RESOLUTION NO. 11

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER, EXECUTE AND SIGN A MEMORANDUM OF AGREEMENT WITH VICTORIA TRADING, THE WINNING BIDDER FOR THE BULLDOZER RENTAL TO BE UTILIZED FOR THE INTERIM RISK MITIGATING MEASURES FOR THE EXISTING LANDFILL IN A MANNER CONSISTENT WITH LAW

WHEREAS, the city is presently undertaking measures to mitigate the risks posed by the garbage piles stored at the currently existing landfill in Old Cabalan with its component activities inclusive of bulldozer to shore up waste materials as part of the maintenance operations thereat;

WHEREAS, as per General Services Office (GSO), a bidding process was undertaken last year under the supervision of the Commission on Audit, where the emerging winning bidder after due evaluation was Victoria Trading ;

WHEREAS, in the lease of bulldozers, the lessor shall be the one obliged to maintain the fuel, oil, lubricants, mobilization and demobilization costs and for the maintenance of the equipment in good operating condition subject to compensation computed from the actual date of operation and leasing;

NOW, THEREFORE, on motion of City Councilor Eyrma Yvette Marzan - Estrella with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to enter, execute and sign a Memorandum of Agreement with Victoria Trading, the winning bidder for the bulldozer rental to be utilized for the interim risk mitigating measures for the existing landfill in a manner consistent with law.
