RESOLUTION NO. 151
(Series of 2014)

A RESOLUTION STRONGLY INDORSING TO THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS THE PROPOSAL FOR THE RECLASSIFICATION OF RIZAL AVENUE EXTENSION (FROM UNITY  ROTONDA TO SBFZ BANICAIN GATE), MAGSAYSAY DRIVE EXTENSION (MT. APO ST.,TO SBFZ BANICAIN GATE) AND 14TH STREET (RIZAL AVENUE TO SBFZ 14TH GATE) AS NATIONAL ROAD

WHEREAS, the first road classification system in the country was established through Republic Act No. 917, known as the Philippine Highway Act, enacted in 1953 and Executive Order 113, Series of 1955 which classified roads into national roads (national primary and national secondary), “national aid” roads (roads of sufficient importance for eventual reclassification at a later state) and provincial/city/municipal/barangay roads;

WHEREAS, Executive Order No. 124, Series of 1987, stipulates that the Minister (now the Secretary) of the Ministry (now Department) of Public Works and Highways shall have the power to “Classify roads and highways into national, regional (interpreted as routes of primary arterial roads), provincial, city, municipal and barangay roads, based on objective criteria it shall adopt; provide or authorize conversion of roads and highways from one category to another”;

WHEREAS, Executive Order No. 113, also laid down the following additional criteria for classification of National Roads and criteria for re-classification from local roads to National Roads:

1.      National Roads shall have a right-of-way of not less than 20 meters, provided that a right-of-way of at least 60 meters shall be reserved for roads constructed through untitled public land.

2.      For re-classification of local roads, Executive Order No. 113 implies that proof of acquisition of the required road right-of-way shall be provided to the Department  (such as Deed of Donation of Sale duly notarized and indicating the lot number and area acquired, and Real Property Tax Declaration Number and/or Certification from the concerned Provincial Registry of Deeds and/or DENR in case of forested  land).  

3.      The National Roads forming the secondary trunk-line system shall exclude “feeder roads”, defined as roads branching off the trunk-line system and not being in line with the provisions in the second paragraph on this page.

4.      Any local road proposed for conversion shall meet the original criteria for classification of national Roads as described in the second paragraph on this page.  This requires that a proposal shall be accompanied by:  (i) an endorsement by the Provincial and/or Municipal Board to the Secretary of Public Works and Communications (now the Department of Public Works and Highways (DPWH); and (ii) a location map indicating kilometre stations at the start and end of the passable road and its relation to other road networks in the area.

5.      The Secretary of the DPWH shall declare re-classification of local roads to National Roads (reinforced by EO No. 124).

WHEREAS,  on July 5, 2013, Engr. Hercules C. Manglicmot, District Engineer of Department of Public Works and Highways wrote Hon. Rolen C. Paulino, City Mayor, Olongapo City seeking for the approval of a Sangguniang Panlungsod resolution endorsing the proposal for reclassification as required by the Department;

WHEREAS, on July 7, 2014, Hon. Rolen C. Paulino, City Mayor, Olongapo City indorsed the proposal to the City Council for approval;

NOW, THEREFORE, on motion of City Councilor Noel Y. Atienza, with  the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to strongly endorse, as it hereby strongly endorses  to the Department of Public Works and Highways the proposal for the reclassification of Rizal Avenue Extension (From Unity Rotonda to SBFZ  Banicain Gate), Magsaysay Drive Extension (Mt. Apo St., to SBFZ Banicain Gate) and 14th Street (Rizal Avenue to SBFZ 14th Gate) as National Road.

Let a copy of the foregoing resolution be furnished the Department of Public Works and Highway for their record and perusal.

