WHEREAS, the Local Government Unit of Olongapo
City fully recognizes that quality, dignified and gainful employment empowers
its citizenry by allowing them to earn a living which improves not only their
lives but also the businesses they work for and the overall local economic
stability of the City;
WHEREAS, Olongapo City is a Highly Urbanized
City adjacent to the first and premier Freeport – the Subic Bay Freeport Zone,
and just a few minutes away from Clark Freeport Zone and the Freeport Area of
Bataan where employment is abundant and opportunities are boundless;
WHEREAS, many of economic engines recognize the
City of Olongapo as their lead choice for good business environment;
WHEREAS, these economic engines are in constant
need of workers, and the City offers a huge pool of qualified, ready, willing,
competent and highly-skilled workers;
WHEREAS, the abundance of available jobs are not
fully maximized by the local workforce;
WHEREAS, a big number of available positions
remain vacant or availed by other workers from nearby municipalities, provinces
and cities leaving our very own workers unemployed. Reasons includes primarily
the limited information available for both businesses and applicants;
WHEREAS, the establishment and implementation of
a scheme which will be known as the Priority
Employment Scheme for Qualified Olongapeños (PESQO)
will serve as a guideline to effectively prioritize our
local workforce specifically during the hiring process of existing and incoming
businesses is aptly needed;
WHEREAS, there is also a need to establish an
Employers and Workers System which will be known as the Olongapo City Labor Market Information Registry (OCLMIR) to serve as the
City’s updated database for a long
term, viable and ready source of updated employer and manpower information for
the City and for the three (3) surrounding Freeport Zones;
WHEREAS, PESQO and OCLMIR will serve as Olongapo
City’s main tool to provide both our employers and our workforce with updated
and reliable information as needed, and when needed and further boost the
City’s efforts to increase our local employment and eventually lead to a higher
standard of living of all Olongapeños and to fast track the City’s economic
development.;
NOW, THEREFORE, on motion of City Councilor
Edna A. Elane, with the unanimous accord of the Members of the Sangguniang Panlungsod
present;

by the Members Sangguniang Panlungsod in session assembled, to enact the
following Ordinance:

