A RESOLUTION AUTHORIZING THE CITY LEGAL OFFICER ATTY. BERNARDINE S. GANTAN TO REPRESENT THE CITY GOVERNMENT OF OLONGAPO BEFORE THE MUNICIPAL TRIAL COURT, THE REGIONAL TRIAL COURT, THE COURT OF APPEALS, THE SUPREME COURT OF THE PHILIPPINES, AND QUASI-JUDICIAL BODIES, PERTINENT TO CASES INVOLVING THE CITY GOVERNMENT OF OLONGAPO.

WHEREAS, under Article 481 of Republic Act No. 7160 in relation to article 117 (2) (k) iii of its implementing Rules, the City Legal Officer shall provide the necessary legal services to ensure that best interests and welfare of the government is protected and enforced;

WHEREAS, by reason of the formal documentary requirements in courts of all levels and quasi-judicial bodies, a City Council resolution authorizing the City Legal Officer to represent the City in its legal cases and concerns should be presented or submitted to the court, body or tribunal concerned;

WHEREAS, the City Legal Officer shall appear or represent the City Government Employees in cases involving their respective offices and official capacity;

WHEREAS, the City is involved in court cases before courts of different levels, and may be involved in legal concerns with quasi-judicial bodies;

NOW, THEREFORE, on motion of City Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED by the Members of the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes, the City Legal Officer Atty. Bernardine S. Gantan to represent the City Government of Olongapo before the Municipal Trial Court, the Regional Trial Court, the Court of Appeals, the Supreme Court of the Philippines, and Quasi-judicial Bodies, pertinent to the cases involving City Government of Olongapo.

A RESOLUTION AUTHORIZING THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT (DILG) CITY DIRECTOR TO IMPLEMENT ALL DECISIONS OF THE SANGGUNIANG PANLUNGSOD REGARDING BARANGAY SUSPENSIONS, ETC.

WHEREAS, the Sangguniang Panlungsod is vested with authority to receive, investigate and decide cases against elective officials whose decisions shall be made final and executory as provided under the Local Government Code of 1991 Section 61 (c);

WHEREAS, the Department of the Interior and Local Government has a delegated authority of general supervision on all elective officials including the Barangay;

WHEREAS, the Legislative Body finds it proper to authorize the DILG City Director as the implementing arm of all the administrative decisions relative to erring barangay elective officials as it has the general supervision on the same;

NOW, THEREFORE, on motion of the City Councilor Edwin J. Piano with the unanimous accord of the members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes the Department of the Interior and Local Government (DILG) City Director to Implement All Decisions of the Sangguniang Panlungsod Regarding Barangay Suspensions, Etc.

A RESOLUTION REQUESTING THE HONORABLE DENR SECRETARY, JOSELITO ATIENZA, TO ACT ON THE DRIFTWOOD BEACH CASE FAIRLY AND EXPEDITIOUSLY, AND SUPPORTING THE CITY GOVERNMENT’S INITIATIVES TO ENSURE THAT IT WOULD BE UTILIZED FOR THE BEST INTEREST AND OPTIMUM BENEFIT OF THE ENTIRE COMMUNITY AND REAFFIRMING OLONGAPO CITY’S HISTORIC AND LEGAL RIGHT OVER DRIFTWOOD BEACH

WHEREAS, the City of Olongapo possesses a historic and legal right over Driftwood Beach (Maquinaya Beach), Brgy. Barretto, this City, pursuant to Republic Act No. 4645, otherwise known as the Charter of Olongapo City, approved on 01 June 1966, and as further reflected under Miscellaneous Sales Application duly filed by the City Government dated 11 March 1988 through then Mayor and now Senator, Richard Gordon, and reiterated in various City Council Resolutions and other official initiatives during the 1990s up to the present;

WHEREAS, there is a need to reaffirm the City’s historic right over Driftwood Beach (Maquinaya Beach) especially in light of its current underutilization, in conjunction with the pressing need to maximize its use relative to the City’s tourism initiatives, and to address the need for a transport hub that would service Freeport-based employees and the entire public;

