A RESOLUTION URGING THE SENATE FOR THE SWIFT PASSAGE OF SENATE BILL 2407 ENTITLED “AN ACT PROHIBITING AND PENALIZING THE PILFERAGE AND THEFT, UNAUTHORIZED USE, INTERCONNECTION, OR RECEPTION OF ANY SIGNAL OR SERVICE OFFERED OVER A CABLE TELEVISION (CATV)
OR CABLE INTERNET SYSTEM AND/OR NETWORK OR THROUGH ANY UNAUTHORIZED INSTALLATION, ACCESS OR CONNECTION THERETO THROUGH THE USE OF CABLE OR OTHER EQUIPMENT, AND PRESCRIBING PENALTIES THEREFORE, AND FOR OTHER PURPOSES”
WHEREAS, it is stated in the explanatory note of Senate Bill 2407 that the operation of the cable TV industry is a vital technological development that has significantly helped in the fast and effective delivery of information, entertainment and other communication services to the Filipino People;
WHEREAS, the cable TV industry is presently facing serious problems such as signal theft and illegal connection. As of June 2005, the number of illegal cable subscribers was estimated at 835,000 which increased by 28 percent from 650,000 in the year 2004;
WHEREAS, on the other hand, legitimate subscribers decreased by 15 percent from 880,000 in 2004 to 750,000 in June 2005;
WHEREAS, as a result the cable TV industry has suffered huge losses in terms of lost profits and higher programming costs. In 2004 the industry reportedly lost of PhP3.92 Billion almost 55 percent of which or PhP2.13 Billion was foregone revenue of the government in terms of taxes, import duties and licensing fees. In 2005 these industry losses already increased to PhP5 Billion;

WHEREAS, the said Senate Bill shall declare certain acts harmful to the industry within the prohibited acts and sanctions are provided therefore;
WHEREAS, the swift passage of the bill shall protect the cable TV industry from the stated prohibited acts to prevent further losses on their industry and attaining their basic purpose as information dissemination instrumentality;
NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of Sangguniang Panlungsod present;
RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges the Senate for the swift passage of Senate Bill 2407 entitled “An Act Prohibiting And Penalizing The Pilferage And Theft, Unauthorized Use, Interconnection, Or Reception Of Any Signal Or Service Offered Over A Cable Television (CATV) Or Cable Internet System And/Or Network Or Through Any Unauthorized Installation, Access Or Connection Thereto Through The Use Of Cable Or Other Equipment, And Prescribing Penalties Therefor, And For Other Purposes”
Let copies of this Resolution be furnished to the Office of Senator Juan Ponce Enrile, House of Representatives and Office of the President.
