The City Vice-Mayor and Presiding Officer Cynthia G. Cajudo called the session to order at 4:40 in the afternoon.

Reading and Adoption of Minutes

On motion of Councilor Marey Beth D. Marzan the members of the previous administration present adopted the minutes of the previous Regular Session held last June 20, 2007. The newly elected members of the council were asked to abstain from voting.

Communications Read:

1. Copy of a letter from Atty. Noel Y. Atienza addressed to Mr. Ferdie M. Magrata, Administrator of James L. Gordon Memorial Hospital, relative to the case of Reylito Ileto, admitted on July 14, 2006 for medical treatment arising from injuries sustained as a result of vehicular accident.

Atty. Atienza wrote that the patient was ready for discharge but was not allowed to leave due to non-payment of hospital bills. He added that the company, which owns the vehicle involved, already undertook the expenses during the victim’s confinement at James L. Gordon Memorial Hospital. 2. Letter from Ms. Rexy G. Cruz, Executive Regulator, Subic Water Regulatory Board, to Mr. Samuel Matias, TUBIG Leader in connection with his letter dated June 25, 2007 requesting for a copy of several documents to be used as reference in a possible opposition paper to Subicwater’s petition. (Referred to the Committee on Public Utilities. Copies were provided to all Members)

3. Copy of letter from Councilor John Carlos G. delos Reyes to Hon. Alberto G. Romulo, Secretary of the Department of Foreign Affaris (DFA) regarding the request of Mr. Charan Jit, an Indian National with a permanent residence certificate issued, asking assistance to obtain a visa for his daughter, Nechal Deepkaur Bhopal. 11. Letter from Angelito M. Soriano, a Subicwater consumer, addressed to Ms. Resurreccion G. Cruz, Executive Regulator of the Subic Bay Water Regulatory Board, formally submitting his position to the so-called Subicwater Public Hearing on June 14 and 28, 2007 at the Rizal Triangle, regarding the 12.5% tariff increase. 12. Letter from Samuel L. Matias, Chairman of TUBIG CO (Coalition of Different groups/sectors of Olongapo City), addressed to Mr. Antonio de Vera, Chairman of Subic Water Regulatory Board, Subic Bay Freeport Zone. Mr. Matias wrote that they have joined hands with the other groups from different sectors of the community and manifested that the public hearing conducted were unethical, biased and favors the Subicwater. 13. Letter from the City Mayor to the City Council Members requesting to consider as ordinance appropriating an additional amount of Thirty Nine Thousand Five Hundred Pesos (PhOP39,500.00) to the Item Other Machineries and Equipment under Capital Outlay of Olongapo City Convention Center, to be taken from the Special Account – Olongapo City Convention Center under the General Fund. (Referred to the Committee on Appropriations)

14. Invitation from Felicidad Basa Mercado for her 75th Diamond Birthday Celebration on July 14, 2007, Saturday, at the Olongapo City Convention Center. (Everyone was enjoined to attend)

15. Writ of Executions of Gerry R. Gruspe, Clerk of Court V, Regional Trial Court, Third Judicial Region, Branch 72, Olongapo City, on Civil Case No. 188-0-88 about Dr. Reino Rosete, petitioner vs City Mayor Richard J. Gordon, et al, respondents. This order the respondents to pay the back salaries, emoluments, etc., including the increases in the amount of Two Million One Hundred Ninety Five Thousand Eight Hundred Seventy Six Pesos only (PhP2,195,876.00), subject to the existing policies/guidelines of the Department of Budget and Management. (Referred to the Committee on Laws. Clarified if the Mayor’s Office and Legal Office were given copies)

16. Letter from Barangay Captain Jimmy B. Pasag of Barangay Pag-asa for the body submitting a copy of the signed Memorandum of Agreement and a copy of the diagram showing the exact location of the operation regarding the mini-fair. (Referred to the Committee on Business and Committee on Barangay Affairs)

17. Memorandum from Renato Lorena, Motorpool Mechanic to Santiago L. Columbrites, Acting Barangay Captain of New Cabalan regarding his inspection of the Barangay Patrol Van. (For information)

18. Notice of Power Interruption on July 12, 2007 from 10:00 A.M. – 11:00 A.M. with the list of affected areas. The cause of power interruption is the clearing of trees that touches the 69KV Transmission lines of Mercurio. (For information)

Committee Reports

Councilor Gina G. Perez reported several items under her committee. First item was that the draft proposal regarding the Olongapo City Investment Code was submitted for study to the Executive Department through the offices of Business Permit, Treasury, Accounting, Budget, CPDO, DILG and to the offices of City Councilors Gie Baloy, Jong Cortez and JC delos Reyes. She informed that the said proposal shall aim at the following: the promulgation of specific investment policies on attracting investors to establish income generating businesses which will bring employment and revenues for the city, the creation of the Olongapo City Investment Board that will spearhead formulation of policies and facilitate enactment of the code; and the founding of the Olongapo City Investment Center that will serve as the Technical Secretariat of the Board. Written comments and suggestions regarding the said draft was requested to be submitted on or before July 13, 2007 and the Councilor also informed the body that a meeting to improve the said legislative proposal was scheduled on July 19, 2007 at 1:00 p.m.