A  RESOLUTION  DECLARING  MR.  TOMMY  ABILLE  PERSONAE NON GRATA NEWS  ANCHOR  OF  “BIGWAS”  AIRED AT TV22 OWNED AND OPERATED BY SUBIC BROADCASTING CORPORATION (SBC) REGARDING HIS UTTERANCE OF DISRESPECTFUL WORDS AGAINST AETAS

WHEREAS, Mr. Tommy Abille is employed by the Subic Broadcasting Corporation as news broadcaster;

WHEREAS, as such, he was assigned to anchor a daily program entitled “Bigwas”  which has been on air on a daily basis over DWGO and TV22;

WHEREAS, on August 14, 2014 Mr. Tommy Abille in one of the episodes of his daily program called “Bigwas”,  he uttered disrespectful words against the Aetas to wit:

                        “Pare Johnny Reblando musta ka na?  Ikaw ba ay nakakatikim na rin ng EXOTIC”  Ako gustong gusto kong tumikim ng EXOTIC, pagkain ha hindi yung katulad ng kaibigan natin na nagsabi ng… “Pare gusto ko talaga tumikim ng EXOTIC, gusto kong tikman AETA”.

WHEREAS, such utterances of Mr. Tommy Abille has became viral in the social media showing their condemnation of the disrespectful statements;

WHEREAS, Article 20 (Culture and Traditional) Section 2 of the Broadcast Code states:

                        “The mores, culture, traditions and characteristics of people must be respected.  Maliciously ridiculing, denigrating or disparaging culture, customs and traditions are  prohibited.”
  
WHEREAS, Mr. Tommy Abille has no record of accreditation with the Kapisanan ng mga Broadkaster  ng Pilipinas which is a violation of Article 30 (Accreditation) of the Broadcast Code and for which the station may be held liable under the code’s penalty provision;

WHEREAS, on September 23, 2014, Mr. Orly L. Pangcog, Chairman, First Division Standard Authority Kapisanan ng  mga Broadkaster ng Pilipinas (KBP) formally denounced the utterances made by Mr. Tommy Abille as a clear violation of the Broadcast Code, copy of the said letter dated September 23, 2014 is hereto attached for your ready reference;

WHEREAS, several cause oriented groups have denounced the disrespectful utterances of Mr. Tommy Abille and sought the immediate action in order to seek justice for our indigenous people the AETAS;

NOW, THEREFORE, on motion of City Councilors Noel Y. Atienza, Aquilino Y. Cortez, Jr., Elena C. Dabu, Eduardo G. Guerrero, Benjamin G. Cajudo, II, Alreuela M. Bundang-Ortiz, Edna A. Elane, Emerito Linus D. Bacay, Randy C. Sionzon and Igmedio M. Gonzales, with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to declare as it hereby declares Mr. Tommy Abille personae non grata, news anchor of “Bigwas” aired at TV22 owned and operated by Subic Broadcasting Corporation (SBC) regarding his utterance of disrespectful words against the aetas.

Let a copy of this resolution be furnished to all Olongapo residents, business establishment, government offices, Kapisanan ng  mga Broadkaster ng Pilipinas, TV22, Subic Broadcasting Corporation, Subic Bay Metropolitan Authority, Olongapo City and SBMA Media Press Corps and Mr. Tommy Abille.

A RESOLUTION AMENDING SECTION 80 OF RESOLUTION NO. 55, SERIES OF 2013 OTHERWISE KNOWN AS  “A RESOLUTION ADOPTING THE REVISED INTERNAL RULES OF PROCEDURES FOR THE SANGGUNIANG PANLUNGSOD
CITY OF OLONGAPO”

WHEREAS, the dynamics of local governance need to be addressed under the vision of our local chief executive of “transparency and good governance”;

WHEREAS, in order to set the visions of transparency and good governance into realization, there is a need to segregate the Standing Committees of Sangguniang Panlungsod;

NOW, THEREFORE, on motion of City Councilor Noel Yabut Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to amend as it hereby amends Section 80 of  Resolution No. 55, Series of 2013 otherwise known as “A Resolution Adopting The Revised Internal Rules of Procedures for the Sangguniang Panlungsod  City of Olongapo,” to read as:

SECTION 80. Standing Committees – There shall be twenty-seven (27) Standing Committees consisting of a Chairman, Vice-Chairman and at least three (3) Members. The  Committees are constituted with their specified duties and powers  to wit:

1.      Committee on Finance and Appropriations –  This shall have general jurisdiction over all matters relating to the approval of the budget, monetary and fiscal matters, all matters relating to the funds for the expenditure of the City Government and for the payment of public indebtedness, claims against the government, and appropriation of public fund.

