RESOLUTION NO. 180
(Series of 2006)

A RESOLUTION REQUESTING THE OVERSIGHT COMMITTEE OF THE
HOUSE OF REPRESENTATIVES TO ESTABLISH SPECIFIC GUIDELINES
IN IMPLEMENTING THE 1991 LOCAL GOVERNMENT CODE PROVISION GRANTING EDUCATIONAL PRIVILEGE TO LEGITIMATE DEPENDENT CHILDREN OF OFFICIALS OF BARANGAYS AND SANGGUNIANG
KABATAAN OFFICIALS

WHEREAS, Local Government Code of 1991 (Section 393 (b) (4) and Section 434) and its Implementing Rules and Regulations (Art. 77 (b) (4) and Art 203 (f) (i) provide that legitimate dependent children of Barangay officials and Sangguniang kabataan (SK) officers shall be exempt from the payment of tuition fees in state universities and colleges located within the province or city to which the Barangay belongs;

WHEREAS, the said provisions specify that the national government shall reimburse the state university or college the amount of tuition and matriculation fees of dependents of Barangay officials and SK officers;

WHEREAS, a number of dependents of Barangay officials and SK officers have availed this educational privilege in the different SUCs;

WHEREAS, the state universities and colleges have been requesting the national government for reimbursement of the corresponding tuition and matriculation fees;

WHEREAS, according to the Department of Budget and Management, funding requirements for the implementation of this LGC provision should be charged against the annual appropriations of the SUC concerned with no additional funds from the national government;

WHEREAS, the SUCs complain that they could not sustain the full implementation of this LGC provision without additional funds coming from the national government;


WHEREAS, the SUCs through their respective Boards were forced to limit those availing of this educational privilege by adopting their own criteria based on their financial capability;

WHEREAS, the differences in the guidelines being followed by SUCs in processing this educational privilege have been causing confusion and irritation from among dependents and officials of Barangays and Sanggunians;


NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan, co-sponsored by Councilors Carlito A. Baloy and Robine Rose C. Buenafe, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, the Sangguniang Panlungsod in session assembled, to request, as it hereby requests the Oversight Committee of the House of Representatives to establish specific guidelines in implementing the 1991 Local Government Code provision granting educational privilege to legitimate dependent children of officials of Barangay and Sangguniang Kabataan,.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be furnished to the 17 Barangays and the Office of the Sangguniang Kabataan Federation.
