A RESOLUTION EXPRESSING PROFOUND CONDOLENCES TO THE BEREAVED FAMILY OF MS. CARMELITA B. YCO, DILG LOCAL GOVERNMENT OPERATIONS OFFICER V

WHEREAS, Ms. Carmelita B. Yco, Local Government Operations Officer V of the Department of the Interior and Local Government, Olongapo City pass on to be with her Creator on January 14, 2013;

WHEREAS, “Carmelites” as she was fondly called by friends and colleagues served the said department since 1981, rose from ranks to the position of a Local Government Operations Officer V and a recipient of numerous recommendations and citations for her dedication and hard work;

WHEREAS, earning the trust and confidence of her superiors and the present administration, she was recommended by the city government as Officer-in-Charge of DILG Olongapo in 2009 due to the retirement of its former City Director Eliseo De Guzman;

WHEREAS, with her vast experience and ability she was designated as Planning Officer, Special Project Coordinator, Business Permit Licensing Services Focal Person, Medium-term Development Goal Management and Evaluation Tracking System Focal Person, significant for the City’s quest in garnering grants and awards benefiting the Olongapo constituents;

WHEREAS, she participated actively in various activities and projects of the city and had assisted the barangays in their various endeavors. Recognizing her contributions as public servant, she was named Regional Awardee for the Most Outstanding City Administrative Support Staff for two consecutive years;

WHEREAS, the Sangguniang Panlungsod of Olongapo will be forever grateful and remember Ms. Yco, the DILG Personnel, who, behind her simplicity and lowly stature had a big heart for public service.

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express, as it hereby expresses profound condolences to the bereaved family of Ms. Carmelita B. Yco, DILG Local Government Operations Officer V.

Let a copy of this Resolution be furnished the bereaved family of Ms. Carmelita B. Yco for their information and record.

A RESOLUTION AUTHORIZING THE HONORABLE CITY MAYOR JAMES GORDON, JR. TO ENTER, EXECUTE AND SIGN AN AMENDED CONTRACT OF LEASE WITH SM PRIME HOLDINGS, INC. TO ENSURE GREATER PROTECTION AND MAXIMIZE BENEFITS ACCRUING TO THE CITY OF OLONGAPO, IN A MANNER CONSISTENT WITH LAW

WHEREAS, the city passed a series of legislation and complied with all legal requirements with respect to the original 2009 Contract of Lease between the City and SM Prime Holdings, Inc. as reflected in the following: Resolution No. 54, Series of 2008, “A Resolution authorizing Honorable City Mayor James Gordon, Jr. to prepare the Terms of Reference to bid out for long-term lease, the Olongapo City Mall”; Resolution No. 79, Series of 2009; Resolution No. 162, Series of 2009; “A Resolution accepting the Proposal of SM Prime Holdings, Inc., and approving the Competitive Challenge procedure as a mode of awarding the lease contract relative thereto, subject to existing auditing rules and applicable legal requirements”; Resolution No. 169, Series of 2009. “A Resolution approving the Joint Recommendation of the Negotiation Team of the SM Prime Holdings, Inc. relative to the Unsolicited Proposal for the long-term lease of the Olongapo City Mall”; Resolution No. 158 Series of 2009, “A Resolution repealing city council resolution No. 114 Series of 2009, to secure the best possible terms for, and optimum benefits from, the long-term lease of City Mall”; Resolution No. 170, Series of 2009, “ A Resolution confirming the Negotiations and approving the Terms of Reference, guidelines and schedule of activities relative to the SWISS/Competitive Challenge mode for the long-term lease of Olongapo City Mall”; Resolution No. 182 Series of 2009, “A Resolution approving the issuance of a Notice of Award of the long-term lease of the City Mall to SM Prime Holdings, Inc. and authorizing the City Mayor to enter into a contract of lease pursuant thereto”;

WHEREAS, the contract and eventual partnership with SM Prime Holdings, Inc. has reaped various additional spill-over and corollary benefits to the local community which include initiatives such as the provision for SM college scholarships for qualified Olongapo youth, SM provisions for a mobile clinic / health van which assist barangays in health service, SM provision for tree planting or agriculture related initiatives, employment generation for almost three thousand (3,000) Olongapo City residents from its date of permits and taxes to the city, conduct of activities which promote the city’s local talents and tourism, tie-ups with the city’s social service offices such as with the City Health Office and the James L. Gordon Memorial Hospital and the attraction of new businesses to the city;

