ORDINANCE NO. 54

AN ORDINANCE APPROPRIATING THE AMOUNT OF NINE MILLION PESOS
(PHP9,000,000.00) FOR THE DESIGN AND CONSTRUCTION OF PHASE 1
PROJECT OF ULO NG APO ROTONDA TO BE TAKEN FROM LOT
SALES UNDER TRUST FUND ACCOUNT

BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESION ASSEMBLED, THAT:

SECTION 1. The amount of Nine Million Pesos (PhP9,000,000.00) is hereby appropriated for the Design and Construction of Phase 1 Project of Ulo ng Apo Rotonda to be taken from Lot Sales under Trust Fund Account.

SECTION 2. This Ordinance shall be subject to the usual accounting and auditing rules and regulations.

SECTION 3. The letter request of the Honorable City Mayor James Gordon, Jr. dated September 11, 2006 and a Certificate of Availability of Funds dated September 12, 2006 issued by Mr. Marcelino D. Andawi, City Treasurer are hereby made as integral parts of this Ordinance.

SECTION 4. This Ordinance repeals Ordinance No. 50, Series of 2006 entitled “An Ordinance Appropriating The Amount Of Eight Hundred Thousand Seven Hundred Thirty Pesos

SECTION 1. The additional amount of Five Hundred Thousand Pesos (PhP500,000.00) is hereby appropriated from the Unappropriated Balance of the General Fund not otherwise appropriated and the same is hereby made available for the Olongapo City Skills Training Program under the Office of the City Mayor to wit:

A RESOLUTION EXPRESSING WARM WELCOME AND FELICITATIONS TO THE DELEGATES OF THE JUNIOR CHAMBER INTERNATIONAL PHILIPPINES
(PHILIPPINE JAYCEES) NATIONAL CONVENTION IN OLONGAPO CITY


WHEREAS, the Junior Chamber International (Philippine Jaycees) blazes its trail back to this City for their National Convention on October 12 to 14, 2006;

WHEREAS, for this, Olongapo City stands honored to be chosen as host to the convergence of the most illustrious and influential league of leaders of our time, who through their leadership in various fields of endeavor and positive impact had propelled countless communities to pursue their next growth level;

WHEREAS, coupled with the pride and excitement of hosting such event, is the great expectation that deeper partnerships will be forged between the Jaycees and the City, having shared the mission as adjutants of positive changes in the country;

WHEREAS, the City accords the convention delegates its warmest welcome as their presence equally brings delight to the people and City Government of Olongapo;

NOW, THEREFORE, with the unanimous accord of the Sangguniang Panlungsod present;

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to express, as it hereby expresses warm welcome and felicitations to the delegates of the Junior Chamber International Philippines (Philippine Jaycees) National Convention in Olongapo City.

RESOLUTION NO. 190
(Series of 2006)

A RESOLUTION AUTHORIZING THE CITY MAYOR AND THE CITY TREASURER TO NEGOTIATE WITH THE DEVELOPMENT BANK OF
THE PHILIPPINES (DBP) AND TO SIGN ALL DOCUMENTS PERTAINING
TO THE EXTENSION OF TERM OF THE PHP23.0 MILLION AND PHP4.5 MILLION SHORT-TERM LOANS FOR ANOTHER 360 DAYS

WHEREAS, Section 22 of the Local Government Code of the Philippines provides that “Every local government unit, as a corporation, shall have the following powers such as to enter into contracts”;

WHEREAS, Paragraph c of the same section of the Local Government Code of the Philippines states that “Unless otherwise provided in this Code, no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization by the Sanggunian concerned”;

WHEREAS, Section 455 of the aforementioned Code further states that the City Mayor, as the chief executive of the City Government, shall exercise such powers and perform such duties and functions as provided by this Code and other laws; represent the city in all its business transaction and sign in behalf all bonds, contracts, and obligations and such other documents upon authority of the Sangguniang Panlungsod or pursuant to law or ordinance;

WHEREAS, pursuant to power granted by the said Code, this City through the local chief executive has availed of PhP23.0 Million and PhP4.5 Million back-to-back loans from DBP for the construction of the Olongapo City Commercial and Cultural Center and the escalator for the Olongapo City Mall;

WHEREAS, the said loan was granted last December 2003 under the same interest rates with the city’s long term PhP84.0 Million loan agreement;

WHEREAS, the city has already negotiated with DBP for the increase of the loan package to reflect the conversion of the short-term loan to long-term loan;

WHEREAS, since the application is under process with DBP, there is a need to extend the short-term loan for another 360 days;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the City Mayor and the City Treasurer to negotiate with the Development Bank of the Philippines (DBP) and to sign all documents pertaining to the extension of the term of the PhP23.0 Million and PhP4.5 Million short-term loans for another 360 days.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, to authorize the continuing assignment of the applicable portion of the city’s IRA, realty taxes and other revenues to CBP until all of the city’s loans are fully paid.

