RESOLUTION NO. 136
(Series of 2006)

A RESOLUTION ENJOINING BARANGAYS TO SUBMIT THEIR BARANGAY RESOLUTIONS, ORDINANCES AND EXECUTIVE ORDERS TO THE SANGGUNIANG PANLUNGSOD OF OLONGAPO FOR THE REVIEW OF THE SAME AS MANDATED BY SECTION 57 OF THE LOCAL GOVERNMENT CODE AND SECTION 458, SUBSECTION (a) (l) (i),

WHEREAS, the Local Government Code under Section 458 (a) (1) states that, the Sangguniang Panlungsod approve ordinances and pass resolutions necessary for an efficient and effective city government, and in this connection shall : (i) Review all ordinances approved by the sangguniang barangay and executive orders issued by the punong barangay to determine whether these are within the scope of the prescribed powers of the sanggunian and of the punong barangay;

WHEREAS, Section 57 of the same code states that (a) Within ten (10) days after its, enactment, the sangguniang barangay shall furnish copies of all barangay ordinances to the sangguniang panlungsod or sangguniang bayan concerned for review as to whether the ordinance is consistent with law and city or municipal ordinances. (b) If the sangguniang panlungsod or sanguniang bayan, as the case may be, fails to take action on barangay ordinances within thirty (30) days from receipt thereof, the same shall be deemed approved. (c) If the sangguniang panlungsod or sangguniang bayan, as the case may be, finds the barangay ordinances inconsistent with law or city or municipal ordinances, the sanggunian concerned shall, within thirty (30) days from receipt thereof, return the same with its comments and recommendations to the sangguniang barangay

concerned for adjustment, amendment, or modification; in which case, the effectivity of the barangay ordinance is suspended until such time as the revision called for is effected.

WHEREAS, also under Section 58, any attempt to enforce any ordinance or any resolution approving the local development plan and public investment program, after the disapproval thereof, shall be sufficient ground for the suspension or dismissal of the official or employee concerned;

WHEREAS, it was observed that most if not all barangay sanggunians do not comply with such provisions under the Code for quite a long of time. Evaluation and assessment conducted on such showed that there are some ordinances, resolutions and executive orders at the barangay level that had adversely affected the community as a whole or had been a bad precedent since they were not in consonance with the plans and programs of the City;

WHEREAS, review of ordinances, resolutions and executive orders by the Members of the Sangguniang Panlungsod is necessary to effective legislation to ensure that barangay laws are not contrary but complementary to City ordinances enhancing intra-governmental relationships and coordination between the City government and its component barangays;

WHEREAS, the move also endeavors to identify and commend barangay legislators whose leadership through such contributions, in this case barangay legislation is noteworthy;

WHEREAS, such contributions through barangay legislation could be officially appreciated and imparted or emulated by other barangays through the initiative of the Sangguniang Panlungsod tasked to review the same;

NOW, THEREFORE, on motion of Councilor John Carlos G. Delos Reyes with the unanimous accord of Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enjoin, as it hereby enjoins barangays to submit their barangay resolutions, ordinances and executive orders to the Sangguniang Panlungsod of Olongapo for the review of the same as mandated by Section 57 of the Local Government Code and Section 458, subsection (a) (l) (i),

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be furnished all barangays of the City for their information and guidance.