The second item reported was regarding to the Olongapo City Tourism Council. Councilor Perez apprised the body that a meeting with the officers of the Olongapo City Tourism Council was held on July 16, 2007 at 11:00 a.m. The following agenda was discussed:

1. The Mutya ng Pilipinas Coronation Night. This national beauty pageant was successfully held at the Olongapo City Convention Center which generated a net income of Php80,000.00 and promoted the Convention Center at the same time. The Executive Department shall decide whether the generated income will go to the City Fiesta fund.

2. Subik-Subik Festival of the Greater Subic Tourism Bureau will be scheduled on November, a week before the Advertising Congress.

3. Transportation and Traffic concerns at the Ramon Magsaysay Drive and Rizal Avenue were discussed with Councilor JC delos Reyes.

4. Proposed series of meetings and seminars for the tourism industry were opened-up for suggestions.

5. The immediate implementation of the Culture of Tourism Programs as provided in Section 12 of the Olongapo City Tourism code known as the “Culture of Excellence”. This will be made possible through an Executive Order by the City Mayor which shall form a committee to create the seminar module.

The third item reported by Councilor Perez was the plan for an Olongapo City Tourism Website as a promotional tool for its tourism industry. The possibility of partnership with students or schools with the technical know-how on website designing was considered. The Councilor added that Columban College expressed their interest and an arrangement with them is presently underway.

The fourth item was about the inspection and accreditation of all tourism establishments, as provided under Article V of the Olongapo City Tourism Code, which states that “establishments shall be classified, accredited and registered”. This is to ensure maintenance of cleanliness. Establishments scheduled for the month of July are Gigolo Super Disco, Club Syzuka, Subic Hardrock, Sam’s Pizza, Jax Comedy Bar, Mozziko’s Bar, Brew’s Bistro, Brad’s Music Bar, Willi’s Concert Bar, Rico’s Diner, Arby’s Lugawan and Ginumis Snakhauz.

The fifth and sixth items were about the meeting with SUBRA and Barretto Beach Boulevard Association on July 18, to discuss matters concerning the annual celebration of Sibit-Sibit Festival. It was contemplated then to assign the event to the said business groups, and the arrangement with Olongapo Business Club for the conduct of the annual Ulo ng Apo Festival or Mardigras.

Other topics for further discussion were the status of Tourism Information Center in Driftwood Beach at Barretto; the complaint letter of Mr. Robert Laing against Harley’s Hotel; the Barangay Tourism meeting on July 25; the World Tourism Day activities and other City Tourism activities.

Calendar of Business

Second Reading:

1. Prior to the motion for the approval of Draft Resolution No. 2007-R-07, Councilor John Carlos G. delos Reyes first explained the reason for the said resolution. Though the issue on Breastmilk Substitutes and Powdered Milk TV commercials and Print Ads may be considered non-significant by some, he considers the matter important because it affects the government program promoting breast-feeding. He said that he thinks breast-feeding is the most economical and also the cheapest way to ensure health of both the infant and mother, and a way to combat poverty. The government imports a lot of breast milk substitutes. Advertisements somehow brainwashed the people thus, the need to re-orient. The Councilor requested his colleagues to support the Milk Code of the Philippines passed in 1986 pursuant to the International Code of Marketing Breast Milk Substitutes. The global prescription is for babies to be exclusively breastfeed at least within the first six months. There were overwhelming evidences which showed that appropriate infant and child feeding is the key to eradicate child malnutrition, and at the same time, contribute to reduction of child morbidity and mortality. The bottom line is to prioritize breast-feeding.

Furthermore, Councilor delos Reyes said that he intends to make series of ordinances and resolutions regarding the matter so that it will be started in the City of Olongapo through the Council’s effort. He said it can make a big impact on the fight against urban poverty.

So, on motion of Councilor John Carlos G. delos Reyes Draft Resolution No. 2007-R-07 – “A Resolution Urging The City Health Office Headed By Dr. Arnildo C. Tamayo And James L. Gordon Memorial Hospital Headed By Dr. Arturo E. Mendoza To Embark On An Aggressive And Sustainable Campaign To Promote Breast-Feeding As A Means To Combat Urban Poverty In The City” was approved unanimously on second reading.

