The City Vice-Mayor and Presiding Officer Cynthia G. Cajudo called the session to order at 5:30 in the afternoon.

Councilor Gina Perez requested for a two-minute recess for the reading of the minutes.

30. Urgent request from the City Mayor for the passage of a resolution authorizing him to represent the City of Olongapo and enter into a contract of loan with the Development Bank of the Philippines in the principal amount of PhP77 Million and to sign the Loan Agreement promissory note and other documents related thereto to implement the aforementioned project. This pertains to the proposed implementation of the acquisition of the dredging machine. (Referred to the Committee as a Whole)
31. City Mayor’s letter on the proposed reversion of funds to finance the PUDs proposed electrical power distribution system continuing rehabilitation and maintenance program. He is requesting for the urgency of the passage of an ordinance reverting the amount of PhP30 Million from the unappropriated National Power Corporation billings to Capital Outlay of the Public Utility Office to fund the above mentioned project.
Committee Reports
Councilor Perez reported on the following:
1. Philippine Councilors League, Olongapo City Chapter
A memo was sent to all officers to discuss the upcoming students consultation which was re-scheduled in September 20, function rooms of the Olongapo City Convention Center. Councilor Perez requested for a meeting on September 17, Sangguniang Panlungsod Session Hall to discuss details of the student consultation.
2. Women Leader Summit according to Councilor Perez. The Asia Foundation with funding support of the United States, Department of the State thru United States Agency for International Development or USAID carried out a two-year empowerment of women leadership program wherein 75 women councilors from selected cities throughout the Philippines; strengthen the leadership skills of the newly elected councilors and link them to the women constituency, build women’s network to advance women’s rights and interests and awareness of women in elective office as effective leaders in their communities and encourage women’s active participation in political life.
The culminating activity was the Women Leaders Summit: “Local Leaders Who Make a Difference” spearheaded in partnership with Ateneo School of Government Dawn Foundation Inc. and Al Mujadilah Development Foundation with the following objectives:
a. Share leadership practices, personal thoughts for good governance.
b. Know the principles of effective/good governance.
c. Create the need for a movement of a new breed of women political leaders for good governance.
On the first day, the participants were welcomed by Ms. Maribel Buenaobra, the Managing Program Officer of the Asia Foundation. Dr. Steven Rood, country representative of the Asia Foundation gave the opening remarks. There were two plenary sessions conducted in the morning:
(1) System for Anti-Corruption: Engaging the Bureaucracy by Hon.Karina Constantino-David, Chair of Civil Service Commission and;
(2) Ethical Leadership and Accountability by Dr. Antonnette Palma- Angeles, Director of the Office of International Programs, Ateneo de Manila University.
In the afternoon, break-out sessions were conducted:
(1) People Center Change by Mayor Jesse Robredo of Naga City.
(2) Winning People’s Confidence through Good Governance by Mayor Sonia Lorenzo and ;
(3) Local Health Practices that Work by Dr. Jaime Galvez Tan.
On the second day, there were 2 plenary presentations held in the morning:
(1) Local Resource Mobilization and Management by Mr. Erlito Pardo, former Deputy Executive Director of the Bureau of Local Government Finance, Department of Finance and;
(2) Environment and Natural Resources Management at the Local Level by Miss Elisea Goson, former Secretary Department of Environment and Natural Resources.
According to Councilor Perez, The Asia Foundation with funding support of the United States.
As Committee Chair on transportation, Councilor delos Reyes informed his colleagues that he met with Col. Aquino of the OTMPS regarding the plans to embark or crackdown all colorum vehicles.
Calendar of Business
Third Reading:
1. Draft Resolution No. 2007 – R-43 - “A Resolution Authorizing The City Mayor To Enter Into A Memorandum Of Agreement With The Department Of The Interior And Local Government (DILG) Through The Bureau Of Local Government Development (BLGD) Regarding The Community Based Monitoring System (CBMS)”. Sponsored by Councilor Edwin J. Piano.
Since there are some changes in the said resolution, it is requested that the same should pass third reading. The title was changed to: “A Resolution Authorizing the City Mayor To Enter Into A Memorandum Of Agreement With The Department Of The Interior And Local Government (DILG) Through The Bureau Of Local Government Development (BLGD) And Community Based Monitoring System (CBMS) Network Coordinating Team Of Angelo King Institute of Economic And Business Studies Regarding The Community Based Monitoring System (CBMS) which was opposed by the body. With no other comments, Draft Resolution No. 2007 – R-43 was unanimously approved on third reading, upon motion of Councilor Piano.
