RESOLUTION NO. 141
(Series of 2013)

A RESOLUTION INTERPOSING NO OBJECTION TO THE APPLICATION OF TREASURE AMUSEMENT CORPORATION TO OPERATE AND MANAGE  PAGCOR E-GAMES STATION (PEGS 2) IN OLONGAPO CITY, IN A MANNER CONSISTENT WITH LAW

WHEREAS, Treasure Amusement Corporation of Olongapo City has signified its intention to operate and manage PAGCOR e-games station (PEGS 2)  with business address at #4 -20th Street, East Bajac-Bajac;

WHEREAS, Philippine Amusement and Gaming Corporation (PAGCOR) has required Treasure Amusement Corporation to secure a “Resolution of No Objection” from the City where the said business unit shall be operated prior to PAGCOR’s issuance of a Grant of Authority;

WHEREAS, the Treasure Amusement Corporation in their letter to the City Vice Mayor dated August 14, 2013 requested for a City Council Resolution that interposes no objection to its intention to operate and manage the said business unit for the purpose of complying to new PAGCOR requirements;

WHEREAS, the City Planning and Development Office (CPDO) confirms in their letter dated September 30, 2013 that the above-mentioned business unit meet the requirement of Article VI, Section 5.f of the Zoning Ordinance that “recreational centers/ establishments are allowed in Commercial Zone provided that it shall not be located within twenty (20) meters from any institutional structure;”

WHEREAS, the City Government of Olongapo confirms that it interposes no objection to the application of Treasure Amusement Corporation to operate and manage PEGS 2 in Olongapo City provided that the same is in accordance with the City’s Zoning Ordinance and the City regulation;

WHEREAS, strict control over the admission of persons under 21 years of age shall be administered in the gaming area as stated in Presidential Decree No. 1869 otherwise known as: “Consolidating And Amending Presidential Decree Nos. 1067-A, 1067-B, 1067-C, 1399 And 1632, Relative To The Franchise And Powers Of The Philippine Amusement and Gaming Corporation (PAGCOR) under Title IV, Section 14, No. 2.c;”

NOW, THEREFORE, on motion of City Councilor Edna A. Elane, co-sponsored by City Councilor Elena C. Dabu, with the majority decision  of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to interpose, as it hereby interposes no objection to the application of Treasure Amusement Corporation to operate and manage PAGCOR E-Games Station (PEGS 2) in Olongapo City, in a manner consistent with law.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that  a copy of the Letter of No Objection dated October 7, 2013 issued by the City Mayor Rolen C. Paulino to Mr. Samuel Del Rosario, the Chairman of the Treasure Amusement Corporation, Olongapo City, be an integral part of this resolution.
