WHEREAS, the thrust of the administration of our incumbent local chief executive is based on transparency and good governance;

            WHEREAS, the City of Olongapo through the Office of  the Sangguniang Panglungsod has passed several local legislations dealing with the rates of garbage fees, to wit:

Ordinance No. 04, Series of 1989 entitled: “An Ordinance Fixing The Fees For The Collection Of Garbage In Residential Buildings Or Establishments.”

Ordinance No. 06, Series of 1997 entitled: “An Ordinance Amending Section 1 Of Ordinance No. 04, Series Of 1989 (RE: Garbage Fees For Residential Buildings)”

Ordinance No. 72,  Series of 2002 entitled: “An Ordinance Ratifying The New Schedule Of Fees Imposed By The Environmental And Sanitation Management Office.”

Ordinance No. 09, Series Of 2008 Entitled: “An Ordinance Prescribing The New Rate Of Garbage Collection Fees Imposed By The Environmental Sanitation And Management Office (ESMO)

WHEREAS, there is an urgent need to amend Ordinance No. 04, Series of 1989 entitled: “An Ordinance fixing the fees for the Collection of Garbage in Residential Buildings or Establishment:”

WHEREAS, the amendments pertain to the scrapping of Garbage Collection Fees for Residential Buildings or Establishments registered under the Pantawid Pamilyang Pilipino Program, listing is hereto attached as Attachment “A”. However the Garbage Collection Fees for Commercial Buildings or Establishment shall be retained and maintained;

            NOW, THEREFORE,  on motion of City Councilor Noel Y. Atienza, with the majority decision  of the Members of the Sangguniang Panlugnsod present,     

           

            RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

ORDINANCE NO. 18

(Series of 2014)

AN ORDINANCE AMENDING ORDINANCE NO. 04, SERIES OF 1998 ENTITLED: “AN ORDINANCE FIXING THE FEES FOR THE COLLECTION OF GARBAGE IN RESIDENTIAL BUILDINGS OR ESTABLISHMENTS” BY SCRAPPING THE GARBAGE COLLECTION FEES FOR RESIDENTIAL BUILDINGS OR ESTABLISHMENTS REGISTERED UNDER THE PANTAWID PAMILYANG PILIPINO PROGRAM

            BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBED, THAT:

SECTION 1.   This Ordinance amends the following:

Section 1.   There is hereby fixed  a monthly garbage collection fee for all residential building or establishments in area covered by the garbage collection rates under the following schedules:

a.     Single detached dwelling unit with a floor area of:

1.     100 square meters--------------------P20.00

2.     Less than 100 square meters--------P10.00

b.     Multiple dwelling/apartment style-----P10.00

c.     Accessorial or mixed use- the predominant use shall prevail and prescribed rates shall be applied.

To read as follows:

Section 1.  There is hereby fixed  a monthly garbage collection fee for all residential building or establishments in area covered by the garbage collection rates under the following schedules:

Except those listed under the Pantawid Pamilyang Pilipino Program issued by the City Social Welfare and Development Office, Olongapo City, which are exempt from payment of Garbage Collection Fees imposed by the Environment Sanitation and Management Office (ESMO).

            SECTION 2.  Separability Clause – Any Ordinance or part of it not consistent with the provisions of this Ordinance shall be considered amended.

            SECTION 3.  This Ordinance shall take effect upon its approval.