2. Draft Resolution No. 2007 – R-08 – “A Resolution Authorizing The Experimental Re-Routing Of Public Utility Jeepneys Particularly PUJ-J-10 (Tabacuhan Yellow With Blue) And PUJ-J-04 (Mabayuan Green)” was deferred on motion of Councilor John Carlos G. delos Reyes for further study.

3. Draft Resolution No. 2007 – R-09 – “A Resolution Ratifying The Memorandum Of Agreement Between The City Government Of Olongapo Represented By The City Mayor James Gordon, Jr. And Philippine Forest Corporation Represented By Its President Noel I. Lozada, Jr.” was deferred on motion of Councilor John Carlos G. delos Reyes for further study.

4. Draft Resolution No. 2007 – R-10 – “A Resolution Approving The Unified Land Information System Project Design Document And Endorsing To The Innovation Support Fund (ISF) For Final Approval The Said Project Design Document”, was deferred on motion of Councilor Edwin J. Piano while awaiting for the indorsement of the City Mayor.

5. Draft Resolution No. 2007 – R-11 – “A Resolution Authorizing The City Mayor James Gordon, Jr. To Enter Into A Memorandum Of Agreement For And In Behalf Of The City Government Of Olongapo And Department Of Public Works And Highways Represented By Marcelina N. Ocampo Asst. Regional Director For Maintenance Operations” was deferred on motion of Councilor John Carlos G. delos Reyes and he proposed that it be tackled by Councilor Anselmo Aquino, which the latter accepted.

6. Draft Ordinance No. 2007 – O-01 - An Ordinance Appropriating The Amount Fourteen Million Pesos (Php14,000,000.00) As The City’s Counterpart Fund For The Olongapo City Unified Land Information System Project was deferred on motion of Councilor Edwin J. Piano while awaiting for the indorsement of the City Mayor.

Other Matters

A. Prior to the motion for urgency regarding Draft Resolution No. 2007 – R-12, Councilor Gina G. Perez explained that a previous resolution was passed authorizing the City Mayor to enter into a MOA with SBMA represented by Mr. Raul Marcelo, the DA for Tourism Services. It was also ratified. However a letter from SBMA was received informing that Mr. Marcelo cannot enter into a MOA in his position as a consultant at that time. The funds for Sibit-Sibit was not processed , instead, another resolution was requested to change the MOA, this time to be signed by Mr. Arman Arreza, to supersede the last resolution.

Thus, Draft Resolution No. 2007-R-12 – “A Resolution Authorizing The City Mayor James Gordon Jr. To Enter Into A Memorandum Of Understanding (MOU) For And In Behalf Of The City Government Of Olongapo And Subic Bay Metropolitan Authority (SBMA), Represented By Its Administrator And CEO Mr. Armand Arreza For The Sibit Sibit Festival” was considered as urgent matter, and on motion of Councilor Gina G. Perez, it was approved unanimously on first, second and final reading.

B. Councilor Elmo Aquino mentioned for the record that he would like Councilor John Carlos G. delos Reyes to co-sponsor Draft Resolution No. 2007-R-11 deferred earlier.

C. Draft Resolution No. 2007 – R-15 – “A Resolution Electing The Chairmen, Vice-Chairmen And Members Of The 2007-2010 Standing Committees” was considered as an urgent matter, reviewed further by the Council Members and on motion of Councilor Edwin J. Piano, it was approved unanimously on its first, second and final reading.

D. The Presiding Officer referred the reading of the Quasi-Judicial divisions created to Councilor Edwin J. Piano.

Councilor Piano mentioned that as agreed, there are four divisions which will conduct necessary investigations with regard to Complaints and Investigations.

The First Division will be composed of Councilors Gina G. Perez, John Carlos G. delos Reyes and Rodel Cerezo. The Presiding Officer clarified that each division can elect their chairman.

The Second Division: Councilors Marey Beth D. Marzan, Lugie Lipumano-Garcia and Gie Baloy.

The Third Division: Councilors Edwin J. Piano, Jong Cortez and Elmo Aquino.

The Fourth Division: Councilors Ellen Dabu, Carlito A. Baloy and Robine Rose Buenafe.

Councilor John Carlos delos Reyes suggested that these division assignments can be included in the House Rules under the Administrative Proceedings but there’s a need to amend the said part of the House Rules.

The Presiding Officer said that since there was no motion to adopt it as yet, this will just be for the information and guidance of everyone.

There being no further matters to be discussed, the session was adjourned at 6:48 p.m. upon the motion of Councilor Anselmo A. Aquino.