2.      Committee on Ways and Means – This shall have jurisdiction over all matters related to taxes, fees, charges, loans, study and revision of tax measures; and generation of other sources and forms of revenue form public and private sectors, including codification of revenue ordinance.

3.      Committee on Organizational Development and Personnel Matters - This shall have jurisdiction to determine the compensation of personnel, the creation and re-organization of local officers and shall oversee  the personnel development program.

4.      Committee on Laws, Complainants, Investigation and Human Rights Protection – This shall have general jurisdiction over all matters relating to penal ordinances, expropriations naming of streets and public places, legal orders from the court on City Ordinances; all matters relating to complain that are lodged with and undertaken by the Sanggunian; investigation of charges of misfeasance and malfeasance against local official and employees; and matters relating to the promotion and protection of human rights.

5.      Committee on Education  - This shall have jurisdiction over all matters relating to education, local schools, colleges and universities, libraries, non-formal and community adult education, scientific and technological research, development and advancement.

6.      Committee on Arts. Culture, Public Information and Media Affairs – This shall have jurisdiction over all matters relating to the city’s preservation of customs and traditions, mores and values as well as the enhancement of Olongapeños’ talent and abilities and shall be empowered to enact laws relative to public dissemination and media affairs.

7.      Committee on Health and Public Welfare – This shall have jurisdiction over all matters relating to the health and welfare of the residents, including proposals pertaining to sanitation, cemeteries, hospitals, health centers and other health and sanitary measures.

8.      Committee on Utilities, Telecommunication and Information Technology (IT) - This shall have jurisdiction over all matters relating to utilities including the power system, and the water system and shall have general jurisdiction over all matters relating to:  1) telecommunications such as land/microwave/satellite based telephone including cellular phone system, radio and television broadcasting, including cable TV, and general telephony; and 2) information communications technology (ICT) including internet, e-business and e-governance. Shall oversee  advances in ICT and ensure that  the City’s computerization program complements effective governance.

9.      Committee on Engineering and Public Works  - This shall have general jurisdiction over all matters relating to planning, construction, maintenance, improvements and repair of public building, highways, bridges, roads, parks, shrines, monuments, playground, and other public edifices, drainage, sewerage, flood control and protection, building permits and other public improvement projects.

10.   Committee on Peace & Order – This shall have jurisdiction over all matters relating to police work and service, drug prevention; maintenance of public order and security and prevention of crimes in coordination with the Philippine National Police and other protective agencies and organizations of the national government.

11.   Committee on Public Safety -  This shall have jurisdiction with disaster preparedness program of the local government unit and other allied activities.

12.   Committee on Transportation and Franchise -  This shall have the  jurisdiction over all public transport operating within the city (sea, land and air) This shall have jurisdiction over all matters relating to the issuance of franchise to all public transport within the City;

13.   Committee on Traffic Management. This shall have jurisdiction over all matters relating to traffic management.

14.   Committee on Ethics, House, Rules and Privileges-  This shall have jurisdiction over all matters relating to the Sangguniang Rules of Procedures, Order of Business, Certification of Ordinance, implementation of local ordinances and conduct, rights, privileges, safety, dignity, integrity and reputation of the Sangguniang and its members;

15.   Committee on Public Markets – This shall have jurisdiction over all matters relating to public market and their maintenance and allied project.

16.   Committee on Business, Economic Enterprise and Public-Private Partnership and Tourism- This shall have general jurisdiction over all matters relating to the establishment, operation and maintenance, and regulation of all business establishment within the City; enhancement of entrepreneurial services and undertakings, provision of incentives to investors and shall have jurisdiction over all economic enterprises being run and maintained by the city, except the markets. This shall have general jurisdiction over all matters relating to the development and promotion of tourism in the City.

17.   Committee on Labor and Manpower Development – This shall have jurisdiction over all matters relating to protection of labor and provision of ameliorative service,  shall spearhead employment generation and vocational, technical and skill development program.

18.   Committee on Environment Protection, Urban Planning, Lands, Housing and Zoning – This shall have jurisdiction over all mattes relating to environmental protection, land use and re-classification, housing, zoning and allied matters.