WHEREAS, such pressing need would best be addressed by the Honorable Secretary Joselito Atienza, Department of Environment and Natural Resources (DENR), through a just and deliberately quick resolution of the long pending case relative thereto;

NOW, THEREFORE, on motion of City Councilor Aquilino Y. Cortez, Jr. with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests, the Honorable DENR Secretary, Joselito Atienza, to act on the Driftwood Beach case fairly and expeditiously, and supporting the city government’s initiatives to ensure that it would be utilized for the best interest and optimum benefit of the entire community and reaffirming Olongapo City’s historic and legal right over Driftwood Beach

RESOLUTION NO. 152
(Series of 2009)

A RESOLUTION STRONGLY OPPOSING THE PASSAGE OF HOUSE BILL NUMBER 24 AND CALLING FOR ITS OUTRIGHT REJECTION

WHEREAS, House Bill Number 24 was filed in Congress which seeks to exempt capital towns of provinces without cities from the requirements of cityhood specifically on the locally generated income of P100 million pesos;

WHEREAS, the House Committee on Local Government recently approved the passage of the Bill despite vehement objections from League. Furthermore, the Bill was approved without proper consultation and notification with the League;

WHEREAS, in LCP vs. COMELEC, the Supreme Court had ruled that “the creation of cities and other political units must follow the same uniform, non- discriminatory criteria found solely in the Local Government Code”;

WHEREAS, the City of Olongapo submits its strong opposition to House Bill 24 on the following grounds:

1. With the implementation of the first tranche monthly salary schedule for local government personnel under the new Salary Standardization Law 3 (SSL3) next year, the passage of the Bill will mean massive lay-offs (especially for the casual employees). Furthermore, the decrease in the IRA share will put a strain on the resources of the existing cities and will significantly impact the increasing demands for the delivery of basic services to the constituents.

2. It is the intent of RA 9009 that the municipalities that want to be converted into cities must prove that they will be capable of internally generating the income that will be sufficient for its sustenance. Amending RA 9009 simply to accommodate capital towns of provinces without cities would be inconsistent with the principle of cityhood.

3. Based on the local income data obtained from BLGF, all the capital towns were not able to meet the P100 million pesos locally generated income. Worst, 20 out of the 30 capital towns have a locally generated income of P20 million pesos and below. Clearly, these capital towns are not qualified to be converted into cities even applying the old requirement of P20 million pesos.

4. The current IRA sharing scheme is no longer responsive to the needs of the Philippine cities, which are at the forefront of bearing the great burden of urbanization in our country.

5. In LCP vs. COMELEC, the Supreme Court held that the intention of Section 10, Article X of the Constitution is to “insure that the creation of cities and other political units must follow the same uniform, no-discriminatory criteria found solely in the Local Government Code. While HB 24 seeks to amend Section 450 of the LG Code, the proposed exemption violates the requirement that the criteria for conversion of municipalities into cities must be uniform and non-discriminatory.

6. HB 24 also violates the equal protection clause of the Constitution. The proposed classification does not rest on substantial distinctions. There are no substantial distinctions between capital municipalities of provinces without cities and other municipalities that justify exempting these capital municipalities from the income requirement. It may also be argued that there is no substantial distinction between capital municipalities of provinces without cities and capital municipalities of provinces with cities.

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to:

1. STRONGLY OPPOSE the passage of House Bill Number 24
2. CALL for the outright rejection of House Bill Number 24 for being unconstitutional and
3. URGE the Honorable Members of the 14th Congress to uphold the principles laid down by the Supreme Court in LCP vs. COMELEC;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be forwarded to Senate President Juan Ponce Enrile. House Speaker Prospero Nograles, the Chairman of the House Committee on Local Government, Hon. George P. Arnaiz, the Chairman of the Senate Committee on Local Government, Sen. Noynoy Aquino III, all the senators and all the members of the House Committee on Local Government for their favorable consideration and immediate action, and the authors of the House Bills and the League of Cities of the Philippines for their information.

