Call to Order
The City Vice-Mayor and Presiding Officer Cynthia G. Cajudo called the session to order at 3:25 in the afternoon.
Roll Call
With eight (8) City Council Members and the Presiding Officer present, a quorum was declared.
Reading and Adoption of Minutes
On motion of City Councilor Gina G. Perez, the minutes of the regular session dated 10th of August, 2009, was deferred by the body.
The Presiding Officer declared a recess, to give way for the announcements of the City Mayor.

When the session resumed, City Councilor Gina Perez moved for the suspension of the rules to give way for the discussion regarding the present status of Olongapo City, brought about by Typhoon Labuyo.
The Presiding Officer acknowledged the presence and introduced Hon. City Mayor James Gordon, Jr., to render the present state of the city after being hit by Typhoon Labuyo.
In his report, the City Mayor assessed the damages brought about by the typhoon, stressing that another typhoon, Maring, is expected to hit the country, to bring strong monsoon rains. There were fifteen (15) barangays that suffered deep floodings and covered most areas with mud, costing an estimated damages of Php 5 Million to private properties, houses, and vehicles, which were submerged in flood waters, especially in the low – lying areas like Barangay Sta. Rita. The City Government also suffered an estimated damage of 25 million pesos that will require a massive road clearing operations. Requests are mostly coming from schools and city government buildings, which will cost the city Php 5 Billion in rehabilitation. According to the City Mayor, the Engineering Department will spend Php 18 Million, the PUD Php 1.5 Million, the Market Php 5 Million, and an additional Php 500,000 for office equipments and supplies destroyed during the storm. For this purpose, the City Mayor declared the city in a state of calamity.
In response to the assessment made by the City Mayor and also based on the recommendation and coming from the Disaster Management Office, City Councilor Cortez moved to pass the draft resolution declaring state of calamity in the City of Olongapo due to heavy rains and flash floods, destruction brought by Typhoon Labuyo, enhanced by the southwest monsoon.
The draft resolution was approved unanimously, in its second and final reading, on motion of City Councilor Aquilino Y. Cortez, Jr.
Recess was again declared by the Presiding Officer at 3:55 P.M.
At the resumption of the session at 3:57 P.M., City Councilor Perez moved for the lifting of the suspension of the rules and to proceed with the regular order of business.

Committee Reports
Councilor Perez reported on what transpired during the World Tourism Day Celebration last 3rd of September, 2009 which was attended by approximately one thousand two hundred (1,200) participants coming from the city government, barangays, schools, NGOs, tourism sector, and some coming from the neighboring towns of Zambales. This event was initiated by the City Tourism Office and Olongapo City Convention Center and was graced by Dr. Erwin Balane of the Department of Tourism as the resource speaker and EA Raul Marcelo from the SBMA Tourism. Vice-Mayor Cynthia Cajudo and Vice-Governor Anne Gordon were also present. City Councilor Perez made a presentation about customer relations while Ms. Lorela Montoya, OIC, Tourism Office, gave an overview of the city tourism industry. Part of the event was to formulate an appropriate title that can best describe the city. Based on actual votes on choices of the attendees from the selection of titles for the city are the following: 1. “Mardi Gras Capital of the Philippines,” 2. “City of Volunteers,” 3. “Scene City,” 4. “Entertainment Capital,” and last “Musicians Capital.” Whatever is the best title chosen, would be adopted by the Sangguniang Panlungsod.

2. City Councilor Gina Perez introduced Draft Ordinance O-27, entitled “An Ordinance Setting Forth Standards For The Designation Of Ambassador Of Goodwill Representing The City Of Olongapo.”
The proponent recalled during the last discussion in the session that it was suggested by some members to change the form, from an ordinance to a resolution. Some changes were also considered based on the observations of City Councilors Aquino and Piano. To further improve Section II Objective, states that “the ambassador of goodwill shall promote the friendship, culture, interest, and welfare between the city and the place to be visited,” instead of just friendship. Under Qualifications, requires that “must be born in Olongapo City” or “has been a good friend” and “should possess related experience to specific tasks to be designated.” Application Endorsement, “The City Council shall further review and decide on the approval of the designation of Ambassador of Goodwill to an individual thru a resolution. Effectivity of Appointment, “shall serve the duration stated in the resolution, and shall be renewed in writing by the city government to another resolution with proper indorsement by the City Mayor.”
With all these considerations, the proponent, though awaiting for more inputs, moved for its approval, with amendments, from its title as an ordinance to “A Resolution Adopting the Standards for the Designation of Ambassador of Goodwill Representing the City.”
