RESOLUTION NO. 143
(Series of 2005)

A RESOLUTION SUPPORTING THE PASSAGE OF HOUSE BILL NOS. 1278, 2031 AND 2887 OTHERWISE KNOWN AS THE “ANTI-OBSCENITY AND PORNOGRAPHY ACT OF 2004”

WHEREAS, obscenity came from the Greek word ob-skene meaning offstage, in Latin obscenus which means foul, repulsive or detestable. In legal context, it is the term commonly used to describe expression which covers words, images, actions, that offends the prevalent sexual morality of the time;

WHEREAS, pornographia is the etymology for pornography, which interprets human body, or human sexual behavior. It can be of different media: written or spoken like photos, sculptures, drawings, moving images and even animation sounds;

WHEREAS, society has conceptualized that obscenity and pornography leads to the increasing number of crimes against persons and chastity; worse, the rate of juvenile delinquents involving the aforementioned crimes is rapidly increasing;

WHEREAS, the enactment of the aforementioned Bills sponsored by Representatives Emmanuel Joel Villanueva, Eilleen Ermita- Buhain and Bienvinido Abante, Jr., respectively, will strictly proscribe the exploitation and dehumanization of the sacred bodies by fully forbidding public demonstration of sexual acts, distribution and production of obscene and pornographic materials. This measure also defined in a wider view the illicit acts of pornography. Moreover, it will give justice to those victims of these actions; and it will broaden the range of our constitutional law in this contemporary period;

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;
RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to support, as it hereby supports the passage of House Bill Nos. 1278, 2031 and 2887 otherwise known as the “Anti-Obscenity and Pornography Act of 2004.”

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that the copies of this Resolution shall be furnished to the Office of City Social Welfare and Development, PREDA Foundation, Philippine Councilors’ League and the House of Representatives for their support.