A RESOLUTION URGING ALL BARANGAYS OF OLONGAPO CITY TO CREATE THE BARANGAY HUMAN RIGHTS ACTION CENTER (BHRAC) AND TO CONVENE THE BARANGAY HUMAN RIGHTS ACTION OFFICERS (BHRAO) AS MANDATED BY THE DEPARTMENT OF THE INTERIOR AND LOCAL GOVERNMENT (DILG) MEMORANDUM

WHEREAS, in pursuance to Article 2, Section 11 of the 1987 Constitution declaring as State policy the promotion and protection of the dignity of every person and the guarantee for full respect of human rights, the Commission on Human Rights of the Philippines (CHRP) instituted the Barangay Human Rights Action Center (BHRAC) Program. The program was designed to empower the ordinary citizen to take the lead in the promotion and protection of human rights of the grassroots;

WHEREAS, DILG Memorandum Circular 94-194, dated October 27, 1994, enjoins all barangays to pass/adopt a Resolution for the Establishment of Human Rights Action Center (BHRAC);

WHEREAS, DILG had recently issued a Memorandum Circular No. 2006-45 enjoining all Punong Barangays to conduct an election of Barangay Human Rights Action Officer (BHRAO) during the Barangay Assembly Day on October 21,2006, nationwide. The DILG is committed to monitor the establishment and the election of BHRAOs in all barangays. As of the 1st quarter of CY 2007, 60.5% or 702 of the total 1,160 barangays in Region XI were able to elect their respective BHRAOs;

WHEREAS, the Responsibilities of LGUs in the BHRAC Program as stipulated in the MOA signed on December 11, 2001 are the following:

• Whenever necessary, issue circular/directive enjoining the barangays to pass/adopt resolution creating the BHRAC and selecting BHRAO in accordance with the duly adopted resolution according to set of standard provided in the BHRAC handbook.

• Give priority to BHRAC program and review human rights plan of action of respective LGU unit/level for inclusion in the annual budget appropriation.

• Appropriate funds for the BHRAC operationalization and BHRAOs support mechanism and incentive.

• Sponsor the BHRACs human rights activities and reproduce information and education materials.

• Document human rights situations/condition in each respective LGU levels.

• Maintain a directory of services and program for each LGU level.

WHEREAS, the Qualification of Barangay Human Rights Action Officer (BHRAO) are the following:

• At least a high school graduate;
• He/She is not less than 21 years old;
• Must be a person of probity and integrity;
• He/She must not be an elective/appointive official of the government;
• Once appointed, he/she must not engage in partisan political activities;
• Committed to the cause of human rights;
• Willing to undergo BHRAO Training.

WHEREAS, the Election process of a BHRAO shall be as follows:
• A barangay assembly meeting shall be convened for the purpose of nominating candidates and finally designating the person who shall serve as the BHRAO.

• The nominees shall come from among the members who are present during the barangay assembly.

• The BHRAO shall be chosen through viva voce voting by the majority of those present in the barangay assembly meeting. The voting shall be jointly supervised by the City/Municipal Planning Development and City/Municipal Local Government Operation Officer.

• The BHRAO shall hold office in any area assigned by the Chairman of the Barangay Council. The Barangay Council is also encouraged to appropriate allowances honorarium for BHRAO and provide them with facilities, supplies and other necessary means to enable them to perform their function effectively.

NOW, THEREFORE, on motion of Councilor John Carlos de los Reyes, with the unanimous decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to urge, as it hereby urges all Barangays of Olongapo City to create the Barangay Human Rights Action Center (BHRAC) and to convene the Barangay Human Rights Action Officers (BHRAO) as mandated by the Department Of The Interior And Local Government (DILG) memorandum.