19.   Committee on Women, Family and Gender Equality ­ - This shall have jurisdiction over all matters relating to the promotion and protection of the rights, opportunities and welfare of women, strengthening and developing of family life and the promotion of gender equality.

20.   Committee on Livelihood and Cooperatives  - This shall have jurisdiction over all matters relating to livelihood programs in the City, organization and supervision of local cooperatives.

21.   Committee on Social Services -  This shall have jurisdiction over all matters related to social welfare and ameliorative services; public social services for the disadvantaged  groups in the Philippine society including disabled and street children.

22.   Committee on Agriculture and Fisheries -  This shall have jurisdiction over all matters related to agriculture and fisheries, agricultural and aquatic economic research; soil and water survey and conversation, agricultural and fishing education.

23.   Committee on Barangay Affairs and Community Development -  This shall have general supervision over all matters pertaining to supervision by the City Government over the barangays and the undertaking of community projects at the Barangay level.

24.   Committee on Youth -  This shall have jurisdiction over all matters pertainind to the youth; the promotion of the youth’s moral, physical, intellectual and social well being.

25.   Committee on Sports Development -  This shall have jurisdiction over all matters relating to the development of sports and sportsmanship in the community.

26.   Committee on Senior Citizens and Veteran’s Affairs -  This shall have jurisdiction over all matters relating to the promotion  of the rights, opportunities and welfare of the elderly, and relating to Veteran’s Affairs.

27.   Committee on Wildlife, Parks, and Playgrounds -  This shall have jurisdiction over all matters relating to the maintenance, operation ad regulations of wildlife, parks ad playgrounds.

A RESOLUTION EXTENDING OUR WARMEST CONGRATULATIONS TO ATTY. DEO AMOR DAVID FOR BEING ADJUDGED AS THE MOST OUTSTANDING CHAPTER PRESIDENT, CATEGORY B OF THE INTEGRATED BAR OF THE PHILIPPINES

WHEREAS, Atty. Deo Amor David is a native of Municipality of Castillejos, Province of Zambales and one of the promising legal practitioners not only within our sphere but goes beyond its border;

WHEREAS, he has been characterized by his legal brethren within the legal circle as a hardworking lawyer practicing with humility. Inevitably, this trademark did not escape the eyes of his fellow brothers in profession, thus on February 2009 he was elected as the Chapter President of the Integrated Bar of the Philippines Olongapo-Zambales Chapter;

WHEREAS, immediately upon assumption into office, Atty. Deo Amor David introduced several innovations in his chapter, reliving camaraderie and fellowship among legal circle with its regular “Kapihan sa IBP” through constant communications with trial judges, prosecutors and court officials and employees for the efficient and effective administration of justice, assignment of IBP Legal Aid Lawyers in every branch of the courts, conducting regular legal aid clinic, distribution of school supplies and relief goods to indigent families and holding regular sport programs;

WHEREAS, his leadership has moved the IBP - Olongapo-Zambales Chapter to greater heights which gained strong and active participation by its members in all its activities and projects;

WHEREAS, at the helm of his governance as Chapter President of Integrated Bar of the Philippines Olongapo-Zambales Chapter, Atty. Deo Amor David was able to secure the right to host the 13th National Convention of Lawyers on April 7 to 10, 2011 to be held at Subic Bay Freeport Zone;

WHEREAS, the untiring efforts of Atty. Deo Amor David leading the chapter to broaden its horizon did not escape the attention of the awarding body of the Integrated Bar of the Philippines, National chapter for which reason, he was adjudged as an OUTSTANDING CHAPTER PRESIDENT Category B during the recently concluded 13th National Convention of Lawyers on April 7 to 10, 2011 at Subic Bay Freeport Zone.

NOW, THEREFORE, on motion of the City Councilor Noel Yabut Atienza, with the unanimous accord of Members of the Sanggunian Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by Sangguniang Panlungsod in session assembled, to extend, as it hereby extends our warmest congratulation to Atty. Deo Amor David for being adjudged as the Most Outstanding Chapter President, Category B of the Integrated Bar of the Philippines.

