WHEREAS, Zone 6, a tricycle zone created to serve the Iram Resettlement Area, which includes Pinagpala and San Isidro at Barangay New Cabalan, this City submitted a resolution signed by their officers to request for a fare increase for them to cope up with the escalating prices of gasoline, diesel and oil as well as tricycle spare parts;

WHEREAS, a public hearing was conducted on July 29, 2008 on this regard and as such a Php10.00 for Pinagpala, PhP11.00 for San Isidro and PhP12.00 starting 10:00 p.m. to 4:00 a.m. in both areas, , shall be charged as fare for each passenger on the said routes. A 20% discount on the fares of Senior Citizens, Students and Disabled persons had also been discussed;

WHEREAS, the aforementioned fares had been agreed upon for indorsement to the Sangguniang Panlungsod for appropriate action;

NOW, THEREFORE, on motion of Councilor John Carlos G. Delos Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 43

AN ORDINANCE AUTHORIZING THE INCREASE OF TRICYCLE FOR HIRE FARE AT IRAM RESETTLEMENT AREA - ZONE 6

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED, THAT:

SECTION 1. Tricycle fares at the Iram Resettlement Area shall now be as follows :

Pinagpala PhP10.00
San Isidro PhP11.00
Starting 10:00 p.m. to 4:00 a.m.- PhP12.00 both areas


SECTION 2. Charging of more than the aforesaid fares shall be deemed as a violation of this Ordinance and shall be subject to the provision of penalties stipulated in Ordinance No. 32, Series of 2001, under the citation system.

SECTION 3. This in effect supersedes Ordinance No. 20, Series of 2005.

SECTION 4. Payment of Three Hundred Pesos (PhP300.00) for the application of fare increase is hereby suspended.

SECTION 5. Copies of this Ordinance shall be provided to all law enforcement agencies in the City for their information and guidance.

SECTION 6. This ordinance shall take effect upon its approval.
