A RESOLUTION ENJOINING ALL TELECOM SERVICE PROVIDERS IN OLONGAPO CITY, SUBIC BAY FREEPORT AND ZAMBALES TO IMMEDIATELY IMPLEMENT THE NATIONAL TELECOMMUNICATIONS COMMISSION MEMORANDUM CIRCULAR NO. 09-07-2007 OTHERWISE KNOWN AS THE INTERCONNECTION OF LOCAL EXCHANGE CARRIERS

WHEREAS, the State recognizes the vital role of telecommunications in nation-building and economic development and in its desire to attain universal access, it shall promote the rapid expansion of telecommunications service in all areas of the Philippines in order to maximize the use of all available telecommunications facilities, and to ensure that every user of the public telecommunications shall have access to such facilities at mandated standards of service and at reasonable costs;

WHEREAS, Section 2 Article II of MC 14-7-2000 defines Local Calling (Service) Areas as “the province within which telecommunications services are furnished subscribers under specific scheduled rates and without toll charges. For purposes of these rules, the present areas forming part of the numbering plan area shall be considered a local calling (service) area of all PTEs presently authorized to provide telecommunications service in any portion of the said area”;

WHEREAS, the National Telecommunications Commission issued Memorandum Circular No. 09-07-2007 defining the rules on the interconnection of local exchange carriers in local calling areas which would result to a more efficient service and lesser cost for the consumers;

WHEREAS, with multiple telecom service providers in our area, the Sanggunian is vouching for the immediate implementation of NTC Memorandum Circular No. 09-07-2007;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to enjoin, as it hereby enjoins, all telecom service providers in Olongapo City, Subic Bay Freeport and Zambales to immediately implement the National Telecommunications Commission Memorandum Circular No. 09-07-2007 otherwise known as the Interconnection of Local Exchange Carriers.

RESOLVED FURTHER, AS IT HEREBY FURTHER RESOLVED, that copies of this resolution be furnished to the National Telecommunications Commission, Globe Innove, PLDT, Digitel, Smart, Subictel, Subic Bay Metropolitan Authority, Subic Bay Chamber of Commerce, Olongapo Business Club, Zambales Provincial Board and Municipalities of Zambales for their appropriate action.

RESOLUTION NO. 29
(Series of 2009)

A RESOLUTION ENDORSING THE INTERCONNECTION OF TELECOMMUNICATIONS FACILITIES OF SUBIC-CLARK-TARLAC GROWTH CORRIDOR

WHEREAS, Subic-Clark Alliance for Development (SCAD) was created to transform Subic and Clark into a world-class mega-logistics hub and a global gateway to the Asia Pacific Region and the rest of the world;

WHEREAS, Subic-Clark-Tarlac Growth Corridor is seen as one of the world’s major economic hubs and a catalyst for development hence a major employment generator in Northern Philippines, with no less than Her Excellency Gloria Macapagal-Arroyo acknowledging that it will become the hottest investment site;

WHEREAS, the Metro Clark Advisory Council (MCAC) moved for the immediate interconnection of telecommunications facilities in Clark Freeport Zone with those in Tarlac and Zambales;

WHEREAS, the interconnection of telecom facilities will result in making calls to interconnected areas considered as local calls thus will not only lower the cost for investors but will compliment the new Subic-Clark-Tarlac Expressway much more beneficial to the local constituents working in the growth corridor;

WHEREAS, Olongapo City in February 2, 2005 passed Resolution No. 11, Series of 2005 requiring telecom interconnection between Subic Bay Freeport, Olongapo City and Zambales;

WHEREAS, in July 2005, the telecommunication interconnection became a reality and with the advent of wireless landline technology, seamless communication in the region will surely make it a haven for investors and eventually result in more jobs for its people;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to endorse, as it hereby endorses the interconnection of telecommunications facilities of the Subic-Clark-Tarlac Growth Corridor

Let copies of this Resolution be furnished the Metro Clark Advisory Council, SCAD, SBMA, NTC and the provincial government of Tarlac, Pampanga, Bataan and Zambales for their information and appropriate action.

A RESOLUTION URGING THE SENATE FOR THE SWIFT PASSAGE OF SENATE BILL 2407 ENTITLED “AN ACT PROHIBITING AND PENALIZING THE PILFERAGE AND THEFT, UNAUTHORIZED USE, INTERCONNECTION, OR RECEPTION OF ANY SIGNAL OR SERVICE OFFERED OVER A CABLE TELEVISION (CATV)
OR CABLE INTERNET SYSTEM AND/OR NETWORK OR THROUGH ANY UNAUTHORIZED INSTALLATION, ACCESS OR CONNECTION THERETO THROUGH THE USE OF CABLE OR OTHER EQUIPMENT, AND PRESCRIBING PENALTIES THEREFORE, AND FOR OTHER PURPOSES”


WHEREAS, it is stated in the explanatory note of Senate Bill 2407 that the operation of the cable TV industry is a vital technological development that has significantly helped in the fast and effective delivery of information, entertainment and other communication services to the Filipino People;

WHEREAS, the cable TV industry is presently facing serious problems such as signal theft and illegal connection. As of June 2005, the number of illegal cable subscribers was estimated at 835,000 which increased by 28 percent from 650,000 in the year 2004;

WHEREAS, on the other hand, legitimate subscribers decreased by 15 percent from 880,000 in 2004 to 750,000 in June 2005;

WHEREAS, as a result the cable TV industry has suffered huge losses in terms of lost profits and higher programming costs. In 2004 the industry reportedly lost of PhP3.92 Billion almost 55 percent of which or PhP2.13 Billion was foregone revenue of the government in terms of taxes, import duties and licensing fees. In 2005 these industry losses already increased to PhP5 Billion;

WHEREAS, the said Senate Bill shall declare certain acts harmful to the industry within the prohibited acts and sanctions are provided therefore;

WHEREAS, the swift passage of the bill shall protect the cable TV industry from the stated prohibited acts to prevent further losses on their industry and attaining their basic purpose as information dissemination instrumentality;

NOW, THEREFORE, on motion of Councilor Noel Y. Atienza, with the unanimous accord of the Members of Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to urge, as it hereby urges the Senate for the swift passage of Senate Bill 2407 entitled “An Act Prohibiting And Penalizing The Pilferage And Theft, Unauthorized Use, Interconnection, Or Reception Of Any Signal Or Service Offered Over A Cable Television (CATV) Or Cable Internet System And/Or Network Or Through Any Unauthorized Installation, Access Or Connection Thereto Through The Use Of Cable Or Other Equipment, And Prescribing Penalties Therefor, And For Other Purposes”

Let copies of this Resolution be furnished to the Office of Senator Juan Ponce Enrile, House of Representatives and Office of the President.
