A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO SIGN AND ENTER INTO A MEMORANDUM OF AGREEMENT BETWEEN THE OLONGAPO CITY GOVERNMENT AND THE DEPARTMENT OF HEALTH REPRESENTED BY DR. RIO L. MAGPANTAY, DIRECTOR IV, CENTER FOR HEALTH DEVELOPMENT REGION 3, REGARDING THE ENDOWMENT OF GRANT AMOUNTING TO THREE HUNDRED TEN THOUSAND FOUR HUNDRED FIFTY TWO PESOS AND EIGHTY CENTAVOS (PHP310,452.80) IN ACCORDANCE WITH REPUBLIC ACT NO. 9401 OTHERWISE KNOWN
AS THE GENERAL APPROPRIATIONS ACT OF 2007

WHEREAS, as reiterated in the 2005-2010 National Objectives for Health, the Philippines has committed to reduce maternal and child mortality by at least half, by the year 2010;

WHEREAS, Item III, Section C.2.j of Republic Act No. 9401, otherwise known as the General Appropriations Act (GAA) of 2007, appropriates funds for artificial family planning and mandates the Department of Health (DOH) to allocate such funds to LGUs for the purchase of reproductive health commodities and the conduct of family planning seminars in local communities, as specified by Special Provision No. 12 of the DOH Budget in the same GAA;

WHEREAS, the President Gloria Macapagal-Arroyo’s Veto Message on the 2007 GAA dated March 22, 2007, required the conditional implementation of Special Provision No. 12 subject to the issuance of guidelines so that the DOH may determine its priority programs, possess the necessary flexibility in choosing the appropriate methods based on the need of the community and transfer the funds to other government agencies and LGUs pursuant to the intent of the GAA;

WHEREAS, as a result of the performance assessment conducted by the DOH, Olongapo City is entitled to Three Hundred Ten Thousand Four Hundred Fifty Two Pesos and Eighty Centavos (PhP310,452.80) with an initial release in the amount of Two Hundred Sixty Three Thousand Eight Hundred Eighty Four Pesos and Ninety Centavos (PhP263,884.90) as grant proceeds from the DOH, subject to the conditions set forth in the corresponding guidelines;

NOW, THEREFORE, on motion of Councilor Aquilino Y. Cortez, Jr., with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the Honorable City Mayor James Gordon, Jr. to sign and enter into a Memorandum of Agreement between the Olongapo City Government and the Department of Health represented by Dr. Rio L. Magpantay, Director IV, Center for Health Development Region 3, regarding the endowment of grant amounting to Three Hundred Ten Thousand Four Hundred Fifty Two Pesos and Eighty Centavos (PhP310,452.80) in accordance with Republic Act No. 9401 otherwise known as the General Appropriations Act of 2007.
