RESOLUTION NO. 76
(Series of 2009)

A RESOLUTION AUTHORIZING THE CITY MAYOR TO RESCIND THE MEMORANDUM OF AGREEMENT BETWEEN TCR TECHNOLOGY ADVANCEMENT SYSTEM, THE CITY OF OLONGAPO AND THE OLONGAPO CITY POLICE DISTRICT OFFICE DATED JANUARY 12, 2006

WHEREAS, a Memorandum of Agreement (MOA) was entered into by TCR Technology Advancement System (TCR), the City of Olongapo and the Olongapo City District Police Office (OCPO) on January 12, 2006 to facilitate the development of an automated system designed to put in place a computerized Police Clearance Program in line with the goal of increasing efficiency in the delivery of honest, affordable and effective public services management system;

WHEREAS, however, reports show that there have been incidents of over-charging of fees or rigging of Police Clearance fees and delays in the release of Police Clearances;

WHEREAS, same reports record that, among others, the cost of electric consumption by TCR Technology has not been fully-settled and TCR's obligation to train PNP personnel were not implemented, in breach of its legal obligation;

WHEREAS, moreover, TCR failed to apply and secure a business permit, a requirement for all business entities operating in Olongapo City;

WHEREAS, the public have expressed disgust over the way police clearances are being transacted;

WHEREAS, both the general public and the Olongapo City District Police Office have moved for the rescission of the MOA given that it has become prejudicial to public interest, contrary to what it was originally envisioned to achieve;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled To Authorize The City Mayor To Rescind the Memorandum Of Agreement Between TCR Technology Advancement System, The City Of Olongapo and The Olongapo City Police District Office Dated January 12, 2006 in a manner in accordance with law.

RESOLVED FURTHER, AS IT HEREBY FURTHER RESOLVED, that copy of this resolution be furnished to TCR Technology Advancement System (TCR) and the Olongapo City District Police Office (OCDPO).