WHEREAS, to ensure that all contact terms and conditions and processes relating thereto would be just, equitable, legal and transparent, with the goal of facilitating the realization of the greatest possible advantage and benefit to the City of Olongapo, the City Finance Team caused an updated review of the 2009 Contract of Lease with SM Prime Holdings, Inc.;

WHEREAS, as per Finance Team review, there is a need to integrate, modify or amend certain provisions in the Contract of Lease which effectively increased the incentives to the city and strengthened its protective provisions in favor of the city;

WHEREAS, as a matter of legal consequence and necessity, there is a need to enter, execute and sign an Amended Contract of Lease to ensure that it would be in consonance the best interests and greatest advantage to the city, with the following recommended terms to be integrated in the pertinent portions of the 2009 Contract of Lease between the City of Olongapo and SM Prime Holdings, Inc.: (a) a provision that the ownership of the City Mall building which SM Prime Holdings, Inc. rehabilitated, repaired, developed and renovated shall revert back to the city after expiration of the lease term without need of reimbursement; (b) any adoption of previous or new terms and conditions of lease or any agreement in the event of its renewal  after expiration of the lease term shall be made subject of negotiations and mutual agreement between the City and SM Prime Holdings, Inc.; (c) incentives shall be made subject to existing city and national legislation and regulations as to coverage and limitations; (d) provisions in the Contract shall be understood to be made subject of implementation and enforcement, in a manner consistent with pertinent laws, rules and regulations;

NOW, THEREFORE, on motion of City Councilor Gina G. Perez, on behalf of City Councilors Rodel S. Cerezo, Eyrma Yvette Marzan-Estrella, Elena C. Dabu, Eduardo J. Piano, Edna A. Elane, with the majority decision of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to authorize as it hereby authorizes, the Honorable City Mayor James Gordon, Jr. to Enter, Execute, and Sign an Amended Contract of Lease with SM Prime Holdings, Inc. to Ensure Greater Protection and Maximize Benefits Accruing to the City of Olongapo, in a manner consistent with law.

A RESOLUTION COMMENDING OLONGAPEÑO JOURNALIST AND ABS-CBN CORRESPONDENT MR. ABNER MERCADO FOR BEING AWARDED THE 2013 NINOY AND CORY AQUINO FELLOW FOR JOURNALISM AND FOR EPITOMIZING THE VALUES OF INTEGRITY, EXCELLENCE, PERSEVERANCE, AND DEDICATION TO PUBLIC SERVICE THROUGH MEDIA WORTHY OF EMULATION

WHEREAS, the City of Olongapo has always endeavored to provide an environment conducive to the development and success of its citizens on all professions or fields, from all walks of life;

WHEREAS, ABS-CBN Journalist Abner Mercado is a genuine Olongapeño, being raised in Olongapo City since his birth on April 17, 1970 in Olongapo City, with his primary education acquired from Olongapo City Elementary School (OCES) and secondary at Christ the King High School prior to his leave from the city to study at the University of the Philippines College of Mass Communication, Major in Film and Audio Visual Communication;

WHEREAS, Olongapeño Abner Mercado has consistently brought pride and inspiration to the city with his long line of achievements, the most notable of which include: (a) being chosen as a Philippine delegate to the “World Report Contributor’s conference” at the prestigious CNN Global Headquarters in April 1997 at Atlanta, Georgia, and to the International Visitor Leadership Program at Washington, District of Columbia, conference and training held on December 3-14, 2012; (b) consistent inclusion in the official selection for Best Mountaineering Film with the Moscow International Festival of Mountaineering and Adventure Films and winning a Special Prize for his work “Mt. Cook Chronicles: The Road to Everest” held in Moscow, Russia and official selection in the Autrans International Mountain Festival at Autrans, France; and, “winning the Bronze World Medal in the Social Issues/Current Events Category (Best Social Issues and Current Events) in the 2012 New York Film and TV Festivals in the “Laya” (Freedom) held last April 17, 2012 at Las Vegas, Nevada, USA;

WHEREAS, Olongapeño Abner Mercado was recently awarded the 2013 Ninoy and Cory Aquino Fellowship Journalism Awards on November 14, 2012 at the US Embassy in Manila, Philippines for the cited reason that, “his work as a societal influencer echoes Senator Benigno “Ninoy” Aquino, Jr.’s significant contributions to establishing a free and responsible media despite the odds;”

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to commend, as it hereby commends, Olongapeño journalist and ABS-CBN correspondent Mr. Abner Mercado for being awarded the 2013 Ninoy and Cory Aquino Fellow for Journalism and for epitomizing the values of integrity, excellence, perseverance, and dedication to public service through media worthy of emulation.

