        A RESOLUTION AUTHORIZING THE CITY MAYOR, HONORABLE ROLEN C. PAULINO TO ENTER INTO,  EXECUTE AND SIGN A MEMORANDUM OF AGREEMENT (MOA) WITH THE METRO OLONGAPO CHAMBER OF COMMERCE, INC. (MOCCI/OBC) , REPRESENTED BY ITS PRESIDENT MR. RUBEN DE GUZMAN, FOR THE MANAGEMENT OF THE OLONGAPO MARDI-GRAS FESTIVITIES ON OCTOBER 2014

             WHEREAS, the annually celebrated Olongapo Mardi-gras boost up the City's tourism and enlivens the livelihood of the community by showcasing the home grown talents, the uniqueness of product and services of the local businesses and the culture of Olongapo City:

              WHEREAS, the City Government recognizes the efforts of the Olongapo businessmen like MOCCI/OBC in bringing substantial economic development through tourism activities planned by the City:

              WHEREAS, the successful celebration of the Olongapo Mard-gras in the past has been spearheaded by MOCCI/OBC with the City Government that triggered an influx of visitors, tourists and attendees at Ramon Masaysay Drive as well as encouraged groups or individuals to become entrepreneurs which helps boost the local economy and further promote the City as a hub for both business and leisure;

               WHEREAS, during the meeting of the City Mayor Rolen C. Paulino with the Metro Olongapo Chamber of Commerce, Inc. (MOCCI/OBC) held  of  February 5, 2014, the businessmen once again expressed their intention to sponsor this year's Mardi-gras  together with the City Government;

               WHEREAS, in order for this activity to take effect, the City as represented by the Honorable City Mayor Rolen C. Paulino must enter into a Memorandum of Agreement with the Metro Olongapo Chamber of Commerce (MOCCI/OBC), Inc. represented by its President Mr. Ruben De Guzman;

                NOW, THEREFORE, on motion of City Councilors Edna A. Elane  and Aquilino Y. Cortez, Jr.  with the unanimous accord of the Members of the Sangguniang Panlungsod present;

                RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to authorize,  as it hereby authorizes the City Mayor, Honorable  Rolen C. Paulino to enter into,  execute and sign  a  Memorandum of Agreement  (MOA)  with the Metro Olongapo Chamber of Commerce, Inc. (MOCCI/OBC),  represented by its President, Mr Ruben De Guzman,  for  the  management  of  the  Olongapo Mardi-gras Festivities on  October 2014.

                  RESOLVED FURTHER, AS IT IS HEREBY FUTHER RESOLVED, that a copy of  the  Memorandum  of  Agreement   between  the  Honorable  City  Mayor  Rolen  C.  Paulino and  Metro   Olongapo  Chamber  of  Commerce  Inc.  (MOCCI/OBC)  be  made  as  integral part of this resolution.

   A RESOLUTION ADOPTING THE GORDON COLLEGE BOARD OF TRUSTEES RESOLUTION NO. 5, 2014 ENTITLED: “A RESOLUTION ENDORSING THE REQUEST OF GORDON COLLEGE FOR SUPPLEMENTAL BUDGET IN THE AMOUNT OF FOUR HUNDRED NINETY TWO THOUSAND SEVEN HUNDRED FORTY PESOS & 37/100 (PHP492,740.37)  TO BE SOURCED FROM THE BALANCE OF TRUST FUND AS OF DECEMBER 31, 2013 REPRESENTING PARTIAL PAYMENT OF BACKWAGES TO MS.              WHEREAS, the Sangguniang Panlungsod deems proper that the resolutions endorsed by Gordon College Board of Trustees pursuant to City Resolution No. 61, Series of 2013 is necessary for adoption;

              WHEREAS, City Ordinance No. 8, Series of 2010, entitled: “An Ordinance Amending the Legal Basis on the Creation and Operation of Gordon College” defines the functions of the Board of Trustees of the Gordon College;

              WHEREAS, it is indeed necessary to carry out the purposes and functions of the College;

            NOW, THEREFORE, on motion of City Councilors  Benjamin G. Cajudo II co-sponsored by City Councilor Elena C. Dabu, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

RESOLUTION NO. 72

A RESOLUTION REQUESTING THE OFFICE OF THE PRESIDENT AND CONGRESS OF THE PHILIPPINES TO CONDUCT A THOROUGH STUDY ON THE POSSIBILITY OF EXTENDING THE TAX PRIVILEGES ACCORDED TO THE SUBIC BAY FREEPORT ZONE TO THE CITY OF OLONGAPO

             WHEREAS, Section 12 of Republic Act 7227 otherwise known as “The Bases Conversion and Development Act of 1992 states:

                        “Subject to the concurrence by resolution of the Sangguniang Panlungsod of the City of Olongapo and the Sangguniang Bayan of the Municipalities of Subic, Morong and Hermosa, there is hereby created a Special  Economic and Freeport Zone consisting of the City of Olongapo and the Municipality of Subic, Province of Zambales, the lands occupied by the Subic Naval Base and its contiguous extensions as embraced, covered and defined by the 1947 Military Bases Agreement between the Philippines and United States of America as  amended and within the territorial jurisdiction of the Munipalities of Morong and Hermosa, Province of Bataan, hereinafter referred to as the Subic Special Economic Zone whose metes and bounds shall be delineated in a proclamation to be issued by the President of the Philippines.  Within thirty (30) days after the approval of this Act, each local government unit shall submit the resolution of concurrence to  join the Subic Special Economic Zone to the Office of  the President.  Thereafter,  the President of the  Philippines shall issue a proclamation defining the metes and bounds of the zone as provided herein.

              WHEREAS,  the seeming  unequal footing confronting the businessmen in the City of Olongapo has been referred to the City Government of Olongapo City  for appropriate action;

              WHEREAS,  it is further stated in Section of Republic Act No. 7227 otherwise known as “The Bases Conversion and Development Act of 1992” particularly under Paragraph (b) which provides:

            (b)  The Subic Special Economic Zone shall be operated and managed as a separate customs territory ensuring free flow or movement of goods and capital within, into and exported out of the Subic Special Economic  Zone as well as provide incentives such as tax and  duty free importations of raw materials, capital and  equipment.  However, exportation or removal of goods from the territory of the Subic Special Economic Zone to the other parts of the Philippine territory shall be subject to custom duties and taxes under the Customs and Tariff Code and other relevant tax laws of the Philippines.

            WHEREAS,  the City of Olongapo is seeking to  be part of the economic zone in order to enjoy the same tax benefits accorded to the Subic Special Economic Zone however, there is a need to conduct a thorough study of the legal effects of the extension of the tax privileges to the City of Olongapo insofar as its duly elected officials as whether their positions shall be automatically abolished and to be under the administration of the Subic Bay Metropolitan Authority;

               WHEREAS, it is imperative to conduct the said study in order to include the City of Olongapo within the customs territory of the Subic Special Economic Zone without prejudice to the performance of official functions of the duly elected officials of the City of Olongapo’

                NOW, THEREFORE, on motion of City  Councilor Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod present;

                RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled to request,  as it hereby requests the Office of the President and Congress of the Philippines to conduct a thorough study on the possibility of extending the tax privileges accorded to the Subic Bay Freeport Zone to the City of Olongapo.

Let a copy of the foregoing resolution be furnished the Office of the President,  House of Senate and Representatives.
