A RESOLUTION EXPRESSING OUR DEEPEST SYMPATHIES AND
 HEARTFELT  CONDOLENCES  TO  THE  BEREAVED FAMILY OF
 THE  LATE  REYNALDO RIVERA GINGCO FORMER BARANGAY
 KAGAWAD OF BARANGAY NEW CABALAN, OLONGAPO CITY

            WHEREAS, on October 11, 2014, former Barangay Kagawad Reynaldo Rivera Gingco has met his untimely demise which brought sadness to his family, friends and to his constituents he served as a former Barangay Kagawad;

            WHEREAS,  “Ka Rey”  as fondly called by his family and friends was born on April 12, 1951 in Cavite City and blessed with four (4) kids;

            WHEREAS, Ka Rey is a 7th Degree Blackbelt “Kyokushinkai”, Karate Instructor at the United States Naval Facility, Combat Karate Instructor at Camp Crame, Quezon City and member of Philippine Karate League;

            WHEREAS, Ka Rey has been elected Barangay Kagawad of Barangay New Cabalan, Olongapo City and served from 1997 to 2010 and during his 13 years of public service, he was awarded by the Department of Interior and Local Government through its Secretary Jose Lina as “Best Barangay Kagawad of Olongapo City;

            WHEREAS, with his abilities and hardwork being the Chairman of Committee on Peace and Order, he was able to perform his assigned tasks with efficiency and intelligence particularly in keeping the maintenance of peace and order in Barangay New Cabalan, Olongapo City;

            WHEREAS, Ka Rey during his lifetime, he was popular to the masses due to his constant love and concern to the plight of his constituents;

            WHEREAS, he was loved and respected by the community with his sudden demise has brought deepest sorrow not only to his family but his public compassion will still linger to all the people whom he touched lives;

            WHEREAS, the entire community of the City of Olongapo shares the moment of sorrow to the bereaved family of the late Barangay Kagawad Reynaldo Rivera Gingco and may our Lord bless his soul eternal rest and peace in His kingdom;

            NOW, THEREFORE, with the unanimous accord of all the Members of the Sangguniang Panglungsod present,

            RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in a session assembled to express as it is hereby expresses deepest sympathies and heartfelt condolences to the bereaved family of the late Reynaldo Rivera Gingco former Barangay Kagawad of Barangay New Cabalan, Olongapo City.

            Let a copy of this Resolution be furnished to the bereaved family of  the late Reynaldo Rivera Gingco as token of our respect and recognition of a good leader who served our City as Barangay Kagawad.

A RESOLUTION EXPRESSING PROFOUND SYMPATHY AND CONDOLENCES TO THE BEREAVED FAMILY OF SLAIN TRANSGENDER WOMAN JEFFREY “JENNIFER” LAUDE AND URGING THE NATIONAL GOVERNMENT TO ENSURE THAT PROMPT JUSTICE  WILL BE SERVED

WHEREAS, the Philippine Government enters into defense agreement with the United States of America through the Visiting Forces Agreement and the Enhance Defense Cooperation Agreement;

WHEREAS, with these agreements, US Military personnel were allowed to conduct activities or temporary stay in the Philippines to conduct mutual defense trainings such as Amphibious Landing Exercise or PHILBEX;

WHEREAS, US Navy Ships regularly conduct port visit in Subic Bay Freeport Zone, being the former US Naval Base for the rest and recreation (R & R) of their personnel, replenish their supplies, and repair of their ships;

WHEREAS, this year’s PHILBEX brings the USS Peleliu (LHA - 5) Expeditionary Strike Group to Subic Bay Freeport Zone for their R & R and, Olongapo City being the host city of the former US Naval Base, welcome the US servicemen hoping that their stay will provide additional boost to the economy of Olongapo;

WHEREAS, Olongapeños were shocked and deeply saddened by the tragic death of Filipino transgender woman Jeffrey “Jennifer” Laude allegedly by a suspected US serviceman;

WHEREAS, while we in Olongapo acknowledge the benefits of a Port of call of US Navy Ships in our local economy, we condemn this gruesome act against our fellow Filipino and we are united in demanding for the swift justice in the killing of Jennifer Laude;

WHEREAS, the National Government through the Visiting Forces Agreement Commission, Department of Foreign Affairs and Department of Justice have the jurisdictions in such cases we enjoin these government offices to act and seek swift justice for Jennifer before or within the one-year limit set forth in the VFA agreement;

NOW, THEREFORE, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to express as it hereby expresses profound sympathy and condolences to the bereaved family of slain transgender Woman Jeffrey “Jennifer” Laude and urging the National Government to ensure that prompt justice will be served.

