RESOLUTION NO. 144
(Series of 2005)

A RESOLUTION SUPPORTING THE PASSAGE OF HOUSE BILL NO. 4613 OTHERWISE KNOWN AS, “AN ACT DEFINING THE CRIME OF CHILD PORNOGRAPHY, IMPOSING PENALTIES THEREFORE,
AND FOR OTHER PURPOSES”

WHEREAS, RA 7610, Article 5, Section 9, otherwise known as, “An Act Against Child Abuse,” provides that, “Any person who shall hire, employ, use, persuade, induce or coerce a child to perform in obscene exhibitions and indecent shows, whether live or in video, pose or model in obscene publications or pornographic materials, or sell or distribute the said materials shall suffer the penalty of prision mayor in its medium period”;

WHEREAS, pornography does not only dishonor an individual, but also obliterates a child’s innocence and future as well;

WHEREAS, the rampant problem in child pornography renders Republic Act 7610 insufficient and inefficient to protect and guard the children from such a terrible crime;

WHEREAS, the stand of House Bill 4613, sponsored by Representative Hans Christian Seyeres, is to strengthen the measures against pornography, involving children by defining the crime in a larger scope and imposing severe penalties;
NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to support, as it hereby supports the passage of House Bill No. 4613, otherwise known as, “An Act Defining the Crime of Child Pornography, Imposing Penalties Therefore and for other Purposes.”

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that the copies of this resolution be furnished to the Office of CSWD, PREDA Foundation, Philippine Councilors’ League and the House of Representatives for their support.