City Councilor delos Reyes wanted to know what are the responsibilities that an Ambassador of Goodwill should follow. After passing a resolution for Mr. Artis, they have other items to be passed under first reading sponsored by City Councilor Garcia concerning private individuals who will go to Guam on a private affair. He expressed his apprehension that designating any one as Ambassador of Goodwill might be used only for personal purposes, such as applying for a visa. While he admitted he personally knew the persons City Councilor Lipumano-Garcia is sponsoring – that they worked for a non-government organization. He is, however, willing to vote for its approval. City Councilor delos Reyes just wanted to caution that the Ambassador of Goodwill measure might only be used for other purposes.
In addition, he suggested to oblige the designated person to submit a report to the City Council on what they have accomplished after doing their mission to Guam. Also, to require them to submit a copy of their credentials.
City Councilor Piano also suggested if it is possible to include a copy of their NBI or Police Clearance, aside from their curriculum vitae. He made a clear distinction between the Ambassador of Goodwill, and the ambassadors that we are familiar of who possess immunity and who holds diplomatic passport. The persons they are designating are not official representatives of the government, who are given power to sign in behalf of the city. According to him, there are countries that even animals, such as dogs, are given titles as Ambassadors of Goodwill.
City Councilor delos Reyes wanted to clarify Sec. IV, No. 1, if its intention is to require an indorsement from the Mayor. If it requires proper indorsement coming from the Mayor, then he will disqualify the resolutions sponsored by City Councilor Lipumano-Garcia, because it has to be filed in the Mayor’s Office in the first place. According to him, if this is an act of the council, it must have been sponsored by a city councilor and be deliberated upon. Such title as Ambassador of Goodwill gives credence to the bearer that brings honor. If it will originate from the Mayor’s Office, then, I don’t know how it would be, he said.
City Councilor Perez tried to explain the above-mentioned section, that an indorsement coming from the City Mayor will be applied in absence of any reputable organization or private individual who can make the indorsement. It will follow the usual process of submitting it to the City Council, then, it will be referred to the concerned committee for proper sponsorship.

After a brief recess, City Councilor Gina G. Perez moved for the deferment of the said measure, pending its further study which the body agreed.
3. City Councilor Perez introduced Draft Resolution No. 2009 R-073, entitled “A Resolution Conveying Aversion To Various Advertisements Currently Placed In National Media Promoting Political Personalities.”
This pertains to the showing of infomercials on national television promoting political personalities as presidentiables in the coming national elections, which has now become controversial because of the big amount of money being spent by politicians reaching to more than billions of pesos. This amount according to some groups, should be spent in building classrooms or providing livelihood programs for the poor. She enumerated the extent of expenses made by Senator Manny Villar amounting to Php 321.4 Million, from unknown sources; Senator Mar Roxas – Php 256.7 Million; Vice-President Noli de Castro – Php 172 Million, sourced from Pag-ibig Corporate Fund; Mayor Jejomar Binay – Php 115.1 Million, from the government of Makati; Efraim Genuino – Php 82 Million, from PAGCOR; Senator Loren Legarda – Php 42 Million, from unknown sources; Secretary Francisco Duque – Php 32.4 Million, from National Center for Health Promotion, Secretary Gilbert Teodoro – Php 30.7 Million, from the National Disaster Coordinating Council; Senator Ping Lacson – Php 22 Million; Chairman Bayani Fernando – Php 5.8 Million, from the Metro Manila Development Authority, and Secretary Jesli Lapus – Php 5.7 Million, from Adopt-A-School Program.
With the passing of this resolution, we can express our dismay over the manner on how funds are being spent, at the same time call the attention of COMELEC for appropriate action because this is a clear violation of the election code. These candidates can get away with it just by the lame excuse of not yet having filed their candidacies. The House of Representatives and the Senate should enact laws that will address this problem. She mentioned that Senators Miriam Defensor Santiago and Richard Gordon have already expressed their sentiments over this matter. City Councilor JC has been very vocal about his cause that campaigning should be based on qualification and not on the influence of money.
At this point, City Councilor delos Reyes took the opportunity to speak about the situation. He described the manner in which the other presidential aspirants by calling it as “One-upmanship.” He also shared his experience on how he is being treated as a candidate, making him appear as the laughing stock and considering him as politically immature and lacking in experience. While criticizing other candidates who are relying on the results of the surveys, he named Gilbert Teodoro, who benefited 2% rating from the survey, as a result of his commercial. He said that he is willing to face-off with any candidate, focusing only on issues and not on personalities. He also commented on matters of nepotism or political dynasty, referring to some candidates in the Liberal Party. Although, he admitted he comes from a political dynasty, he stressed that his family respected his views and vowed to pursue his crusade against political dynasties. He also branded the entry of Noy-noy Aquino in the presidential race as the “Flavor-of-the month Personality Politics.” In this draft resolution, he suggested to add the words “in the strongest term” in the title, to read “A Resolution Conveying Aversion in the Strongest Terms to Various Advertisements Currently Placed In National Media Promoting Political Personalities.”