Let copy of this Resolution be furnished to the family of Jeffrey “Jennifer” Laude, Department of National Defense, Department of Foreign Affairs and the Department of Justice for their information and prompt action.

RESOLUTION NO. 151
(Series of 2014)

A RESOLUTION STRONGLY INDORSING TO THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS THE PROPOSAL FOR THE RECLASSIFICATION OF RIZAL AVENUE EXTENSION (FROM UNITY  ROTONDA TO SBFZ BANICAIN GATE), MAGSAYSAY DRIVE EXTENSION (MT. APO ST.,TO SBFZ BANICAIN GATE) AND 14TH STREET (RIZAL AVENUE TO SBFZ 14TH GATE) AS NATIONAL ROAD

WHEREAS, the first road classification system in the country was established through Republic Act No. 917, known as the Philippine Highway Act, enacted in 1953 and Executive Order 113, Series of 1955 which classified roads into national roads (national primary and national secondary), “national aid” roads (roads of sufficient importance for eventual reclassification at a later state) and provincial/city/municipal/barangay roads;

WHEREAS, Executive Order No. 124, Series of 1987, stipulates that the Minister (now the Secretary) of the Ministry (now Department) of Public Works and Highways shall have the power to “Classify roads and highways into national, regional (interpreted as routes of primary arterial roads), provincial, city, municipal and barangay roads, based on objective criteria it shall adopt; provide or authorize conversion of roads and highways from one category to another”;

WHEREAS, Executive Order No. 113, also laid down the following additional criteria for classification of National Roads and criteria for re-classification from local roads to National Roads:

1.      National Roads shall have a right-of-way of not less than 20 meters, provided that a right-of-way of at least 60 meters shall be reserved for roads constructed through untitled public land.

2.      For re-classification of local roads, Executive Order No. 113 implies that proof of acquisition of the required road right-of-way shall be provided to the Department  (such as Deed of Donation of Sale duly notarized and indicating the lot number and area acquired, and Real Property Tax Declaration Number and/or Certification from the concerned Provincial Registry of Deeds and/or DENR in case of forested  land).  

3.      The National Roads forming the secondary trunk-line system shall exclude “feeder roads”, defined as roads branching off the trunk-line system and not being in line with the provisions in the second paragraph on this page.

4.      Any local road proposed for conversion shall meet the original criteria for classification of national Roads as described in the second paragraph on this page.  This requires that a proposal shall be accompanied by:  (i) an endorsement by the Provincial and/or Municipal Board to the Secretary of Public Works and Communications (now the Department of Public Works and Highways (DPWH); and (ii) a location map indicating kilometre stations at the start and end of the passable road and its relation to other road networks in the area.

5.      The Secretary of the DPWH shall declare re-classification of local roads to National Roads (reinforced by EO No. 124).

WHEREAS,  on July 5, 2013, Engr. Hercules C. Manglicmot, District Engineer of Department of Public Works and Highways wrote Hon. Rolen C. Paulino, City Mayor, Olongapo City seeking for the approval of a Sangguniang Panlungsod resolution endorsing the proposal for reclassification as required by the Department;

WHEREAS, on July 7, 2014, Hon. Rolen C. Paulino, City Mayor, Olongapo City indorsed the proposal to the City Council for approval;

NOW, THEREFORE, on motion of City Councilor Noel Y. Atienza, with  the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to strongly endorse, as it hereby strongly endorses  to the Department of Public Works and Highways the proposal for the reclassification of Rizal Avenue Extension (From Unity Rotonda to SBFZ  Banicain Gate), Magsaysay Drive Extension (Mt. Apo St., to SBFZ Banicain Gate) and 14th Street (Rizal Avenue to SBFZ 14th Gate) as National Road.

