RESOLUTION NO. 55

(Series of 2014)

A RESOLUTION LIFTING THE GOVERNMENT RESERVED STATUS OF THE PROPERTY LOCATED  AT 14^TH  STREET,  EAST TAPINAC, OLONGAPO CITY

 OWNED  BY DR. GERALDINE D. SAN GABRIEL

            WHEREAS,  Dr. Geraldine D. San Gabriel is the true and absolute owner of a parcel of residential land located at 14^th Street,  East Tapinac, Olongapo City which is particularly described as follows:

                        “A parcel of residential land containing an area of Five Hundred Fifteen (515 sq. m) Square Meters more or less bounded on the Northeast by Lot 3959 TS-308; on the Southeast by road: and on the North west by Lot 3961 TS-308 declared for taxation purposes in her name (Dr. Geraldine D. San Gabriel) under T.D. No. AB00303230”

            Copy of the Declaration of Real Property Value-Land is hereto attached as Annex “A” and made an integral part of this Resolution.

            WHEREAS, the said property has been registered in the name of Dr. Geraldine D. San Gabriel under Torrens Title as evidenced by Transfer Certificate of Title No. T-14781 which is hereto attached as Annex “B”;

WHEREAS, taxes on the property has been duly settled by the owner as of December 17, 2013 as shown by Official Receipt No. 0329874 attached  herewith as Annex “C”;

            WHEREAS, the opposition filed by the City of Olongapo has long been dismissed and the decision has become final and executory, copies of the Decision of Department of Environment and Natural Resources through the Office of the Secretary dated May 14, 2004 and Order dated August 16, 2001 issued by Department of Environment and Natural Resources Region III, San Fernando, Pampanga are hereto attached as Annexes “D” and “D-1” respectively;

            WHEREAS, the owner has applied for the issuance of building permit for the construction of three (3) story residential building on the said place however, the same was denied for reason of government reserved status;

            NOW,  THEREFORE, on motion of City Councilor Noel Y. Atienza, with the majority decision of the Members of the Sangguniang Panlungsod  present,

            RESOLVED, AS IT IS HEREBY RESOLVED,   by the Sangguniang Panlungsod in session assembled, to lift as it hereby lifts the government reserved status of the property located at 14^th Street, East Tapinac, Olongapo City owned by Dr. Geraldine D. San Gabriel.

            Let a copy of the foregoing resolution be furnished to Dr. Geraldine D. San Gabriel, #50-14^th Street, East Tapinac, Olongapo City.