A RESOLUTION AUTHORIZING MR. RAMON DASIG BALAGTAS, ADMINISTRATIVE OFFICER V, PUBLIC UTILITIES DEPARTMENT, TO REPRESENT THE CITY GOVERNMENT OF OLONGAPO PUBLIC UTILITIES DEPARTMENT IN THE PROSECUTION OF CRIMINAL CASES

WHEREAS, a number of cases of suspects were caught and apprehended by the Public Utilities Department involved in Blatant Violation of Republic Act. No. 7832 otherwise known as the “Electricity Anti- Pilferage Act”;

WHEREAS, under Republic Act No. 7160 (The Local Government Code Of 1991), the City is vested with corporate powers including the power to sue and be sued;

WHEREAS, with Olongapo losing millions of pesos to this kind of illegal act, the city deems it best to prosecute the offenders in court; with the recommendation of its Legal Department;

NOW, THEREFORE, on motion of Councilor Jonathan G. Manalo, with the unanimous accord of the Members of Sangguniang Panlungsod present.

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes Mr. Ramon Dasig Balagtas, Administrative V, Public Utilities Department, to represent the City Government of Olongapo Public Utilities Department in the Prosecution of criminal cases before the City Prosecutor’s Office and the Trial Courts, and to appear before the same.

RESOLVED FURTHER, AS IT HEREBY FURTHER RESOLVED, that Mr. Ramon Dasig Balagtas is hereby given full power and authority to do and perform all acts and things whatsoever requisite and necessary to be done in and about the premises as fully to all intents and purpose for and in the name of the City.

RESOLVED, FINALLY, AS IT IS HEREBY FINALLY RESOLVED, that it shall be the obligation of Mr. Balagtas to furnish the Hon. Mayor and the City Legal Office with updates and pertinent reports relative thereto on a regular basis

A RESOLUTION SUPPORTING HOUSE BILL NUMBER 4315 WHICH SEEKS TO DISCONTINUE THE PROLIFERATION OF SCANDALOUS MATERIALS IN THE COUNTRY AND CALLING ALL CONCERNED OFFICES FOR ITS IMMEDIATE PASSAGE AND IMPLEMENTATION

WHEREAS, Philippines being a predominantly Christian community promotes good values as a strong foundation of its culture;

WHEREAS, most recently, issues that demolish this culture have blatantly come out and affected many homes, work places and the Filipino people individually;

WHEREAS, several sex scandals involving the young generation in the showbiz world and academe have proliferated the telecommunication industry and the world wide web causing disturbance in the community and the government;

WHEREAS, in this period of modern society where cellular phones, internet and the broadcast media are of recurrent utilization, those young women who are being exposed in unfortunate circumstances are placed in indignity and humiliation;

WHEREAS, Section 14 of the Philippine Constitution states that women have respective roles in nation building and shall be afforded the fundamental equality;

WHEREAS, women as mothers and wives should be given utmost respect and affection because families and communities will not be significantly built without them;

WHEREAS, Senator Pia Cayetano has proposed Senate Bill 3267 or the Anti-Video Voyeurism Act of 2009 which seeks to prohibit and penalize the recording of private act or acts as well as the distribution or exhibition of such recordings without the consent of the person involved;

WHEREAS, Buhay Party List Representatives Hon. Irwin C. Tieng, Hon. Rene M. Velarde and Hon. Ma. Carissa O. Coscolluela at the same time, proposed House Bill 4315 of the Anti-Cyber-boso Bill which seeks to criminalize taking and possessing indecent video clips using mobile phones or video cameras;

WHEREAS, such circulation of these obscene sexual acts and other pornographic materials are condemnable to the Filipinos specifically for women who are doubly victimized and the culprits must be castigated;

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, with unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to support, as it hereby supports House Bill 4315 which seeks to discontinue the proliferation of scandalous materials in the country and call all concerned offices for its immediate passage and implementation.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be given to the Philippine Congress, the Philippine Senate, Optical Media Board and Office of the President for their action.

WHEREAS, with tourism being the main industry in the City of Olongapo, there is a need to explore some other potential sites to serve as additional tourist spots in the locality;

WHEREAS, the existing waterfalls located at dead end of 26th Street, East Bajac-Bajac has been considered as one of the potential tourist spots that can be converted as an eco-tourism site;

WHEREAS, the conversion will contribute to the environmental protection and preservation not only in boosting tourism industry, but also in providing various livelihood programs that will uplift the income of the residents in the City of Olongapo.

