for the BHRAC operationalization and BHRAOs support mechanism and incentive.

• Sponsor the BHRACs human rights activities and reproduce information and education materials.

• Document human rights situations/condition in each respective LGU levels.

• Maintain a directory of services and program for each LGU level.

WHEREAS, the Qualification of Barangay Human Rights Action Officer (BHRAO) are the following:

• At least a high school graduate;
• He/She is not less than 21 years old;
• Must be a person of probity and integrity;
• He/She must not be an elective/appointive official of the government;
• Once appointed, he/she must not engage in partisan political activities;
• Committed to the cause of human rights;
• Willing to undergo BHRAO Training.

WHEREAS, the Election process of a BHRAO shall be as follows:
• A barangay assembly meeting shall be convened for the purpose of nominating candidates and finally designating the person who shall serve as the BHRAO.

• The nominees shall come from among the members who are present during the barangay assembly.

• The BHRAO shall be chosen through viva voce voting by the majority of those present in the barangay assembly meeting. The voting shall be jointly supervised by the City/Municipal Planning Development and City/Municipal Local Government Operation Officer.

• The BHRAO shall hold office in any area assigned by the Chairman of the Barangay Council. The Barangay Council is also encouraged to appropriate allowances honorarium for BHRAO and provide them with facilities, supplies and other necessary means to enable them to perform their function effectively.

NOW, THEREFORE, on motion of Councilor John Carlos de los Reyes, with the unanimous decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to urge, as it hereby urges all Barangays of Olongapo City to create the Barangay Human Rights Action Center (BHRAC) and to convene the Barangay Human Rights Action Officers (BHRAO) as mandated by the Department Of The Interior And Local Government (DILG) memorandum.
