A RESOLUTION EXPRESSING PROFOUND SYMPATHY AND CONDOLENCES TO THE BEREAVED FAMILY OF SLAIN TRANSGENDER WOMAN JEFFREY “JENNIFER” LAUDE AND URGING THE NATIONAL GOVERNMENT TO ENSURE THAT PROMPT JUSTICE  WILL BE SERVED

WHEREAS, the Philippine Government enters into defense agreement with the United States of America through the Visiting Forces Agreement and the Enhance Defense Cooperation Agreement;

WHEREAS, with these agreements, US Military personnel were allowed to conduct activities or temporary stay in the Philippines to conduct mutual defense trainings such as Amphibious Landing Exercise or PHILBEX;

WHEREAS, US Navy Ships regularly conduct port visit in Subic Bay Freeport Zone, being the former US Naval Base for the rest and recreation (R & R) of their personnel, replenish their supplies, and repair of their ships;

WHEREAS, this year’s PHILBEX brings the USS Peleliu (LHA - 5) Expeditionary Strike Group to Subic Bay Freeport Zone for their R & R and, Olongapo City being the host city of the former US Naval Base, welcome the US servicemen hoping that their stay will provide additional boost to the economy of Olongapo;

WHEREAS, Olongapeños were shocked and deeply saddened by the tragic death of Filipino transgender woman Jeffrey “Jennifer” Laude allegedly by a suspected US serviceman;

WHEREAS, while we in Olongapo acknowledge the benefits of a Port of call of US Navy Ships in our local economy, we condemn this gruesome act against our fellow Filipino and we are united in demanding for the swift justice in the killing of Jennifer Laude;

WHEREAS, the National Government through the Visiting Forces Agreement Commission, Department of Foreign Affairs and Department of Justice have the jurisdictions in such cases we enjoin these government offices to act and seek swift justice for Jennifer before or within the one-year limit set forth in the VFA agreement;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express as it hereby expresses profound sympathy and condolences to the bereaved family of slain transgender Woman Jeffrey “Jennifer” Laude and urging the National Government to ensure that prompt justice will be served.

Let copy of this Resolution be furnished to the family of Jeffrey “Jennifer” Laude, Department of National Defense, Department of Foreign Affairs and the Department of Justice for their information and prompt action.

A RESOLUTION STRONGLY URGING ALL SCHOOL CANTEENS IN PUBLIC ELEMENTARY AND SECONDARY SCHOOLS IN OLONGAPO CITY TO ADHERE TO THE DEPARTMENT OF EDUCATION ORDER NO. 08, SERIES OF 2007 ALSO KNOWN AS THE REVISED IMPLEMENTING GUIDELINES ON THE OPERATION AND MANAGEMENT OF SCHOOL CANTEENS IN PUBLIC ELEMENTARY AND SECONDARY SCHOOLS

WHEREAS, malnutrition is an underrated challenge detrimental to the apposite development of a child’s health;

WHEREAS, the Department of Education issued on February 06, 2007 Order No. 08, Series of 2007 also known as the revised guidelines on the operation and management of school canteens in public elementary and secondary schools to facilitate the intensified implementation of its provisions;

WHEREAS, for its part, the City of Olongapo under the leadership of Honorable Mayor James Gordon, Jr. has been exerting various efforts in coordination with the City Health Office and City Nutrition Council to address the dietary concerns within its jurisdiction;

WHEREAS, the said order from the Department of Education substantiates the crucial role of proper nutrition in the advancement of education and, therefore, warrants utmost support;

NOW, THEREFORE, on motion of Councilor Angelito W. Baloy and co-sponsored by Councilor Jonathan G. Manalo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,


RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to strongly urge, as it hereby strongly urges all school canteens in public elementary and secondary schools in Olongapo City to adhere to the Department of Education Order No. 08, Series of 2007 also known as the revised guidelines on the operation and management of school canteens in public elementary and secondary schools.

