WHEREAS, the subject right-of-way at Upper Nieves Street, Brgy. Mabayuan was initially brought to the City Government’s attention last October 2004;

WHEREAS, there is another access from Rodriguez Street but the said stairway is sloping/inclined and is unsafe for the residents especially to the children and elderly to traverse particularly during emergency situation;

WHEREAS, various meetings were held with the concerned parties thru the Barangay for the past two years and it was only on January 24, 2006 that the concerned residents/beneficiaries and the lot owner, the Sps. Romeo and Adelaida Porneso agreed to settle the problem wherein the beneficiaries already gave the initial amount of Php10,000.00 to the lot owner as their share in the total amount of Php40,000.00;

WHEREAS, according to the residents they cannot provide the whole amount to the Sps. Porneso thus, they are asking for financial assistance from the City Government to settle the remaining amount of Php30,000.00 to fully pay the agreed amount of Php40,000.00 to the lot owner for the said right of way;

WHEREAS, the said right-of-way/access must be kept open for public use especially in cases of emergency;

NOW, THEREFORE, on motion of Councilor Marey Beth D. Marzan and co-sponsored by Councilor John Carlos G. delos Reyes, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 68
(Series of 2007)

AN ORDINANCE APPROVING THE PROVISION OF FINANCIAL ASSISTANCE TO THE CONCERNED RESIDENTS OF UPPER NIEVES ST., BRGY. MABAYUAN AMOUNTING TO PHP30,000.00 FOR THE FULL PAYMENT OF THE RIGHT-OF-WAY TO THE LOT OWNER, SPS. ROMEO & ADELAIDA PORNESO

SECTION 1. Financial assistance amounting to Thirty Thousand Pesos is hereby provided as full payment for the right-of-way to the lot owner, Sps. Romeo and Adelaida Porneso and the same shall be charged and made available from the account Donations, under the 2008 Budget of the Office of the City Mayor

SECTION 2. This ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. This Ordinance shall take effect upon its approval.