Let a copy of the foregoing resolution be furnished the Department of Public Works and Highway for their record and perusal.

            WHEREAS, Section 219 of the Local Government Code of the Philippines expressly states:

                        “General Revision of Assessment and Property Classification – The provincial, city or municipal assessor shall undertake a general revision of real property assessment within two (2) years after the effectivity of this Code and every three (3) years thereafter.”

            WHEREAS, the procedures prescribed by Section 212 of the same code have been complied with:

                        “Preparation of Schedule of Fair Market Values – Before any general revision of property assessment is made pursuant to the provision of this Title, there shall be prepared a schedule of fair market values by the provincial, city and the municipal assessors of the municipalities within the Metropolitan Manila Area  for the different classes of real property situated in their respective local government units for enactment by ordinance of the sangguniang concerned.  The schedule of fair market value shall be published in a newspaper of general circulation in the province, city, or municipality concerned or in the absence thereof shall be posted in the provincial capital, city of municipal hall and in two other conspicuous public places therein.”

            WHEREAS, Section 218 of Republic Act No. 7160 otherwise known as the Local Government Code of the Philippines provides that the assessment levels to be applied to the fair market value of real property to determine its assessed value shall be fixed by an ordinance of the Sangguniang Panlungsod at the rates as provided for under the said provision;

            WHEREAS, the City Assessor submitted to the Sangguniang Panlungsod the proposed  schedule of fair market values and thereafter, the Sangguniang Panlungsod, led by Chairman of Committee on Ways and Means conducted a series of briefings, consultations and meetings with the City Assessor and his staff as well as the Finance Committee concerning the proposed schedule with the view of threshing out every detail thereto;

            WHEREAS, the adoption of the proposed schedule of fair market value as such is beneficial to help increase the City’s revenue which will redound to the financial capability of the City towards transparency and good governance and immediate delivery of quality public service to its constituents;

            WHEREAS, Section 458 of the same code provides for the powers of the Sangguniang Panlungsod in the exercise of its legislative functions to wit:

                        Power, Duties, Functions and Compensation – (a) The sangguniang Panlungsod, as the legislative body of the city, shall enact ordinance, approve resolutions and appropriate funds for the general welfare of the city and its inhabitants pursuant to Section 16 of this Code and in the proper exercise of the corporate powers of the city as provided for under Section 22 of this Code and shall:

(1)    Approve ordinance and pass resolutions  necessary for an efficient and effective city government.

NOW, THEREFORE, on motion of City Councilor Noel Y. Atienza with the majority decision of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED,  by  the Sangguniang Panlungsod in session assembled, to enact the following Ordinance:

AN ORDINANCE ADOPTING/OR APPROVING THE SCHEDULE OF BASE UNIT VALUE PER SQUARE METER FOR LAND FOR GENERAL REVISION EFFECTIVE YEAR 2015 AND  SCHEDULE OF MARKET VALUES FOR BUILDING PER SQUARE METER (FLOOR AREA) AND FIXING THE ASSESSMENT LEVELS TO BE APPLIED THERETO TO DETERMINE THE CORRESPONDING ASSESSED VALUES FOR PURPOSES OF THE 2016 GENERAL REVISION OF PROPERTY ASSESSMENTS TO BE UNDERTAKEN HEREAFTER PURSUANT TO THE PROVISIONS OF REPUBLIC ACT NO. 7160 OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF THE PHILIPPINES

            BE IT ORDAINED, BY THE SANGGUNIANG PANLUNGSOD IN SESSION ASSEMBLED THAT:

            SECTION 1.  The schedule of fair market values of properties in the City of Olongapo submitted by the City Assessor as herein attached in two (2) pages with caption “Schedule of Base Unit per square meter for land and Schedule of Market Values for building per square meter (floor area) both for General Revision effective year 2016” are hereby adopted.  Provided that the said Schedules of Market Values of Real Property shall be made an integral part thereof.

            SECTION 2.  This Ordinance shall take effect upon its approval.  Provided, however that the assessments to be made on the basis of the schedule of fair market values adopted and assessment levels fixed by this Ordinance shall take effect on the first day of January 2016 as provided for the Section 221 of the Code and Article 312 of the Implementing Rules and Regulations.