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Sangguniang Panlungsod present,

SECTION 1. The waterfalls located dead end of 26th Street, East Bajac-Bajac shall be named as “Falls in Love”.

SECTION 2. A copy of this ordinance shall be furnished to barangay of East Bajac-Bajac for information and record.


SECTION 3. This ordinance shall take effect immediately upon its approval.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES L. GORDON, JR. TO ENTER INTO A MEMORANDUM OF AGREEMENT (MOA) FOR THE SWAPPING OF LAND BETWEEN CALVARY CHAPEL OLONGAPO AND THE CITY GOVERNMENT OF OLONGAPO

WHEREAS, the City of Olongapo is vested under the Local Government Code the power of a corporation and as such has the power to acquire and convey real or personal property;

WHEREAS, the City Government of Olongapo owns and possesses a certain parcel of lot with the following description:

WHEREAS, construction will commence upon Calvary Chapel Olongapo acceptance of the offer and the physical transfer will take place once the construction is 100% completed and ready for occupancy;

WHEREAS, Calvary Chapel Olongapo may take all personal or real (except land) including machineries from the said property (Lot No 028) for them to dispose or enjoy its use;

A RESOLUTION URGING ALL OFFICES UNDER THE OLONGAPO CITY GOVERNMENT TO IMPLEMENT FORTHWITH REPUBLIC ACT NO. 9485 OTHERWISE KNOWN AS “AN ACT TO IMPROVE EFFICIENCY IN THE DELIVERY OF GOVERNMENT SERVICE TO THE PUBLIC BY REDUCING BUREAUCRATIC RED TAPE PREVENTING GRAFT AND CORRUPTION,AND PROVIDING PENALTIES THEREFOR”

WHEREAS, Article II, Section 27 of the 1987 Constitution of the Republic of the Philippines pronounces, “The state shall maintain honesty and integrity in the public service, and take positive and effective measures against graft and corruption”;

WHEREAS, The 1987 Constitution of the Republic of the Philippines created the Civil Service Commission, as the central personnel agency of the Government, that shall initiate measures to promote the morale, efficiency, integrity, responsiveness and courtesy in the civil service;

WHEREAS, On June 2, 2007 President Gloria Macapagal Arroyo signed into law Republic Act 9485 otherwise known as “An Act to Improve Efficiency in the Delivery of Government Service to the Public by Reducing Bureaucratic Red Tape Preventing Graft and Corruption, and Providing Penalties Therefor”;

WHEREAS, RA 9485 or the Anti Red Tape Act of 2007 was passed in response to the pressing necessity to establish an effective system that will eliminate bureaucratic red tape, avert graft and corrupt practices and improve efficiency of delivering government frontline service;

WHEREAS, the City Government of Olongapo is in its continuous fight for excellence to ensure maximum delivery of service to its constituency, as its reason for existence;

WHEREAS, the present administration, expresses its extreme desire to improve the existing system of procedures, to eliminate unnecessary steps in delivering services to its people and to launch an efficient program that will result into a harmonious relationship with the local populace;

NOW, THEREFORE, with unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to urge, as it hereby urges all offices under the Olongapo City Government to implement forthwith Republic Act No. 9485 otherwise known as “An Act to Improve Efficiency in the Delivery of Government Service to the Public by Reducing Bureaucratic Red Tape Preventing Graft and Corruption, and Providing Penalties Therefor.”

