RESOLUTION NO. 02
(Series of 2008)

A RESOLUTION RATIFYING THE MEMORANDUM OF AGREEMENT BETWEEN THE JAMES L. GORDON MEMORIAL HOSPITAL (JLGMH) AND FORTUNE CARE MEDICARE, INC. REPRESENTED BY MS. DOROTHEA J. SIBAL, EVP.AND GENERAL MANAGER WITH ADDITIONAL STIPULATIONS


WHEREAS, that the amount deducted from the COMPANY’S bill as legislated health benefits be disallowed or reduced by the government bodies concerned, the COMPANY shall correspondingly adjust its payment to the HOSPITAL without controversion;

WHEREAS, failure to pay within the agreed period shall bind the COMPANY to pay interest charges at the rate of two percent (2%) per month until the amount is fully paid. Should the unpaid amount need to be endorsed to a lawyer for collection, the HOSPITAL reserves its right to charge additional interest on the unpaid amount of up to three percent (3%) per month;

WHEREAS, herein parties hereby agree that any and all court actions or suits between the parties arising from this Agreement shall be instituted or filed in the proper court of a competent jurisdiction in Olongapo City, Philippines;.

NOW, THEREFORE, on motion of Councilor John Carlos G. delos Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to ratify, as it hereby ratifies the Memorandum of Agreement between the James L. Gordon Memorial Hospital (JLGMH) and Fortune Care Medicare, Inc. represented by Ms. Dorothea J. Sibal, EVP and General Manager with additional stipulations.