A RESOLUTION URGING ALL OFFICES UNDER THE OLONGAPO CITY GOVERNMENT TO IMPLEMENT FORTHWITH REPUBLIC ACT NO. 9485 OTHERWISE KNOWN AS “AN ACT TO IMPROVE EFFICIENCY IN THE DELIVERY OF GOVERNMENT SERVICE TO THE PUBLIC BY REDUCING BUREAUCRATIC RED TAPE PREVENTING GRAFT AND CORRUPTION,AND PROVIDING PENALTIES THEREFOR”

WHEREAS, Article II, Section 27 of the 1987 Constitution of the Republic of the Philippines pronounces, “The state shall maintain honesty and integrity in the public service, and take positive and effective measures against graft and corruption”;

WHEREAS, The 1987 Constitution of the Republic of the Philippines created the Civil Service Commission, as the central personnel agency of the Government, that shall initiate measures to promote the morale, efficiency, integrity, responsiveness and courtesy in the civil service;

WHEREAS, On June 2, 2007 President Gloria Macapagal Arroyo signed into law Republic Act 9485 otherwise known as “An Act to Improve Efficiency in the Delivery of Government Service to the Public by Reducing Bureaucratic Red Tape Preventing Graft and Corruption, and Providing Penalties Therefor”;

WHEREAS, RA 9485 or the Anti Red Tape Act of 2007 was passed in response to the pressing necessity to establish an effective system that will eliminate bureaucratic red tape, avert graft and corrupt practices and improve efficiency of delivering government frontline service;

WHEREAS, the City Government of Olongapo is in its continuous fight for excellence to ensure maximum delivery of service to its constituency, as its reason for existence;

WHEREAS, the present administration, expresses its extreme desire to improve the existing system of procedures, to eliminate unnecessary steps in delivering services to its people and to launch an efficient program that will result into a harmonious relationship with the local populace;

NOW, THEREFORE, with unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to urge, as it hereby urges all offices under the Olongapo City Government to implement forthwith Republic Act No. 9485 otherwise known as “An Act to Improve Efficiency in the Delivery of Government Service to the Public by Reducing Bureaucratic Red Tape Preventing Graft and Corruption, and Providing Penalties Therefor.”

LET COPIES of this Resolution and RA 9485 with its Implementing Rules and Regulations be distributed to all government offices and agencies located in the territorial jurisdiction of Olongapo City for their information and guidance.

A RESOLUTION URGING LOCAL GOVERNMENT UNITS (LGUs) TO CALL FOR ADVOCACY TO UPLIFT WOMEN’S RIGHTS AND DIGNITY AND PASS THE ANTI-PROSTITUTION ORDINANCE

WHEREAS, prostitution is generally defined as performing, offering, or agreeing to perform a sexual act for any money, property, token, object, article, or anything of value;
WHEREAS, the City Government of Olongapo is deeply concerned about the fact that prostitution and trafficking are flourishing in all societies worldwide and that increasing numbers of women and children are being made into sexual instruments for men's pleasure;
WHEREAS, it is stated in the Republic Act 9208, to institute policies to eliminate trafficking in persons especially women and children, establishing the necessary institutional mechanisms for the protection and support of trafficked persons, providing penalties for its violations, and for other purposes;

WHEREAS, the City Government of Olongapo is urging its neighboring Local Government Units to join in the advocacy to uplift women’s rights and dignity by passing the Anti-Prostitution Ordinance;

WHEREAS, it is a known fact that the economic state of some cities is strikingly commendable due to prostitution, but what is disconcerting to know is that the economic state is doing well for the wrong cause;

WHEREAS, Prostitution targets the tourism image, disposition of the constituents and primarily the health and well-being of the oppressed;

WHEREAS, the City is COMMITTED to eliminate this disconcerting issue and promote clean tourism to all;

WHEREAS, it is a fact that prostitution is a worldwide economic crisis and is not easy to eliminate, that is why the City of Olongapo is appealing to its contiguous and other LGUs to unite and help eliminate this so-called crisis;

WHEREAS, the City Government calls upon Local Government Units to combat prostitution and trafficking by formulating measures which penalize not only the traffickers and pimps but also the men who buy women performing sexual acts;

WHEREAS, it is advised that this resolution needs instantaneous response and action for all;
NOW, THEREFORE, on motion of Councilor Gina G. Perez co-sponsored by Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges all Local Government Units (LGUs) to call for advocacy to uplift women’s rights and dignity and pass the Anti-Prostitution Ordinance.