2. Draft Resolution No. 2007 – R-54 - “A Resolution Converting Transcon Area As Multi-Purpose Complex”, sponsored by Councilor Edwin J. Piano was approved by majority decision.
Second Reading:
1. On motion of Councilor delos Reyes, Draft Resolution No. 2007 – R-57 – “A Resolution Ratifying The Memorandum Of Agreement Entered Into By And Between Philippine National Police Crime Laboratory (PNPCL) Represented By Police Chief Supt. Arturo G. Cacdac, Jr. And The City Government Of Olongapo Represented By City Mayor James Gordon, Jr.”, was deferred for further study.
2. Draft Resolution No. 2007 – R-58 – “A Resolution Authorizing The City Mayor To Enter Into A Memorandum Of Agreement With The Philippine Atmospheric, Geophysical And Astronomical Services Administration (PAGASA), Of The Department Of Science And Technology (DOST), Regarding The Community-Based Flood Management Program (CBFMP), was deferred on motion of Councilor Piano.
3. Draft Resolution No. 2007 – R-60 – A Resolution Authorizing The City Mayor James Gordon, Jr., To Enter Into Memorandum Of Agreement (MOA) For And In Behalf Of The City Health Department Of Olongapo With Global City Innovative College Subic International Incorporated (GCICSII) Represented By Corazon B. Guanco, Vice President For Administration”, was deferred on motion of Councilor Marzan.
4. On motion of Councilor delos Reyes, Draft Ordinance No. 2007 – O-23 – “An Ordinance Appropriating The Amount Of Two Million One Hundred Ninety Five Thousand Eight Hundred Seventy Six Pesos (PhP2,195,876.00) To Satisfy The Civil Liability Of Olongapo City To Dr. Reino Rosete In Civil Case No. 188-0-88 Entitled Dr. Reino Rosete Vs. Former City Mayor Richard Gordon Et. Al.,” was deferred pending the receipt of the Certificate of Availability of Funds.
5. On motion of Councilor Perez, Draft Resolution No. 2007 – R-61 – “A Resolution Extending Sincerest Gratitude To The Altruistic And Profound Contribution Of Mr. Ronaldo P. Tiotuico, Director Of The Department Of Tourism (DOT) Region III In The Tourism Awareness Seminar And Strategic Planning Held Last August 30, 2007”, was unanimously approved on its second and final reading.
6. Draft Resolution No. 2007 – R-62 – “A Resolution Proffering Earnest Requital To The Distinct And Unselfish Contribution Of Mr. Leonilo C. Agustin, Tourism Consultant Of Subic Bay Metropolitan Authority (SBMA), In The Tourism Awareness Seminar And Strategic Planning Held Last August 30, 2007”, was approved unanimously on second and final reading on motion of Councilor Perez.
7. On motion of Councilor Piano, Draft Resolution No. 2007 – R-63 – “A Resolution Approving The Annual Budget Of Barangay New Asinan, City Of Olongapo For The Calendar Year 2007”, was unanimously approved on second and final reading.
8. Draft Resolution No. 2007 – R-53 - “A Resolution Adopting Gordon College, Board Of Trustees (BOT) Resolution Nos. 27,28,29,30 & 31 Series Of 2007”. Before moving for the main motion, Councilor Marzan moved to exclude Res. No. 27 to give way to the observation of Councilor Aquino to make an ordinance creating a special fund for Gordon College. Since many observations need further study, on motion of Councilor Marzan, the said resolution was deferred.
9. On motion of Councilor Piano, Draft Ordinance No. 2007 – O-22 – “An Ordinance Repealing Ordinance No. 81, Series Of 2002 And Providing For The Olongapo City 2007 Revenue Code”, was deferred.
10. Draft Ordinance No. 2007 – O-19 – “An Ordinance Providing For Annual Physical And Dental Check-Up Of Olongapo City Government Employees”, was deferred on motion of Councilor Edwin J. Piano.