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION
ASSEMBLED, THAT:
ARTICLE 1
TITLE,
SCOPE AND DEFINITION OF TERMS
SECTION
1
Short Title
This
Ordinance shall also be known as the “OLONGAPO CITY LOCAL EMPLOYMENT
ORDINANCE.”
SECTION
2
Declaration of Policy
The
City Government of Olongapo strongly recognizes that quality, dignified and
gainful employment empowers its citizenry by allowing them to earn their living
which improves not only their lives but also the businesses they work for and
the overall local economic stability of the City.
The
City Government also believes that giving priority employment for its qualified
citizens shall provide a domino effect and shall further stimulate rapid
development for the local economy, thus, it shall seek to promote full
employment of workers by facilitating their placement through the creation of
the Priority Employment Scheme for Qualified
Olongapeños (PESQO) and the Olongapo
City Labor Market Information Registry (OCLMIR)
SECTION
3
Scope
This
Ordinance is applicable within the territorial jurisdiction of Olongapo City.
SECTION
4
Definition of Terms
The
following terms are hereby defined as used:
a) “City” – shall refer to the
Local Government of Olongapo City.
b)
“Qualified
Olongapeño” – can be any of the following:
1.
Born
in Olongapo City
2.
A
registered voter in Olongapo City
3.
Whose
parents are registered voters of Olongapo City
c) “PESO” – the Public Employment Services Office
of Olongapo City.
d) “BPLO” – the Business Permit
and Licensing Office of Olongapo City.
e) “CPDO” – the City Planning and
Development Office of Olongapo City.
f) “SRS Report” – Skills Registry
System Report is the Registry found at the PESO containing information relating
to workers in Olongapo City including, but not limited to: the name of the
worker, age, gender, residential address, other contact details, educational
background, employment history, skills, and other information as determined by
the PESO which may aid employers in determining their employability.
g) “LMI Report” – Labor Market
Information Report is the Registry found at the PESO containing information relating
to job placement made per industry and per occupation in Olongapo City: The
same report also includes a report on Job Vacancies Solicited by Occupation,
Sex, Age, Civil Status Group, Educational Attainment and Work Experiences.
h) “Workforce” – any individual
who resides in Olongapo City who is capable and willing to work under the law,
employed or unemployed;
i)
“Employer”
– an individual, partnership or corporation located within Olongapo City, which
engage workers to perform jobs for monetary consideration.
j)
“PESQO” – the short term for Priority
Employment Scheme for Qualified Olongapeños, a scheme which will be created by
virtue of this City Ordinance to provide proper guidelines for employers in
their hiring process.
k) “OCLMIR” – the short term for
Olongapo City Labor Market Information Registry. It is a hybrid system which
will be utilized both by the City, the Workers and the Employers for the
purpose of Skills Mapping, Job Vacancies Mapping & Future Development
Planning.
ARTICLE II
THE
PRIORITY EMPLOYMENT SCHEME FOR QUALIFIED OLONGAPEÑOS (PESQO)
SECTION
1
Formulation & Implementation of a
Priority Employment Scheme for Qualified Olongapeños
a.
The
PESO and BPLO shall work hand-in-hand in the formulation and implementation of
a scheme which shall be known as the Priority Employment Scheme for Qualified
Olongapeños. This is a scheme that will serve as a guideline to effectively
prioritize our local workforce specifically during the hiring process of
existing and incoming businesses which is aptly needed. A sample Employment
Guideline is herewith attached as Annex
A.
b.
Employers
shall be required to register with PESO for their Local Employment Clearance
upon registration of business establishment every Third Quarter of the
succeeding year, a few months before the renewal.
c. Employers shall be required to
strictly comply with the guidelines set forth in the PESQO. This shall be a
requirement for the release of their Local Employment Clearance which will
serve as a pre-requisite for the issuance of their business permit and annual
renewal for the succeeding and subsequent years.
ARTICLE III
THE
OLONGAPO CITY LABOR MARKET INFORMATION REGISTRY (OCLMIR)
SECTION
1
Establishment of an Employers &
Workers Registry System
a.
PESO
shall establish an Employers & Workers Registry System which will be known
as the OlongapoCity Labor Market Information Registry (OCLMIR) to serve as the City’s updated
database for a long term, viable and ready source of updated employer and
manpower information for the City and the three (3) contiguous Freeport Zones;
b.
OCLMIR
will be an improvement and hybrid of the current Labor Market Information (LMI)
report and Skills
Registry System (SRS) report
being submitted by PESO-Olongapo to DOLE on a monthly basis, Sample
copy is attached and marked as ANNEX B
and C.
c.
Companies
within Olongapo City shall submit to PESO a list of current employees with the
required information provided by this Ordinance. Upon the effectivity of this
ordinance the subject company shall submit the required information necessary
for the establishment of OCLMIR relating to their current employees and shall
provide updates as needed;
d.
Colleges,
universities, technical schools, vocational schools to PESO and other
educational institutions within Olongapo City, both public and private, shall
submit a list of their graduates within the required information provided by
this Ordinance. Upon the effectivity of this ordinance the said institutions
shall submit the required information necessary for the establishment of OCLMIR
relating to their graduates for the last four (4) years. They shall update the
same annually or as updates are available;
e.
PESO
shall conduct registration drives in every barangay of the City with the
assistance of the respective Barangay government officials;
f.
A
minimal fee shall be collected and paid to the City Treasury prior to the
release of information to cover the cost of printing, materials and information
acquired as embodied on the Olongapo City Revenue Code.
ARTICLE
IV
IMPLEMENTATION AND
ADMINISTRATION
SECTION 1
Administration
of PESQO
a. PESO is hereby placed in
charged as the main implementer and administrator of the Priority Employment
Scheme for Qualified Olongapeños.
b. PESO shall directly and
consistently coordinate with BPLO for full implementation.
SECTION 2
Administration
of OCLMIR
a.
PESO
is hereby placed in charged as the main implementer and administrator of the
Olongapo City Labor Market Information Registry.
b.
PESO
shall directly and consistently coordinate with BPLO for the full
implementation.
c.
PESO
shall regularly post an updated list of Job Vacancies for workers consumption.
d.
PESO
shall provide BPLO and CPDO with an updated LMI report on a quarterly basis or
as needed.
e.
PESO
shall provide full LMI information access to any individual or company for
private use, but, for the purpose of regulation, a request form shall be properly
filled-out and submitted to the Mayor’s Office bearing the name of requestor,
institution being represented, office address and purpose of request.
f.
To
protect the privacy of the workers and employers, access to OCLMIR shall be
granted only to legitimate employers, as determined by PESO, including the
extent of information to be released to the requestor.
g.
A
minimal fee shall be collected and paid to the City Treasury prior to the
release of information to cover the cost of printing, materials and information
acquired as embodied on the Olongapo City Revenue Code.
ARTICLE
V
PENAL PROVISIONS
SECTION
1
Penalties for Violation of Olongapo City
Employment Ordinance
Violation of any provision of this
ordinance shall be meted with a Penalty as follows:
FIRST
OFFENSE: Php 2, 500 Penalty, Non-issuance of Local Employment Clearance and Warning for suspension of Business permit
until all requirements are complied within the specified time frame.
SECOND
OFFENSE: Php 3, 500
Penalty, Non-issuance of Local Employment Clearance and Temporary
suspension of Business permit until all requirements are complied within the
specified time frame.
THIRD
OFFENSE: Php 5, 000
Penalty, Non-issuance of Local Employment Clearance and Suspension of
Business permit until all requirements are complied within the specified time
frame.
ARTICLE VI
FINAL
PROVISIONS
SECTION
1
Funding Requirement
For this purpose, the funding
requirements of the Public Employment Service Office as to the project’s
implementation and information shall be necessarily appropriated, subject to
the usual government accounting rules and regulations.
SECTION
2
Implementing Rules and Regulations
Requirement
The
PESO is hereby mandated to formulate the Implementing Rules and Regulations of
this Ordinance
SECTION
3
Separability Clause
If, for any reason or reasons, any part
or provisions of this Ordinance shall be held to be unconstitutional or
invalid, other parts or provisions hereof which are not affected thereby shall
continue to be in full force and effect
SECTION
4
Effectivity Clause
This Ordinance shall take effect after
fifteen days following the posting for two weeks and publication in at least
one (1) newspaper of general circulation.

PROVISIONS
SECTION
1
Funding Requirement
For this purpose, the funding
requirements of the Public Employment Service Office as to the project’s
implementation and information shall be necessarily appropriated, subject to
the usual government accounting rules and regulations.

Implementing Rules and Regulations
Requirement
The
PESO is hereby mandated to formulate the Implementing Rules and Regulations of
this Ordinance
SECTION
3
Separability Clause
If, for any reason or reasons, any part
or provisions of this Ordinance shall be held to be unconstitutional or
invalid, other parts or provisions hereof which are not affected thereby shall
continue to be in full force and effect
SECTION
4
Effectivity Clause
This Ordinance shall take effect after
fifteen days following the posting for two weeks and publication in at least
one (1) newspaper of general circulation.