A RESOLUTION REQUESTING THE DEPARTMENT OF TRADE AND INDUSTRY (DTI)
TO WAIVE THE PERMIT FOR BUSINESS PROMOTION ON THE CITYWIDE SALE
FROM THE 12TH TO 31ST DAY OF OCTOBER 2006 IN CELEBRATION OF THE
ULO NG APO FESTIVAL

WHEREAS, the Olongapo City Government, with the city’s event organizers, prepared series of activities to culminate the ULO NG APO Festival 2006. Highlights of the events are the Mardigras, Citywide Sale, Art Exhibit, Marikina Shoe Caravan, Beach Mardigras and many others;

WHEREAS, the ULO NG APO Festival is slated on the 12th to 31st day of October where Olongapeños of all ages will go out of their houses and lead to major streets of the city to witness this annual festivity showing the Olongapo heritage;

WHEREAS, the Olongapo City Government, through the Task Force Tourism, in its endeavor to create events for the marketing and promotion of activities, ultimately help the business community in all its determination to organize absolute marketing, promotional measures and fund raising activities;

WHEREAS, all local business establishments, who shall benefit largely from these events have been encouraged to participate in the Citywide Sale from the 12th to 31st day of October 2006, one of the most effective sales promotion approaches which shall provide marked down prices and discounts in most tourism related areas;

WHEREAS, the Citywide Sale will seek to provide sales, discounts, buy one take one, bargains, and similar sales and marketing/ promotional activities that will persuade people to go out of their homes and spend money. This will eventually help the business community in its desire to acquire additional revenues;

WHEREAS, the Department of Trade and Industry mandates all business establishments that aspire to have sales promotional activities to secure permit before commencing;

WHEREAS, the Department of Trade and Industry is the city’s local partner in its venture to expand its trade and industry, creating job opportunities and generating additional revenues to reinforce the city’s socio-economic progress. By exempting the permit for the sales promotion activities intended for the Citywide Sale from the 12th to 31st day of October 2006, DTI will be able to contribute in meeting such objectives;

NOW, THEREFORE, on motion of Councilor Gina Gulanes Perez, with the unanimous accord of the Sangguniang Panlungsod present;

RESOLVED, AS IT HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests the Department of Trade and Industry (DTI) to Waive the Permit for Business Promotion on the Citywide Sale from the 12th to 31st Day of October 2006 in Celebration of the ULO NG APO FESTIVAL.

Let copies of this Resolution be furnished to DTI and the Olongapo City Business Division for their information and implementation.

TO ENTER INTO A MEMORANDUM OF AGREEMENT IN BEHALF OF THE OLONGAPO CITY COUNCIL FOR THE WELFARE OF CHILDREN WITH THE NATIONAL COUNCIL FOR THE WELFARE OF CHILDREN AND THE REGIONAL SUB-COMMITTEE FOR THE WELFARE OF CHILDREN IN RELATION TO THE EARLY CHILDHOOD CARE AND DEVELOPMENT COUNCIL (ECCD) PROGRAM IMPLEMENTATION IN THE CITY


WHEREAS, under Resolution No. 138, Series of 2006, the Office of the National Council for the Welfare of Children headed by Executive Director Lina B. Laigo, was inadvertently not included in the said resolution as party to the agreement;

A RESOLUTION APPROVING THE PROPOSED BOY SCOUTS OF THE PHILIPPINES (BSP)-JAMES L. GORDON COUNCIL BUILDING AS ONE OF THE PRIORITY PROJECTS OF THE CITY FOR THE CALENDAR YEAR 2006.


WHEREAS, the Boy Scouts of the Philippines, James L. Gordon Council, Olongapo City passed Resolution No. 005, Series of 2006, entitled “A Resolution Approving The Construction Of The Proposed James L. Gordon Council’s Building Headquarters,” last August 24, 2006;

WHEREAS, the Sangguniang Panlungsod deems it proper to approve the proposed construction of the Boy Scouts of the Philippines-James L. Gordon Council’s Building, as one of the priority projects of the city for the Calendar Year 2006;

WHEREAS, BSP-James L. Gordon Council of Olongapo City approved its design for the construction of the proposed James L. Gordon Council’s Building;

NOW, THEREFORE, on motion of Councilor Edwin J. Piano and with the majority decision of the Members of Sangguniang Panlungsod present;

RESOLUTION NO. 190

A RESOLUTION AUTHORIZING THE CITY MAYOR AND THE CITY TREASURER TO NEGOTIATE WITH THE DEVELOPMENT BANK OF
THE PHILIPPINES (DBP) AND TO SIGN ALL DOCUMENTS PERTAINING
TO THE EXTENSION OF TERM OF THE PHP23.0 MILLION AND PHP4.5 MILLION SHORT-TERM LOANS FOR ANOTHER 360 DAYS

WHEREAS, Section 22 of the Local Government Code of the Philippines provides that “Every local government unit, as a corporation, shall have the following powers such as to enter into contracts”;

WHEREAS, Paragraph c of the same section of the Local Government Code of the Philippines states that “Unless otherwise provided in this Code, no contract may be entered into by the local chief executive in behalf of the local government unit without prior authorization by the Sanggunian concerned”;

WHEREAS, Section 455 of the aforementioned Code further states that the City Mayor, as the chief executive of the City Government, shall exercise such powers and perform such duties and functions as provided by this Code and other laws; represent the city in all its business transactions and sign in behalf all bonds, contracts, and obligations and such other documents upon authority of the Sangguniang Panlungsod or pursuant to law or ordinance;

WHEREAS, pursuant to power granted by the said Code, this City through the local chief executive has availed of PhP23.0 Million and PhP4.5 Million back-to-back loans from DBP for the construction of the Olongapo City Commercial and Cultural Center and the escalator for the Olongapo City Mall;

WHEREAS, the said loan was granted last December 2003 under the same interest rates with the city’s long term PhP84.0 Million loan agreement;

WHEREAS, the city has already negotiated with DBP for the increase of the loan package to reflect the conversion of the short-term loan to long-term loan;

WHEREAS, since the application is under process with DBP, there is a need to extend the short-term loan for another 360 days;

NOW, THEREFORE, on motion of Councilor Cynthia G. Cajudo, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize, as it hereby authorizes the City Mayor and the City Treasurer to negotiate with the Development Bank of the Philippines (DBP) and to sign all documents pertaining to the extension of the term of the PhP23.0 Million and PhP4.5 Million short-term loans for another 360 days.

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, to authorize the continuing assignment of the applicable portion of the city’s IRA, realty taxes and other revenues to DBP until all of the city’s loans are fully paid.
