RESOLUTION NO. 145
(Series of 2005)

A RESOLUTION SUPPORTING THE PASSAGE OF HOUSE BILL NO. 4575 OTHERWISE KNOWN AS, “AN ACT PENALIZING ON- LINE CHILD PORNOGRAPHY”

WHEREAS, the term “child abuse” referred to in Republic Act No. 7610, Section 3, 6, d otherwise known as, “An Act Against Child Abuse,” pertains to, “circumstances analogous to endangering life, safety, or normal development of children”;

WHEREAS, Republic Act 7610 covers a comprehensive program of services and facilities to protect children against (a) child prostitution and sexual abuse; (b) child trafficking; (c) obscene publications and indecent shows; (d) other acts of abuse; and (e) circumstances that threaten or endanger the survival and normal development of children;

WHEREAS, technological advancement, humongous production of high-tech gadgets and constant innovations in international networking render Republic Act 7610 insufficient and inefficient to assure safety of children against other forms of exploitation and abuse;

WHEREAS, the onset of on-line pornography among children has brought about pressing problem that necessitates urgent attention;

WHEREAS, House Bill 4575, sponsored by Representative Rodolfo Bacani of Manila, encourages the justice system to classify any forms of on-line pornography of children as a crime, and shall be punishable by the appropriate penalties;

WHEREAS, this resolution recommends the inclusion of telecommunication equipment like high-powered cell phones with add-in feature such as bluetooth, camera, video-audio, infrared, MMS, etc.;

NOW, THEREFORE, on motion of Councilor Gina Gulanes-Perez, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to support, as it hereby supports the passage of House Bill No. 4575, otherwise known as, “An Act Penalizing On-Line Child Pornography”;

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that the copies of this resolution be furnished to the Office of City Social Welfare and Development, PREDA Foundation, Philippine Councilors’ League and the House of Representatives for their support.