A RESOLUTION  STRONGLY REITERATING THE CALL FOR ALL PERSONS, ENTITIES OR ESTABLISHMENTS TO IMPLEMENT THE LEGALLY MANDATED RIGHTS OF SENIOR CITIZENS AND PERSONS WITH DISABILITIES UNDER REPUBLIC ACT NO. 7432 AS AMENDED BY REPUBLIC ACT NOS. 9257 AND 9994 WHICH INCLUDE ESTABLISHMENT OF A PREFERENTIAL OR SPECIAL LANE

WHEREAS, in a long line of legislation since the year 1996, the city has passed Ordinances and Resolutions which promote the rights of Senior Citizens, particularly: City Ordinance No. 3, Series of 1996, “An Ordinance making it punishable for any establishment, service utility and private or public institution who refuses to grant the privileges and benefits due senior citizens as provided for under Republic Act 7432”, City Council Resolution No. 60, Series of 1999, “A Resolution establishing a preferential or express lane for senior citizens and persons with disabilities in paying stations of government and non-government agencies providing utilization of services for a fee (electric, water, transportation, cinemas, banking facilities and etc.)”; City Ordinance No. 23, Series of 2000, “An Ordinance mandating all public utility transport vehicles within the jurisdiction of the City of Olongapo to comply with the provisions of RA #7432 specifically granting twenty (20%) discount to senior citizens and posting of that information in the vehicles”: City Ordinance No. 25, Series of 2000, “An Ordinance mandating each barangay to appoint an OSCA (Office of Senior Citizen Affairs) Chairman for Senior Citizens to be selected from among barangay council members”; City Council Resolution No. 36, Series of 2001, “A Resolution authorizing the Federation of Senior Citizens Association of the Philippines (FSCAP) Olongapo chapter to occupy portion of Lot 5, TS-308, located at Barangay West Bajac-Bajac, this city”; City Council Resolution No. 100, Series of 2001,” A Resolution authorizing the Federation of Senior Citizens Association of the Philippines (FSCAP) Olongapo City Chapter, to use the old DSWD office at the City Engineering Compound, West Bajac-Bajac, this city as their new office and authorizing the City Mayor to enter into a Memorandum of Agreement relative thereto”; City Council Resolution No.41, Series of 2006, “A Resolution strongly supporting the strict compliance with the provisions of Republic Act 9257 otherwise known as the Expanded Senior Citizens Act of 2003”; City Council Resolution No. 103, Series of 2006, “A Resolution strongly endorsing the swift passage into law of Senate Bill No. 2206 giving Senior Citizens discount beyond death, and other additional privileges, authored by Sen. Edgardo Angara”; City Council Resolution No. 140, Series of 2007, “A Resolution accrediting the Federation of Senior Citizens Association of the Philippines (FSCAP) Olongapo City Chapter, a people’s organization for membership purposes in local special bodies in Olongapo City pursuant to the provisions of Republic Act No. 7160 otherwise known as the Local Government Code of 1991”; City Council Resolution No. 21, Series of 2009, “A Resolution supporting Senate Bill No. 3061 which seeks to amend Republic Act No. 9257 or the Senior Citizens Act of 2003 by exempting senior citizens from the twelve percent Value Added Tax on Medicines”; City Council Resolution No. 64, Series of 2010, “A Resolution adopting Republic Act No. 9994 otherwise known as the Expanded Senior Citizens Act of 2010 or An Act granting additional benefits and privileges to senior citizens, further amending Republic Act 7432 as amended, otherwise known as An act to maximize the contribution of senior citizens to nation building, grant benefits and special privileges and for other purposes and enjoining all concerned establishments and offices on its implementation” ;

WHEREAS, recent reports show that there remain persons, entities or establishments which do not comply with the legally mandated rights of Senior Citizens or Persons with Disabilities under national and local legislation's  thus the need to  strongly reiterate the city’s consistent stance favoring and promoting their rights;

NOW, THEREFORE, on motion of City Councilors Edna A. Elane and Elena C. Dabu with the unanimous accord of the Members of the Sangguniang Panlungsod present;

 RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to Strongly Reiterate the Call for all Persons, Entities or Establishments to Implement the Legally Mandated Rights of Senior Citizens and Persons with Disabilities under Republic Act No. 7432 as amended by Republic Act Nos. 9257 and 9994 which include establishment of a Preferential or Special Lane.