A RESOLUTION EXTENDING OUR WARMEST CONGRATULATIONS TO THE OFFICERS AND MEMBERS OF THE INTEGRATED BAR OF THE PHILIPPINES OLONGAPO-ZAMBALES CHAPTER FOR THE SUCCESSFUL HOSTING OF THE 13TH NATIONAL CONVENTION OF LAWYERS HELD LAST APRIL 27-10, 2011 AT THE SUBIC BAY EXHIBITION AND CONVENTION CENTER, SUBIC BAY FREEPORT ZONE

WHEREAS, the Integrated Bar of the Philippines Olongapo-Zambales Capter has been awarded the right to host the 13th National Convention of Lawyers on April 7 to 10, 2011;

WHEREAS, with strong determination and courage, the Integrated Bar of the Philippines Olongapo-Zambales Chapter has taken the challenge and organized one of the best ever conversations held in the history of Integrated Bar of the Philippines;

WHEREAS, with a limited resources, the Integrated Bar of the Philippines Olongapo-Zambales Chapter has tremendously worked overtime to come up with an organized and memorable convention to be held at the heart of economic bastion of the Philippines, Subic Bay Freeport Zone;

WHEREAS, true indeed, the IBP – Olongapo-Zambales Chapter through the hardwork and perseverance of its officers and members, garnered another milestone in its fold for having achieved in attendance, with no less than the Vice-President of the Philippines, Hon. Jejomar C. Binay who led the array of convention speakers who discussed about the integrity and credibility of a lawyer;

WHEREAS, the Integrated Bar of the Philippines Olongapo-Zambales Chapter in collaboration with its National Officers has come up with a complete 36 units of Mandatory Continuing Legal Education (MCLE) for the delegates covering accredited topics in laws and procedures with excellent line up of resource speakers;

WHEREAS, after the culmination of the four-day convention, delegates from all over the Philippines were delighted with benefits and happiness brought by the convention knowing fully well that their time and efforts in attending the said convention have added to their personal growth;

WHEREAS, by reason of the successful hosting of the 13th National Convention of Lawyer from April 07 to 10, 2011 by the Integrated Bar of the Philippines Olongapo-Zambales Chapter has a beneficial effect on the economic and tourism aspect not only with the Subic Bay Freeport Zone but likewise with the City of Olongapo;

NOW, THEREFORE on motion of City Councilor Noel Yabut Atienza, with the unanimous accord of the Members of the Sanggunian Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to extend, as it hereby extends our warmest Congratulations to the Officers and Members of the Integrated Bar of the Philippines Olongapo-Zambales Chapter for the successful hosting of the 13th National Convention Of Lawyers held last April 7 – 10, 2011 at the Subic Bay Exhibition And Convention Center, Subic Bay Freeport Zone.

A RESOLUTION INTERPOSING STRONG OBJECTION TO THE 9 PERCENT WATER TARIFF INCREASE GRANTED TO SUBICWATER INC. BY THE SUBIC BAY REGULATORY BOARD (SBWRB)

WHEREAS, the recent burden of water tariff increase being shouldered by our people has added to their economic miseries and woes;

WHEREAS, the Subicwater Inc. has imposed a 9% water tariff increase which was approved by the Subic Bay Water Regulatory Board on its consumers;

WHEREAS, water has become one of the necessities of the people which should be made accessible to them regardless of their status in life;

WHEREAS, for the past five years, the Subicwater has implemented series of water tariff increases which the people of Olongapo through the Sangguniang Panlungsod interposed their continuous objection on the same;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the majority decision of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to interpose, as it is hereby interposes strong objection to the 9 percent water tariff increase granted to Subicwater Inc by the Subic Bay Regulatory Board (SBWRB).

A RESOLUTION INVITING MS. AMETHYA DE LA LLANA, DEPARTMENT MANAGER OF ECOLOGY, SUBIC BAY METROPOLITAN AUTHORITY (SBMA) AND TEST CONSULTANTS, INC. TO CONDUCT A FORMAL BRIEFING BEFORE THE SANGGUNIANG PANLUNGSOD REGARDING THE STATUS OF THE PROPOSED 150 MW COAL-FIRED THERMAL POWER PLANT AT BARANGAY AGUSUHIN, SUBIC, ZAMBALES


WHEREAS, there is a proposed Coal-fired Power Plant to be established at the Redondo Peninsula.