A RESOLUTION AUTHORIZING THE CITY MAYOR, HON. JAMES GORDON, JR. FOR AND IN BEHALF OF THE GORDON COLLEGE TO ENTER INTO A CONTRACT OF AFFILIATION WITH THE MARIVELES MENTAL WARD REPRESENTED BY DR. RIO L. MAGPANTAY

WHEREAS, the Gordon College is a tertiary level learning institution duly authorized and recognized by the Commission on Higher Education to accept enrollees for Health Science and related programs;

WHEREAS, the increasing demand for health professionals in the global market, led to the growing number of enrollees to the said school and a tertiary-care capable hospital is necessary to comply the Nursing Act of 2002 that requires nursing students to undergo Related Learning Experience (duty hours) in the community as well as in hospital setting;

WHEREAS, the Mariveles Mental Ward is an authorized hospital that has the capability and the facilities to impart the real hospital set up and exposures required of a nursing job to the students;

WHEREAS, the Mariveles Mental Ward agrees and allows the affiliation and training of nursing students of the Gordon College subject to the policies, procedures and guidelines governing Affiliation and Training of Students prescribed by the Department of Health/Hospital/Rural Health Units and Other Health Agencies;

WHEREAS, Gordon College shall provide the grading system and the grading sheets to be used by the Mariveles Mental Ward for the Related Learning Experience (RLE) exposure;

NOW, THEREFORE, on motion of Councilor John Carlos G. delos Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize, as it hereby authorizes City Mayor, Hon. James Gordon, Jr. for and in behalf of the Gordon College to enter into a contract of affiliation with the Mariveles Mental Ward represented by Dr. Rio L. Magpantay.

RESOLUTION NO. 110
(Series of 2008)

A RESOLUTION AUTHORIZING THE CITY MAYOR AND/OR THE CITY LEGAL OFFICER TO REPRESENT THE CITY OF OLONGAPO IN THE TWIN CASES OF “MEREDITH VS. CITY OF OLONGAPO” AND “CITY OF OLONGAPO VS. MEREDITH” LODGED BEFORE DENR-REGION III INVOLVING HALF MOON BEACH AND ITS ACCRETED AREA

WHEREAS, on 08 July 2008, the City received an order from the Department of Environment and Natural Resources (DENR) Region III requesting to submit its comment to the protest filed by Teresita Meredith and her letter to Malacañang dated 05 March 2008 in connection with the accretion area in Half Moon Beach, Kalaklan, Olongapo City;

WHEREAS, on 15 July 2008, the City filed its comment in connection to said protest and letter and registered its own protest on the Miscellaneous Sales Application (MSA) of Meredith anent (x-4) 3014 referring to Half Moon Beach, Kalaklan, Olongapo City;

WHEREAS, under the 1959 Turn-over Agreement between the governments of the United States of America and the Philippines and the Exchange of Notes, said area had been declared open to the public for swimming and other recreational purposes;

WHEREAS, under Republic Act No. 4645, as amended (otherwise known as the Charter of the City of Olongapo), ownership of properties within the City of Olongapo of whatever nature and source transferred and/or turned over to the Philippine Government by the United States Government before, during and after the date of the turnover of the then community of Olongapo on December 7, 1959, shall vest on the city;

WHEREAS, under Republic Act No. 7160 (the Local Government Code of 1991), the city is vested with corporate powers and provides that the City Council has the power to grant authority to its officers to represent the City Government in the exercise of its corporate powers including the power to sue and be sued;

NOW, THEREFORE, on motion of Councilor Aquilino Y. Cortez, Jr., with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled that the City Government hereby appoints the incumbent City Mayor, Hon. James Gordon, Jr., and/or the City Legal Officer as its duly authorized representative in the above-mentioned case, and to appear before the same; to attend Pre-Trial up to the final termination of the case; to enter into compromise of the said case on such terms and conditions which our attorneys-in-fact may deem best and appropriate to our interest; to execute, sign and deliver any papers or documents, to give any papers or documents to give full effects to the power herein above-granted; hereby giving and granting unto said attorneys full power and authority to be done in the premises.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that in connection with the said case, the Hon. Mayor/City Legal Officer is/are hereby given full power and authority to do and perform all acts and things whatsoever requisite and necessary to be done in and about the premises as fully to all intents and purposes for and in the name of the city.

WHEREAS, on 03 March 2008, Teresita Meredith filed a Complaint for Injunction against the City Government of Olongapo and its officials led by Hon.