11. Draft Resolution No. 2007 – R-51 – “A Resolution Authorizing The City Mayor James Gordon, Jr. To Enter Into Memorandum Of Agreement With BSP-James L. Gordon Council Represented By Dr. Ligaya B. Monato, For The Use Of A Parcel Of Land Located At The South-West End Of Tapinac Elementary School, For James L. Gordon Council-BSP Headquarters”, was deferred on motion of Councilor Edwin J. Piano.
Other Matters
A. On motion of Councilor Piano, “A Resolution Expressing Deep Condolences To The Bereaved Family Of Mr. Ruperto B. Gatpo, Purok Leader Of Barangay Sta. Rita, This City”, was considered as an urgent matter and was approved unanimously on its second and final reading. (Sponsored Unanimously)
B. On motion of Councilor Marzan, Draft Ordinance No. 2007 – O-24 was considered an urgent matter.
For the discussion, the Councilor apprised the body that the P30 million fund originally intended for the payment of NPC Billings was proposed to be reverted to the unappropriated balance of the General Fund to finance the continuing rehabilitation and maintenance program of the PUD. Instead of doing an automatic reversion, the use of the PhP30 Million fund shall be taken from the unappropriated balance with the following breakdown: PhP10 Million for the Primary and Secondary Distribution Network; PhP7.5 Million for the Sub-Station Operation’s Control and Protection; PhP5 Million for the Revenue Metering Standardization; PhP3.5 Million for the Information System Management; and PhP4 Million for the Sub-transmission and Rehabilitation.
Councilor Marzan said that the details of the project proposal shall form an integral part of the Ordinance. She added that the Certification from the Local Finance Committee, a body empowered to assist the Sangguniang Panlungsod in the analysis and review of the annual and regular supplemental budgets to determine compliance and administrative requirements, shall also form an integral part of the Ordinance, adopted entoto, since, according to her, it is the basis for the reversion and appropriation of fund.
Councilor Marzan also read for the record the recommendations of the Local Finance Committee which pertains to the letter request of Engr. Louie Lopez, PUD General Manager, regarding their justification for their proposed funding of the Electric Power Distribution System Rehabilitation Maintenance Program. One of the justifications is the increasing maintenance costs and the regulatory compliance requirements of the EPIRA Law and of the ERC. Second, Engr. Lopez attested that with its implementation, the system’s improvement will eventually generate the amount reverted with a fair return of investment.
The Local Finance Committee recommended the endorsement of the said proposal to the Sangguniang Panlungsod for the enactment of an appropriate ordinance. In addition, the Committee recommended that PUD initiate proper or legal actions, such as power rates, re-structure applications, reformat of ERC policies and/or private sector participation, in order to solve the technical and financial determination of the power system.
Councilor Marzan then moved for the passage of the said Ordinance. For the comments and observations, Councilor Lipumano-Garcia asked the proponent if they could get the funding from the IRA. Councilor Marzan explained that the IRA is allocated for the city’s social projects, hospital and other needs, while the budget for the payment of NPC Billing is already included in the PUD budget. Thus, instead of using the IRA to finance PUD programs, the proposal suggests that it will come directly from the PUD budget.
Councilor Lipumano-Garcia made a follow up comment that the proposed measure may mean an addition to the PUD debt. In response, Councilor Marzan affirmed the observation of Councilor Lipumano-Garcia and explained that the body will have to decide on whether to put the PUD program on hold due to lack of funding at the moment or do as recommended.
Councilor Perez queried about the return of investment. She added that her concern is on the rehabilitation of PUD’s internal system like the addition of meter readers since the city only has 20 meter readers at present with 42,000 meters to read and also the responsible and prompt payment of bills especially by government offices, officials and employees. Councilor Marzan suggested that Engr. Lopez is in the best position to give light on the matter and answer the queries.
Councilor delos Reyes mentioned to put on record his opinion regarding the above matter. He commented that the PUD problem is part of the systemic problem of the city government. Thus, as the Chairman of the Committee on Public Utilities, Councilor delos Reyes said that he will draft a comprehensive committee report concerning all PUD issues that needs to be addressed. He enjoined his fellow Councilor to help in making the draft.
While awaiting the arrival of Engr. Lopez, the Presiding Officer suggested that a powerpoint presentation by the PUD Department to the Sangguniang Panlungsod body must be done.
Councilor Perez asked the proponent to defer the matter pending the request for a comprehensive presentation by the PUD.