WHEREAS, there is reason to believe that the operation of this Coal-fired Power Plant will affect Subic Bay and Olongapo City, as studies show that Coal-fired Plants are sources of mercury pollution detrimental to the health of the community;
WHEREAS, the combustion process of coal releases carbon dioxide and other greenhouse gases, causing climatic warming in the earth's atmosphere also, combustion of coal is a source of sulfur oxides and nitrogen oxides, which are harmful to humans and are mostly responsible for acid rain; WHEREAS, fly ash from Coal Plants is a major air pollutant which may cause adverse environmental effects as well as bottom ash and smoke stacks which may choke terrestrial wildlife and dirty up white sands;

WHEREAS, the heat from the Coal-fired Power Plant is feared to increase the temperature of the waters in the bay which could affect marine communities. Much of the remaining coral reefs in this part of the Bay may be lost;

WHEREAS, there is also the concern that the establishment of the plant will alter the scenic Redondo Peninsula which is a tourist attraction from the Olongapo side of the bay;

WHEREAS, under Sec. 26. of the local Government code, it shall be the duty of every national agency or government-owned or controlled corporation authorizing or involved in the planning and implementation of any project or program that may cause pollution, climatic change, depletion of non-renewable resources, loss of cropland, rangeland, or forest cover, and extinction of animal or plant species to consult with the local government units, nongovernmental organizations, and other sectors concerned and explain the goals and objectives of the project or program, its impact upon the people and the community in terms of environmental or ecological balance, and the measures that will be undertaken to prevent or minimize the adverse effects thereof;

WHEREAS, Olongapo City, together with other municipalities of Zambales and Bataan, is a major stakeholder in the development of Subic Bay and must be accorded its statutory right to mandatory consultations as such project may directly affect the immediate environment;

NOW, THEREFORE, on motion of Councilor John Carlos G. delos Reyes co-sponsored by Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to invite, as it is hereby invites Ms. Amethya de la LLana, Department Manager of Ecology, Subic Bay Metropolitan Authority (SBMA) and Test Consultants, Inc. to conduct a formal briefing before the Sangguniang Panlungsod regarding the status of the proposed 150 MW Coal-Fired Thermal Power Plant at Barangay Agusuhin, Subic, Zambales.

A RESOLUTION URGING THE SENATE FOR THE SWIFT PASSAGE OF SENATE BILL 2407 ENTITLED “AN ACT PROHIBITING AND PENALIZING THE PILFERAGE AND THEFT, UNAUTHORIZED USE, INTERCONNECTION, OR RECEPTION OF ANY SIGNAL OR SERVICE OFFERED OVER A CABLE TELEVISION (CATV)
OR CABLE INTERNET SYSTEM AND/OR NETWORK OR THROUGH ANY UNAUTHORIZED INSTALLATION, ACCESS OR CONNECTION THERETO THROUGH THE USE OF CABLE OR OTHER EQUIPMENT, AND PRESCRIBING PENALTIES THEREFORE, AND FOR OTHER PURPOSES”


WHEREAS, it is stated in the explanatory note of Senate Bill 2407 that the operation of the cable TV industry is a vital technological development that has significantly helped in the fast and effective delivery of information, entertainment and other communication services to the Filipino People;

WHEREAS, the cable TV industry is presently facing serious problems such as signal theft and illegal connection. As of June 2005, the number of illegal cable subscribers was estimated at 835,000 which increased by 28 percent from 650,000 in the year 2004;

WHEREAS, on the other hand, legitimate subscribers decreased by 15 percent from 880,000 in 2004 to 750,000 in June 2005;

WHEREAS, as a result the cable TV industry has suffered huge losses in terms of lost profits and higher programming costs. In 2004 the industry reportedly lost of PhP3.92 Billion almost 55 percent of which or PhP2.13 Billion was foregone revenue of the government in terms of taxes, import duties and licensing fees. In 2005 these industry losses already increased to PhP5 Billion;

WHEREAS, the said Senate Bill shall declare certain acts harmful to the industry within the prohibited acts and sanctions are provided therefore;