A RESOLUTION URGING THE BARANGAY COUNCILS OF DIFFERENT BARANGAYS IN OLONGAPO CITY TO ALLOCATE FUNDS FROM THEIR BUDGETS SOLELY FOR THE IMPLEMENTATION OF LIVELIHOOD PROGRAMS

WHEREAS, the City recognizes the power of livelihood programs and business opportunities together in pump-priming the flow of economic wealth in the City;

WHEREAS, the integration of livelihood and business implemented at the barangay level will not only uplift the economic condition of financially-marginalized Olongapo residents but will energize the spirit of cooperation within the barangay;

WHEREAS, the allocation of funds from the barangay budget solely for this purpose is deemed to be complementary to the efforts of the City in equipping the barangay units arm their people with livelihood skill, entrepreneurial spirit and self-reliance;

WHEREAS, by virtue of Ordinance No. 50, Series of 2005, the City established the City Livelihood and Cooperative Office and had approved recently the creation of a cooperative development council to assist the executive branch in bringing this thrust down to the barangay level, to support and provide services towards the wider opportunities of livelihood development, an endeavor the barangay should not miss;

NOW, THEREFORE, on motion of Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present :

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges the Barangay Councils of different barangays in Olongapo City to allocate funds from their budgets solely for the implementation of livelihood programs.


RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution be furnished all Barangay Chairmen for their action.

A RESOLUTION URGING THE BARANGAY COUNCIL OF DIFFERENT BARANGAYS IN OLONGAPO CITY TO ESTABLISH A FREE COMPUTER TRAINING PROGRAM IN THEIR RESPECTIVE BARANGAY

WHEREAS, recognizing the need and importance of Modern Technology in the development of the youth into productive society that will give a chance to the youth to up-grade this skills in computer especially those youth who are indigent who cannot afford to pursue their studies in college;

WHEREAS, every youth must be provided with essential foundations that will develop him as a versatile and productive young citizen with good future through computer technology;

WHEREAS, this program will help the indigent youth to alleviate their needs in Computer Technology which will help them to compete globally and given a change to seek jobs;

WHEREAS, this program will help the indigent youth to prepare since computer literacy is very much in demand in the dynamic labor force;

WHEREAS, the projection of our youth in their respective barangay who will undergo this training are in line with the computerization trends because most jobs these days requires computer literacy even to the minimum ability an applicant can manifest;

NOW, THEREFORE, on motion of Councilor Rodel S. Cerezo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it is hereby urges the Barangay Council of different Barangays in Olongapo City to establish a Free Computer Training Program in their respective Barangay.


RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, to furnish copies of this Resolution to the Barangay Captains and Barangay Kagawad for their information and appropriate action.

A RESOLUTION URGING THE CITY HEALTH OFFICE HEADED BY DR. ARNILDO C. TAMAYO AND JAMES L. GORDON MEMORIAL HOSPITAL HEADED BY DR. ARTURO E. MENDOZA TO EMBARK ON AN AGGRESSIVE AND SUSTAINABLE CAMPAIGN TO PROMOTE BREAST-FEEDING AS A MEANS TO COMBAT URBAN POVERTY IN THE CITY

WHEREAS, no less than the Philippine Constitution provides that the State shall promote and protect the right to health of the people and instill health consciousness among them;

WHEREAS, Executive Order No. 51 otherwise known as the Milk Code is a statute enacted in pursuance to the aforesaid Constitutional Mandate and in adopting an International law entitled the International Code of Marketing Breastmilk substitutes the aim of which is to promote breast-feeding and ensure the proper use of breastmilk substitutes;

WHEREAS, the World Health Organization (WHO) and the United Nations Children's Fund (UNICEF) have for many years emphasized the importance of maintaining the practice of breast-feeding - and of reviving the practice where it is in decline;

WHEREAS, under the Code, Art. 5, there should be no advertising or other form of promotion to the general public of products within the scope of the code, manufacturers and distributors should not provide directly or indirectly, to pregnant women, mothers or members of their families, samples of their products;

WHEREAS, under Art. 6 of the Code, health authorities in member-states should take appropriate measures to encourage and protect breast-feeding and promote the principles of the Code; no health care facility should be used for the purpose of promoting infant formula or other products;

WHEREAS, there are rampant violations of the said Code and the Philippine Milk Code by International firms which aggressively advertise and sell milk formulas, effectively ‘brainwashing’ the populace that imported infant formula is at par or even better than breast milk;

WHEREAS, infant formula should not be promoted in ways that would destroy or interfere with the task of protecting and promoting breast milk, which is free, natural, and healthy, as against imported, expensive formula or powdered milk;

WHEREAS, breast-feeding is the most effective means to secure the most ideal health and development of infants; that it forms a unique biological and emotional base for the health of both mother and child, that the anti-infective properties of breast milk help to protect infants against disease, and that the result of breast feeding is effective child spacing that contributes to legitimate and moral population management methods;

WHEREAS, there is a need to widen the information campaign to encourage breast-feeding practices as Olongapo City must strive to ensure the health and safety of its inhabitants by adopting a clear and attainable policy direction in pursuance of the objectives of the Code and the law;

WHEREAS, the end result or objective of this resolution is to promote breast-feeding such that it would become a major component, especially at the grassroots level, in the city government’s fight against poverty;

NOW, THEREFORE, on motion of Councilor John Carlos G. delos Reyes, with the unanimous accord of the Member of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to urge, as it hereby urges the City Health Office Headed by Dr. Arnildo C. Tamayo and James L. Gordon Memorial Hospital Headed by Dr. Arturo E. Mendoza to embark on an Aggressive And Sustainable Campaign to Promote Breast-Feeding as a means to Combat Urban Poverty in the city.

