A RESOLUTION EARNESTLY REQUESTING HON. HERMOGENES E. EBDANE, JR., SECRETARY OF THE DEPARTMENT OF PUBLIC WORKS AND HIGHWAYS, THRU THE DPWH DISTRICT ENGINEER TO EFFECT THE ASPHALTING OF ROAD SHOULDERS ALONG THE NATIONAL HIGHWAY FROM BARANGAYS OLD AND NEW CABALAN, KALAKLAN AND BARRETTO, OLONGAPO CITY

WHEREAS, there are some road shoulders in different areas along the National Highway particularly the roads from Barangay Old and New Cabalan, Kalaklan and Barretto, Olongapo City that remain unasphalted and if left unattended, will pose threat to lives and properties of motorists and commuters in the City;

WHEREAS, to ensure safety of motorists and commuters plying these routes and to avoid further loss of lives and properties, this body hereby earnestly requests the Honorable Secretary of the Department of Public Works and Highways to effect the asphalting of road shoulders along these particular areas of the City;

NOW, THEREFORE, on motion of Councilor Anselmo A. Aquino, with the unanimous accord of the Members of the Sangguniang Panlungsod present,

RESOLVED, AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session assembled, to request, as it hereby requests, Hon. Hermogenes E. Ebdane, Jr., Secretary of the Department Of Public Works and Highways, thru the DPWH District Engineer to effect the asphalting of road shoulders along the National Highway from Barangays Old and New Cabalan, Kalaklan and Barretto, Olongapo City

RESOLVED FURTHER, AS IT IS HEREBY FURTHER RESOLVED, that copies of this Resolution shall be furnished Hon. Hermogenes E. Ebdane, Jr., Secretary of the Department of Public Works and Highways, Manila, for his favourable consideration and the District Engineers of the Department of Public Works and Highways – Iba, Zambales and Olongapo City Offices, for their information, support and endorsement.

The City Vice-Mayor and Presiding Officer Cynthia G. Cajudo called the session to order at 4:40 in the afternoon.

As an addition to the agenda, Councilor Edwin J. Piano moved for the inclusion of a draft resolution under the First Reading, entitled “A Resolution Requesting The Subic Bay Metropolitan Authority (SBMA) And Subic Freeport Locators To Donate Scrap Materials And Equipment To The City Of Olongapo For Various Livelihood And Skills Training Program.”

Councilor Cerezo manifested for the change of Item No.1 on First Reading, Draft Ordinance No. 2008-O-11 to Draft Ordinance No. 2008-O-12.

Regarding Item No. 6, on the Second Reading Councilor Perez manifested that Councilor delos Reyes shall be her co-sponsor.

With no other observations, on motion of Councilor Cerezo, the body approved the day’s agenda as amended.

1. Letter from Ms. Marey Beth D. Marzan, City Planning Officer, City Planning & Development Office addressed to the City Council requesting for the Council’s Calendar of Activities for 2008 to be included in the Unified Calendar of Activities for the local government unit of Olongapo.

First Endorsement from the City Mayor James Gordon, Jr. addressed to the Sangguniang Panlungsod regarding the letter of SAVP Lydia Maglalang, Head, RMC Central Luzon, Development Bank of the Philippines, on the PhP23 million one on one loan of the City with DBP. The letter states that the submission of the Sangguniang Panlungsod Resolution in connection with the City’s request for extension of the maturity of the promissory note from January 13 to April 13 is indispensable. 15. Memorandum from City Mayor James Gordon, Jr. addressed to all City Government Department Heads, regarding Letters, Memos, and EO Proposals. All proposed letters, memos and executive orders submitted to his office for his approval has been noted that proposals are written in their final form and without accompanying cover letter of endorsement requesting his approval. In this regard, the Mayor hereby advises everyone that pending approval of the proposals such should be submitted in their draft form, with the required attachment. (For information and guidance)

16. Memorandum to all City Employees concerned from Mr. Marcelino D. Andawi regarding the use of coffee and consumables at the Tax Payer’s Lounge.

17. Memorandum from the City Administrator addressed to all Department Heads and Chief of Offices, Assistant Department Heads, Assistant Chief of Offices and Division Chiefs regarding the Mass Wedding Ceremony. The memorandum states that it would be appreciated if the concerned will bring with them token gifts that may cost from PhP200.00 to PhP500.00 each. (Referred to the Committee on Education)

Committee Reports

Under the Committee on Finance and Appropriation, Councilor Perez reported about the various communications from the barangays which was referred to her for study. Committee meetings were conducted to discuss with concerned barangay officials the matters affecting their barangays. For Barangay Asinan, the collection of terminal fees for tricycles and jeepneys operating within their jurisdiction as well as the collection of rental fees for sidewalk vendors were found to be illegal for reasons that under the law, street roads and sidewalks are public domain therefore, they are beyond the commerce of man.. They were advised not to continue with their legislations of approving Barangay Ordinances imposing fees for tricycles and jeepneys. The Transport Cooperative President, however, agreed to give donations to their barangay as financial support. This is provided that corresponding MOA be signed by both parties as suggested by Council members. On the other hand, the Finance Team composed of the City Treasury, Budget and City Accountant advised Barangay East Bajac Bajac to arrange a meeting with the City Mayor for the renewal of the MOA regarding the 80% share from the collection fees from ambulant vendors, since the previous MOA was signed by former Barangay Captain Grospe and Mayor Kate Gordon. Also, the advise of COA to all Barangays to improve their system of collection by imposing controlled receipts for efficient financial reporting was also reported. Regarding the Resolution of Barangay New Cabalan, the Finance Team gave no objection to the said resolutions. Except for Resolution No. 26, the COA did not allow cash advances for certain fees to be paid to a supplier but only for travels. With regard to Barangay Budget of Brgy. Old Cabalan the Councilor said that the draft will be prepared by the City Council.