After a thorough deliberation, Resolution No. 2009 R-073 was approved unanimously by the body, in its second and final reading, on motion of City Councilor Gina G. Perez.
4. City Councilor Manalo moved for the approval of Draft Resolution No. 2009 R-093, entitled “A Resolution Approving The Terms And Conditions Of The Sale And Modernization Of The Olongapo City Electric Distribution Utility System And Authorizing The City Government To Conduct The Public Bidding For The Sale Of Such Assets, And For Other Purposes.”
In his explanation, in July, 2009, the council already approved an ordinance for the modernization of the PUD, by way of public and private participation thru divestment, sale, or BOT. The city is now ready to conduct the public bidding for the sale of such assets, and to approve the terms and conditions of the sale. Before the said bidding, the City Mayor will issue an Executive Order appointing the members coming from the government or private entities, who will comprise the Special Bids and Awards Committee.
The Presiding Officer made sure that everyone has a copy of the new draft and the indicative term sheet of an asset purchase agreement dated 27th August, 2009.
City Councilor Cortez expressed his willingness to vote of the said draft resolution, saying there is no other choice because the PUD is now in a state of distress, to avoid further losses on part of the city, and to stop the public from wondering why such a big loss. He believes that thru the privatization of PUD, all consumers will be treated fairly. He urged his colleagues to vote for its approval.
After a brief discussion, the draft resolution was approved by a majority vote in its second and final reading, on motion of City Councilor Jonathan G. Manalo.
Other Matters
A. City Councilor Perez shared the information about the impending travel of the Vice-Mayor to the Holy Land of Israel, and to visit the House of Parliament. She will bring with her the message of warm greetings from our city to the people of Israel. We can expect that she will bring with her many positive inputs that can be useful for our city as she returns home. With this, she moved for the approval of “A Resolution Expressing the City’s Warmest Greetings and Felicitations to the Holy Nation, Israel thru the City’s Envoy, Vice-Mayor Cynthia G. Cajudo,” sponsored by her colleagues unanimously.
City Councilor delos Reyes reiterated his previous objection against the motion for unanimous sponsorship. He suggested at least three (3) sponsors may suffice, for reference.
The proponent was joined by City Councilors Edwin J. Piano, Aquilino Y. Cortez, Jr., Anselmo A. Aquino, Elena C. Dabu, Jonathan G. Manalo, and Cheenee F. Hoya as co-sponsors. The draft resolution was approved unanimously, in its second and final reading, on motion of City Councilor Gina G. Perez.
B. City Councilor Ellen Dabu moved for the urgency of Draft Resolutions R-96, R-97, and R-98, entitled “Resolutions Designating Dolores “Dolly” Yanan, Alma Bulawan, and Elsa Gonzaga as “Ambassadors of Goodwill” of the City of Olongapo,” in Connection with the 7th Meeting of the International Women’s Network on September 14 to 19, 2009 at the University of Guam, Mangilao, Guam, U.S.A. These measures were sponsored by City Councilor Lipumano–Garcia and she as co-sponsor. She explained that the said delegates are members of the Buklod ng Kababaihan ng Olongapo, which is an accredited NGO in the city. She further said that the meeting will benefit the women sector of Olongapo City.
With the motion to approve, Draft Resolutions 96, 97, and 98 were approved unanimously, in its second and final reading, on motion of City Councilor Elena C. Dabu, co-sponsored by City Councilor Lipumano-Garcia.
C. City Councilor Cortez introduced “A Resolution Reiterating the Request For LTFRB to Course all Applications for a Certificate of Public Convenience for Olongapo City thru the Office of the City Mayor for Appropriate Endorsements and to Declare the City as “Saturated Area” for Public Utility Vehicles.”
The resolution asks the LTFRB to give the city authority to assess and to allow or not additional public vehicles to operate within its jurisdiction, whether buses, jeeps, or tricycles, and to course such requests thru the Office of the City Mayor, and the City Council, whatever endorsements there will be regarding applications to operate in consonance with Resolution No. 36, passed in 1989. In addition, City Councilor JC delos Reyes said that under the Local Government Code, the City Mayor is given the power to summon the national officials for consultation whenever there are projects or programs to be implemented by the national offices that will affect the local government, specifically under Article 3.
Without further discussions, the Draft Resolution was approved unanimously, in its second and final reading, on motion of City Councilor Aquilino Y. Cortez, Jr.
D. The Presiding Officer wanted to know if there is any update on the Digitel and Smart applications. City Councilor Piano informed the body about the hearing that was conducted at the Session Hall and at 1190. According to him, he made a recommendation to the applicants to try to look for another location that will be acceptable to the residents.