A RESOLUTION URGING THE HOTEL INDUSTRY TO MONITOR TOURIST ARRIVALS EVERY MONTH AND SUBMIT A QUARTERLY REPORT TO THE CITY TOURISM & PROMOTIONS DEPARTMENT (TPD)

WHEREAS, the City Government of Olongapo envisions to utilize its natural and heritage resources to foster the development of tourism in the City as a viable sector of the local economy in a manner which completes the scale, quality and unique features of the community;
WHEREAS, the Tourism and Promotions Department shall be the primary sector assigned with the responsibility to encourage, promote, and develop tourism as a major socio-economic activity to generate foreign currency and employment and to spread the benefits of tourism to both the private and public sectors in the City;
WHEREAS, tourism is a significant part of the local economy which undoubtedly creates employment and business opportunities in all aspects;

WHEREAS, the City is gearing towards more tourism-oriented programs and preparing for more ways to implement activities for growth and development;

WHEREAS, various local government units have long established mechanisms to monitor tourist arrivals and use the collected data in determining better and more efficient programs for their respective areas;

WHEREAS, tourists statistics are indeed useful and can be used as a basis for countless plans and programs, which can be realized in the City Government of Olongapo, in its aspiration for a booming tourism industry;

A RESOLUTION URGING THE SENATE FOR THE SWIFT PASSAGE OF SENATE BILL 2407 ENTITLED “AN ACT PROHIBITING AND PENALIZING THE PILFERAGE AND THEFT, UNAUTHORIZED USE, INTERCONNECTION, OR RECEPTION OF ANY SIGNAL OR SERVICE OFFERED OVER A CABLE TELEVISION (CATV)
OR CABLE INTERNET SYSTEM AND/OR NETWORK OR THROUGH ANY UNAUTHORIZED INSTALLATION, ACCESS OR CONNECTION THERETO THROUGH THE USE OF CABLE OR OTHER EQUIPMENT, AND PRESCRIBING PENALTIES THEREFORE, AND FOR OTHER PURPOSES”


WHEREAS, it is stated in the explanatory note of Senate Bill 2407 that the operation of the cable TV industry is a vital technological development that has significantly helped in the fast and effective delivery of information, entertainment and other communication services to the Filipino People;

WHEREAS, the cable TV industry is presently facing serious problems such as signal theft and illegal connection. As of June 2005, the number of illegal cable subscribers was estimated at 835,000 which increased by 28 percent from 650,000 in the year 2004;

WHEREAS, on the other hand, legitimate subscribers decreased by 15 percent from 880,000 in 2004 to 750,000 in June 2005;

WHEREAS, as a result the cable TV industry has suffered huge losses in terms of lost profits and higher programming costs. In 2004 the industry reportedly lost of PhP3.92 Billion almost 55 percent of which or PhP2.13 Billion was foregone revenue of the government in terms of taxes, import duties and licensing fees. In 2005 these industry losses already increased to PhP5 Billion;

WHEREAS, the said Senate Bill shall declare certain acts harmful to the industry within the prohibited acts and sanctions are provided therefore;

WHEREAS, the swift passage of the bill shall protect the cable TV industry from the stated prohibited acts to prevent further losses on their industry and attaining their basic purpose as information dissemination instrumentality;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges the Senate for the swift passage of Senate Bill 2407 entitled “An Act Prohibiting And Penalizing The Pilferage And Theft, Unauthorized Use, Interconnection, Or Reception Of Any Signal Or Service Offered Over A Cable Television (CATV) Or Cable Internet System And/Or Network Or Through Any Unauthorized Installation, Access Or Connection Thereto Through The Use Of Cable Or Other Equipment, And Prescribing Penalties Therefor, And For Other Purposes”

Let copies of this Resolution be furnished to the Office of Senator Juan Ponce Enrile, House of Representatives and Office of the President.