WHEREAS, the swift passage of the bill shall protect the cable TV industry from the stated prohibited acts to prevent further losses on their industry and attaining their basic purpose as information dissemination instrumentality;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges the Senate for the swift passage of Senate Bill 2407 entitled “An Act Prohibiting And Penalizing The Pilferage And Theft, Unauthorized Use, Interconnection, Or Reception Of Any Signal Or Service Offered Over A Cable Television (CATV) Or Cable Internet System And/Or Network Or Through Any Unauthorized Installation, Access Or Connection Thereto Through The Use Of Cable Or Other Equipment, And Prescribing Penalties Therefor, And For Other Purposes”

A RESOLUTION URGING THE COMMITTEE ON LAWS, COMPLAINTS AND INVESTIGATION AND COMMITTEE ON PERSONNEL DEVELOPMENT TO CONDUCT AN INVESTIGATION ON THE VERACITY OF THE EMPLOYMENT STATUS OF THE ATTACHED NAMES


WHEREAS, the Committee on laws, complaints and investigation shall have general jurisdiction over all matters relating penal ordinances, expropriations, naming of streets and public places, legal orders from the court on city ordinances, all matters relating to complaints that are lodged with and undertaken by the Sanggunian investigation of charges of misfeasance and malfeasance against local officials and employees and matters relating to the promotion and protection of human rights;

WHEREAS, the committee on Organizational Development and Personnel Matters shall have general jurisdiction to determine the compensation of personnel and the creation and reorganization of local offices and shall oversee the personnel development program;

WHEREAS, the above-mentioned standing committees of the Sangguniang Panlungsod of Olongapo should take the lead in verifying and determining the economy and efficiency of the status and functions of each and every government employee and their contribution to the city government of Olongapo;

WHEREAS, President Gloria Macapagal-Arroyo issued a directive to Secretary Ronaldo Puno, Department of the Interior and Local Government to ensure that local government units comply with all laws, rules and regulations in the hiring of their employees, including the prohibitions against hiring ghost employees and ordered to submit a report and recommendations to the Office of the President not later than December 30, 2006;

DOROPAN UNDER THE OFFICE OF THE CITY ADMINSTRATOR TO DISCLOSE THE NAMES OF ALL THE CONSULTANTS HIRED BY THE CITY GOVERNMENT INCLUDING THEIR RIGHTS, PRIVILEGES, DUTIES, FUNCTIONS AND NATURE OF THEIR TASKS OR SERVICES PURSUANT TO THE CONSTITUTIONAL POLICY OF TRANSPARENCY


WHEREAS, Section 28, Article II of the 1987 Constitution in relation to Section I, Rule IV of the Rules implementing the Code of Conduct and Ethical Standards for Public Officials and Employees states: “Subject to reasonable conditions prescribed by law, the State adopts and implements a policy of full public disclosure of all its transactions involving public interest.”;

WHEREAS, Section 7 of Article III of the 1987 Constitution, likewise, provides as follows: “The right of the people to information on matters of public concern shall be recognized. Access to official records and to documents and papers pertaining to official acts, transactions, or decisions as well to government research data used as basis for policy development, shall be afforded the citizen, subject to such limitations as may be provided by law.”;

WHEREAS, the exceptions provided in the said constitutional provisions pertain to confidential matters which affect the national security and defense of the country;

WHEREAS, all branches, departments and government enterprises should disclose the identity of the consultants in their employ, the nature of their work and their compensation and other privileges as well as the terms and conditions of their consultancy agreement;

WHEREAS, the disclosure of these pieces of information should automatically be informed the people through their duly authorized representatives and should be a part of the consultancy agreement;

WHEREAS, the public deserve to know if the services rendered by consultants employed by the City Government of Olongapo are commensurate to the compensation they receive from the city government;

WHEREAS, the public has the right to be apprised of who advise the government and what kind of advice they provide on certain issues;

NOW THEREFORE, on motion of Councilor Noel Yabut Atienza with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests the Office of the City Mayor through the Personnel Officer Leticia M.Doropan under the Office of the City Administrator to disclose the names of all the consultants hired by the City Government including their rights, privileges, duties, functions and nature of their tasks or services pursuant to the constitutional policy of transparency.
