RESOLUTION NO. 07
(Series of 2008)

A RESOLUTION REQUESTING THE HON. BARANGAY CHAIRMEN OF OLONGAPO CITY TO ABATE PILFERAGE AND THEFT OF ELECTRIC POWER BY REPORTING ALL ILLEGAL CONNECTIONS AND TAPPINGS WITHIN THEIR BARANGAYS


WHEREAS, it states in Sec. 389 b.(1) of the Local Government Code: FOR EFFICIENT, EFFECTIVE AND ECONOMICAL GOVERNANCE, THE PURPOSE OF WHICH IS THE GENERAL WELFARE OF THE BARANGAY AND ITS INHABITANTS PURSUANT TO SEC 16 OF THIS CODE, THE PUNONG BARANGAY SHALL:

1. Enforce All Laws And Ordinances Which Are Applicable Within The Barangay;
2. Maintain Public Order In The Barangay And, In Pursuance Thereof, Assist The City Mayor And The Sanggunian Members In The Performance Of Their Duties And Functions;
3. Ensure The Delivery Of Basic Services As Mandated Under Sec 17 Of This Code;

WHEREAS, the ANTI-ELECTRICITY AND ELECTRIC TRANSMISSION LINES/MATERIALS PILFERAGE ACT of 1994 or Republic Act 7832 otherwise known as An Act Penalizing the Pilferage of Electricity and Theft of Electric Power Transmission Lines/Materials, Rationalizing System Losses by Phasing out Pilferage Losses as a Component Thereof, and for Other Purposes provides the following:

1. Illegal Use of Electricity – It is hereby declared unlawful for any person, whether natural or juridical, public or private, to:

(a) Tap, make or cause to be made any connection with overhead lines, service drops, or other electric service wires without previous authority or consent of the private electric utility or rural electric cooperative concerned;

(b) Tap, or cause to be made any connection to the existing electric service facilities of any duly registered consumer without the latter’s or the electric utility’s consent or authority;

(c) Tamper, install or use a tampered electrical meter, jumper which interferes with the proper or accurate metering of electrical current; and

(d) Knowingly use or receive the direct benefit of electric service obtained through any of the acts mentioned in subsections a, b, c above.

WHEREAS, there is rampant and unabated theft and pilferage of electricity and electrical materials all over Olongapo City which remain unreported;

WHEREAS, the Public Utilities Department is mired in a huge debt and needs serious rehabilitation;

WHEREAS, as the basic political unit which serves as the primary planning and implementing unit of government policies, plans, programs, projects, and activities in the community, the city government urges all barangays to assist in the rehabilitation of the Public Utilities Department by reporting the illegalities connected with electricity and electric transmission lines/materials theft and pilferage;

NOW, THEREFORE, on motion of Councilor John Carlos G. delos Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests, the Hon. Barangay Chairmen of Olongapo City to Abate Pilferage and Theft of Electric Power by Reporting Illegal Connections and Tappings within their Barangays.