On another topic, she informed the body that she intends to defer the proposed ordinance on the creation of Dental Health Section and proposed resolution authorizing the City Mayor to enter into a MOA with Preventive Motor Supplies Services for further discussions.

The Chair wanted it clarified if there is a need for them to pass a resolution to correct the deficiencies of the resolution approved by the barangays. According to Councilor delos Reyes, if there is something irregular with barangay resolutions, they can just make comments and give them advise to correct whatever errors. He added there would be a committee to look into these kind of documents. It was Councilor Marzan who volunteered to do the task, but she’s no longer around.

Under the Committee on Livelihood, Councilor Dabu rendered her report regarding the holding of a barangay consultation livelihood program together with Ms. Aileen Cuevas of the Livelihood Cooperative Center assisted by the personnel of the PNP who discussed with them the various ordinances pertaining to the operation of Sari-Sari Stores. The consultation resulted to a very encouraging participation of a number of residents who expressed interest in meat processing as a means of livelihood. Ms. Cuevas also informed the participants the full support of Mayor Bong Gordon on this endeavor by extending his pledge of financial assistance to start up a Sari-Sari Store business. Also, Councilor Dabu shared to the body the need to amend the ordinance on livelihood which was passed in 1995. For other updates, she said that Barangay Banicain is also requesting for a medical mission in the barangay. She also assured the residents to bring up the matter to the attention of Councilor Gie Baloy as head of the Committee on Health.

On matters pertaining to the activities of the Local Price Coordinating Council, Councilor Dabu expressed that they conducted the monitoring of the 3 public markets which resulted with the confiscation of least 20 pieces of defective weighing scales. The City Health Office was also requested to look into the problem on the proliferation and use of “magic sugar”, a substance commonly used by vendors selling fruit juices to enhance its taste, but is believed to be harmful to the health of children, specifically. She mentioned about the need to pass an ordinance regarding this. Also, in order to have an efficient enforcement of inspections, a mobile vehicle from the barangay needs to be provided with especially in Barangays EBB; WBB, Pag-asa, Barretto and Cabalan.

In line with the celebration of Women’s Month for March, Councilor Dabu as Chair of the Committee on Women, announced the various activities to be conducted. Starting with the Flag Ceremony on March 3, with all Lady Councilors hosting, there will be a parade of women’s group on March 4 and other activities such as mobile birth registration, trade fair, medical mission, libreng gupit, PAP smear, and Buntis Party to be held at the Rizal Triangle. Invited to grace the occasion is a choice from Gov. Belle Angara, Dinky Soliman or Etta Rosales.

Councilor Cerezo reported that Barangay Tanod Enhancement Training has started at Brgy. Kalaklan with 60 participants composed of Tanods and Purok Leaders. Another group from Brgy. Mabayuan, Sta. Rita and Gordon Heights with 164 participants likewise participated. The Councilor also attended the awarding for the Best Police Office of the Year in Region 3 held at Camp Olivas, San Fernando City.

1. Draft Ordinance No. 2008 O-04 – “An Ordinance Prescribing For The Mandatory Posting Of Notice And Information Regarding Child Protection On Establishments Whose Operation Of Business Is Prejudicial To The Development And Welfare Of Minors,” was deferred by the body on motion of Councilor Rodel S. Cerezo co-sponsored by Councilor Angelito W. Baloy, since public hearings are still to be scheduled.

2. On motion of Councilor Cerezo co-sponsored by Councilor Edwin J. Piano, Draft Resolution No. 2008 – R-011 – “A Resolution Adopting The Computerization Project Of Various Departments Of The City,” was deferred pending the submission of requirements.

3. Draft Ordinance No. 2008 – O-05 – “An Ordinance Providing For Tourism-Environmental Education Program In The City Of Olongapo, Prescribing Measures For Its Implementation Thereof, And For Other Purposes,” was deferred for further replenishing by the body on motion of Councilor Rodel S. Cerezo co-sponsored by Councilors Gina G. Perez and Aquilino Y. Cortez, Jr.

4. On motion of Councilor Piano, Draft Resolution No. 2008 R-012 – “A Resolution Approving The Annual Budget Of Barangay Gordon Heights, City Of Olongapo For The Calendar Year 2008,” was deferred awaiting the opinion from the DBM.

5. Draft Resolution No. 2008 R-013 – “A Resolution Approving The Annual Budget Of Barangay West Tapinac, City Of Olongapo For The Calendar Year 2008,” was deferred awaiting the opinion from DBM on motion of Councilor Edwin J. Piano.

6. Draft Resolution No. 2008 R-014 – “A Resolution Authorizing The City Mayor, Hon. James Gordon, Jr., To Enter Into A Memorandum Of Agreement In Behalf Of The City Of Olongapo With Mr. Carlo Marcelo, Proprietor Of Preventive Motor Supplies Services, Regarding The Repair And Maintenance Of The City Owned Tow-Truck Under The Office Of The Traffic Management And Public Safety,” was deferred by the body on motion of Councilor Gina G.
